W-93MIAMI SPECIAL UTILITY AUTHORITYINSTRUCTIONS TO BIDDERSEXAMINATION OF BID DOCUMENTS Each Contractor by offering its Bid represents that ithas read and understands all documents comprising the Request for Formal Bids. TheContractor shall include in its Bid any and all costs that may be necessary to complete thework in accordance with the requirements of the contract documents.INTERPRETATION OF CONTRACT DOCUMENTS Questions regarding documents,discrepancies, omissions, or intent of the Specifications or drawings shall be submitted inwriting to the MSUA through the Engineer or purchasing agent at least twenty (20) days priorto opening of bids to provide time for issuing and forwarding an addendum. Any interpretationof the Contract Documents will be made only by addendum duly issued or delivered by theMSUA to each person receiving a set of documents. The MSUA will not be responsible forany other explanations or interpretation of the contract documents.MATERIAL SUBSTITUTION Each Contractor shall base its Bid upon the materials andequipment as described in the Request for Formal Bids. The successful Contractor will notbe allowed to make any substitutions on its own initiative, but in each instance will be requiredto obtain authorization from the MSUA before installing any work in variance with therequirements of the Contract Documents.LOCAL CONDITIONS AFFECTING Each Contractor shall visit the site of the work andthoroughly and fully inform itself relative to construction hazards and procedure, labor, andall other conditions and factors, local and otherwise, which would affect the prosecution andcompletion of the work and the cost thereof, including the arrangement and conditions ofexisting structures and facilities affecting or which are affected by the proposed work, accessto the site, the availability and cost of labor, and available facilities for transportation, handlingand storage of materials and equipment. It is understood and agreed that all such factorshave been properly investigated and considered in the preparation of every Bid submittedand there will be no subsequent financial adjustment to any Contract award here under, evenin the event the lack of such prior investigation affects the cost of the work.SUBSURFACE CONDITIONS The Contractor shall be completely responsible forinvestigating subsurface conditions that may affect the proposed work and prepare its Bidaccordingly. The existence of unforeseen subsurface conditions, whether investigated or not,that adversely affect the work, shall not entitle the successful Contractor to any additionalcompensation.QUALIFICATIONS OF CONTRACTOR To assist in determining the best Bid in the interestof MSUA, each Contractor must complete the attached “Qualification Statement ofContractor” which seeks the following information: (a) address of permanent place ofbusiness; (b) list of Contractor-owned equipment available to complete the work properly andexpeditiously; (c) list of equipment Contractor expects to rent or lease to complete the work4MIAMI SPECIAL UTILITY AUTHORITYproperly and expeditiously; (d) financial records showing Contractor’s ability to meetobligations incident to the work; and (e) list of similar projects completed. Each proposer mustcomplete the attached “Qualification Statement of Bidders.”Each Contractor may be required to show that former work performed by it has been handledin such manner that there are no just or proper claims pending against such work. NoContractor will be acceptable if it is engaged on any other work which impairs its ability tofinance this Contract or provide proper equipment for the proper execution of same. EachContractor shall demonstrate its ability by meeting all requirements herein stipulated.BID SECURITY. No Bid will be considered unless accompanied by a cashier’s check, acertified check or a Bidder’s bond in the amount of ten (10) percent of the Bid, as a guaranteethat if the Bid is accepted, the Bidder will execute the agreement and file bonds and insuranceas required by the Contract Documents within 10 days from and after the date of theacceptance of the Bid by the MSUA.RETURN OF BID SECURITIES. The security of all unsuccessful Bidders will be returnedafter the execution of the agreement with the successful Bidder and the approval of its bondsand insurance. If all Bids are rejected, all securities will be returned at the time of rejection.AGREEMENT, BONDS, INSURANCE The attention of Contractors is specifically directed tothe forms of agreement and bonds to be executed and the type of insurance to be taken outin the event a Contract award is made. The Contractor, to whom the work is awarded, will berequired to furnish the following Surety Bonds and Liability Insurance. An irrevocable letterof credit may be substituted for each bond if approved by the City Attorney. Performance Bond. A performance bond to the MSUA in an amount equal to 100%of Contract Price. Statutory Bond. A statutory bond to the MSUA in an amount equal to 100% of theContract Price. Maintenance Bond. A maintenance bond to the MSUA in an amount equal to theContract Price to protect against defective workmanship and materials for a periodof (1) one year after acceptance of the project, and payment of all labor and materialsincluding the prime Contractor and all subcontractors. Liability Insurance with necessary endorsements and certificate naming the MSUAas an Additional Insured. The insurance policy shall provide coverage in the amountof One Million Dollars ($1,000,000) per occurrence and Five Million Dollars($5,000,000) in the aggregate. Workers’ Compensation Insurance. In the absence of Workers’ Compensationinsurance, a signed affidavit for exempt status must be provided. The insurancepolicy shall provide coverage in the amount of One Million Dollars ($1,000,000) peroccurrence and Five Million Dollars ($5,000,000) in the aggregate.Each bond shall be executed on the forms attached, signed by a surety company authorizedto do business in the State of Oklahoma and acceptable as a surety to the MSUA. With eachbond there shall be filed with the MSUA one copy of the “Power of Attorney” certified toinclude the date of bond.A letter of credit from a bank for the total amount of the Bid project may be used, if approvedby the City Attorney, in lieu of bonds.5
