PHASE 1 – CONTRACT 5

PROJECT NO. CWSRF – 8349/5

INVITATION TO BID

Sealed Bids for construction of Wastewater Collection and Water Resource Recovery Facilities, Phase 1 – Contract No. 5 will be received by the Town of Yarmouth, Massachusetts at the Department of Public Works, 74 Town Brook Road, West Yarmouth, MA 02673 until 1:00 PM, June 5, 2025 and at that time bids will be publicly opened and read aloud in the conference room.

The work of this contract includes, but is not limited to, furnishing and installing approximately 8,000 linear feet of 8-inch to 30-inch polyvinyl chloride (PVC) and ductile iron (DI) sewer pipe; 9,000 linear feet of 16-inch PVC force main; one submersible pumping station (PS3); manholes, sewer service connections and appurtenances; 6-inch and 10-inch double-barrel siphon below the Parkers River by horizontal directional drilling (HDD); approximately 7,100 linear feet of 6-inch to 12-inch Class 52 DI water main; including water service connections, fittings, valves, hydrants, connections to the existing water system, cutting, capping and abandoning existing water mains; earthwork; dewatering and drainage; paving; restoration; and all miscellaneous work and cleanup as specified.

The Contract Time shall be 900 Calendar Days commencing twenty days following the Effective Date of the Agreement.

Contract Documents may be examined and/or obtained online at https://www.yarmouth.ma.us/bids.aspx after 2:00 PM beginning May 14, 2025.

Contract Documents may be examined at, but not removed from, the office of the Town of Yarmouth Department of Public Works (DPW), 74 Town Brook Road, West Yarmouth, MA 02673 and at the office of CDM Smith, 3 Davol Square, Building A, Suite A425, Providence, RI 02903.

Each Bid shall be submitted in accordance with the Instructions to Bidders and shall be accompanied by a Bid Security in the amount of five percent of the Bid.

Bidders may not withdraw their Bids for a period of sixty days, excluding Saturdays, Sundays, and legal holidays after the actual date of the opening of the Bids.

The Successful Bidder must furnish a 100 percent Performance Bond and a 100 percent Payment Bond with a surety company acceptable to the Owner.

Minimum Wage Rates as determined by the Executive Office of Labor and Workforce Development under the provision of the Massachusetts General Laws, Chapter 149, Section 26 to 27H, as amended, apply to this project.  It is the responsibility of the Contractor, before bid opening, to request if necessary, any additional information on Minimum Wage Rates for those tradespeople who may be employed for the proposed work under this Contract. Federal Minimum Wage Rates as determined by the United States Department of Labor under the Davis-Bacon Act also apply to this project.

The bidding and award of this Contract will be under the provisions of M.G.L. Chapter 30, Section 39M.

Massachusetts Department of Transportation (MassDOT) prequalification of contractors with the class of work as, SEWER & WATER, for the project with an estimated value of $22,950,000 will be required.

The Owner reserves the right to waive any informality in or to reject any or all Bids if deemed to be in its best interest.

The work under this Contract is funded in part by the Massachusetts Clean Water Trust (the "Trust").

Disadvantaged Business Enterprise (DBE) goals are applicable to the total dollars paid to the construction contract. The goals for this project are a minimum of 4.20 percent D/MBE participation and 4.50 percent D/WBE participation by certified DBEs.  The two low bidders shall submit completed DBE forms (EEO-DEP-190C & EEO-DEP-191C and the DBE Certification of United States Citizenship form) by the close of business on the third business day after bid opening.  Failure to comply with the requirements of this paragraph may be deemed to render a proposal non-responsive.  No waiver of any provision of this section will be granted unless approved by the Department of Environmental Protection (MassDEP).

This Project requires compliance with the Department of Environmental Protection's (DEP) Diesel Retrofit Program by use of after-engine emission controls that are EPA certified, or their equivalent, on all of the off-road (non-registered) diesel vehicles/equipment, and vehicles greater than 50 brake horsepower, which will be used in the performance of the work.
