In the event that the CiTi Business Office is closed due tounforeseen circumstances, the bid deadline will be extended tothe next business day when CiTi is open for business. Thetime of day will remain 1:00 p.m.10. A public bid opening will take place on March 17, 2026, at1:00 p.m.11. All public bid openings hosted by CiTi are made availablevirtually via the Zoom platform. Bidders and members of thepublic who wish to join the bid opening in-person must followall visitor policy guidelines when present on CiTi property.12. For Sealed Bid Submissions: Bidders must supply signedhard copies of their completed bids in a sealed envelopemarked with the name of the bidder and the bid number on thefront of the envelope to the address listed in the mannerspecified within the Bid Documents. CiTi also stronglyencourages the submission of the bid pricing (in excelformat) on either a CD or flash drive along with the signedhard copies of all the required bid documents. Please referto the “Instructions for the Submission of the VendorResponse Sheet” for information on how to properly fillout the forms.13. The CD or Flash Drive must be clearly labeled with the nameof the bid, the bid number, and the bidder’s name.14. All express envelopes must be clearly marked with thewords “Sealed Bid Enclosed” on the front of the outsideenvelope. This is important in assuring that the bid isdelivered properly. The sealed bid envelope must be includedin the express envelope.15. For Electronic Bid Submissions: Bidders must supply asigned photocopy of the bid forms and a completed vendorresponse sheet (in excel format) via BidNet Direct. Pleaserefer to the “Instructions for the Submission of the VendorResponse Sheet” for information on how to properly fillout the forms.16. The proposal as presented shall remain valid for a minimumperiod of sixty (60) days from the date of bid opening.17. Bidder must insert the price per unit as specified and the priceextension accordingly against each item bid. In the event of adiscrepancy between the unit price and the extension, the unitprice will govern. Prices shall be extended in decimals, notfractions.18. In order to ascertain that bid items conforms to thespecifications, vendors should provide CiTi with stocknumbers for reference during the analysis process. If CiTi isunable to verify that the item bid conforms to thespecifications through a catalog, website or cut sheets, CiTireserves the right to reject that item bid.Bid Information, Instructions and Special Conditions, Page 1 of 319. BIDDERS PLEASE NOTE: The words "Or Equivalent"shall be considered as added to each specification, except ininstances where “ONLY” or “NO SUB” is stated. CiTireserves the right to request samples of items where anequivalent is bid. It is the responsibility of the bidder tonotify the CiTi when such substitutions are incorporated.Please note any substitutions on the bid form. Pleaseindicate your Catalog/Vendor Item Number in the spaceprovided on the electronic bid form. Vendors may be requiredto send catalogs to the School Districts if requested.20. Standard colors for colored paper are: blue, canary, cherry,goldenrod, green, ivory, lavender, lilac, pink and salmon. Anypaper that is packaged in cellophane MUST have a pull tab orother mechanism for easy opening.21. A vendor’s website link to the vendor’s ‘up to date’ onlinecatalog may be accepted. The vendor’s catalog/item numbermust correlate to the item being bid to verify conformity tothe item specification. A bid item will not be accepted if thevendor’s catalog/item number does not provide or link to theitem’s information as bid.22. If the vendor is offering a substitute item with the samepackaging as the items specified, the vendor shall provide thesubstitute information as well as the packaging information.The bid software will not recognize the vendor substituteoffer if the packaging information is not provided and willnot evaluate the bidders pricing for that item. Failure toprovide packaging information with a substituted item willresult in the rejection of the bid item.23. The bidder shall not change or provide the bid sheets in adifferent format than the one provided. Any change in theelectronic format will prevent the CD or travel drive frombeing read by the bid evaluation software and therefore willresult in the rejection of the bidders’ submittal.24. The following three (3) forms are included herein and form apart of this bid proposal: 1. Bid Proposal Certifications (Non-Collusion Bidding Certification and Conflict of InterestCertification). 2. Exceptions or Limitations/Acknowledgementof Terms and Conditions. 3. Iran Divestment Act Certificate ofCompliance. Failure to fully execute these three (3)statements will constitute grounds for rejection of a bidsubmission.25. The bidder shall state the discount that will be allowed in theSchool Districts for prompt payment. In the absence of such astated discount payment will be made approximately thirty(30) days after receipt of materials and invoice.26. All bids are to be on the basis of delivery prepaid todestination.27. CiTi reserves the right to waive any informality on bidsreceived.28. Each participating School District will prepare its ownindividual Purchase Order for its respective share of the bid.Quantities listed on the bid are from the school districts listedas active participants.30. Delivery is to be made to multiple locations in each SchoolDistrict. The Purchase Order shall designate the place ofdelivery.31. Invoices shall be presented to each School District for thequantities ordered as per the Purchase Order.32. Purchases made by the School Districts because they aregovernmental agencies are not subject to any sales tax.33. Delivery is to be made per the included Delivery Schedule.Partial shipments will be expected if the full shipmentcannot be made within the Delivery Schedule. Payment fora partial shipment will be made upon receipt of the invoice forthe items delivered. The vendor must make note on theincluded Exception Sheet if they cannot deliver per theDelivery Schedule. If no timeline is noted, delivery should bemade within 30 days ARO.34. It is expected that any items bid with expiration dates will notexpire until after the conclusion of the bid contract. Any itemsreceived by the districts that expire before the conclusion ofthe bid contract will be returned to the vendor at the vendor’sexpense and will be credited or replaced at no additional costto the school.35. A MATERIAL SAFETY DATA SHEET must accompanyeach bid item delivered containing a Chemical Substance.Failure to include these requisite data sheets will prohibit theprocessing of payment.36. After receipt of an order, the vendor agrees to call the districtwithin three working days, concerning any out-of-stock items,or defect in the purchase order. If a district is forced topurchase out of stock items or items not meeting specificationsfrom another vendor, the difference must be paid by theoriginal vendor.37. During the scheduled delivery times, the vendor agrees toremove all damaged cases that are visible and all products thatare found damaged upon opening, or products which do notmeet specifications.38. Pertinent information: Damaged goods not removed by thevendor, as stated, will be regarded as abandoned and thedistrict shall have the right to dispose of them as its ownproperty. This condition addresses the following concerns:a. Damaged cases discovered during and after deliveryb. Products that do not meet specificationsc. Storage of such itemsd. Ownership of such itemsBid Information, Instructions and Special Conditions, Page 2 of 339. In any of the situations mentioned, the vendor is required topick up damaged goods at the time of delivery andimmediately issue credit. Additionally, if the discrepanciesare not noted until after receipt of the goods, the vendor agreesto pick up the items on the next delivery. In either event, ifthe vendor does not adhere to these terms, the district gainstitle to the property and needs only to maintain a record of thedelivery date and the item codes to be entitled to credit.Force Majeure40. The successful bidder shall not be held responsible for anylosses resulting if the fulfillment of the terms of the contractshall be delayed or prevented by wars, acts of public enemies,strikes, fires, acts of God, or for any other acts not withincontrol of the successful bidder and which by the exercise ofreasonable diligence he/she is unable to prevent.41. Products and quantities listed on the bid are CiTi’s bestestimate based on the projected instructional plan for CiTiand participating school districts. If CiTi or the participatingschool districts’ instructional plans change due to unforeseenand/or a force majeure event, the actual quantities purchasedmight also change.Award42. Notice of Award shall be made to the successful bidder withinsixty (60) days from the date of bid opening. The award forthis bid will take place at the May 13, 2026, CiTi BoardMeeting.43. The bid award will be in a line-by-line manner or bysubcategory method.44. Vendors may not be considered for an award if there are not asubstantial amount of items or value of items to be awarded tothe vendor and/or where an award of these items would resultin the ordering members processing purchase ordersamounting to $25.00 or less, or where the minimum orderingamount cannot be met.45. The CiTi/School District and the vendor will submit allcomplaints in writing to the appropriate party(s) within four(4) days of occurrence of any incident. The CooperativeBidding Office will maintain a file of all complaints that aresubmitted from both the CiTi/School District and the vendor.46. This will be a 6-month bid. The bid period will be from6/1/26 to 11/30/26.47. Failure to adhere to these instructions will constitutegrounds for rejection of the bid.B26-2201A Copy Paper & EnvelopesOswego County Board of Cooperative Educational ServicesHolly Cheeley, Bid SpecialistBid Information, Instructions and Special Conditions, Page 3 of 3Center for Instruction,Technology & InnovationA Board of Cooperative Educational Services179 County Route 64Mexico, NY 13114GENERAL CONDITIONS(For the Purchase of Materials, Supplies,Equipment, and Services)All invitations to bid issued by the abovenamed Board of Cooperative EducationalServices will bind bidders and successfulbidders to the conditions and requirementsset forth in these general conditions, andsuch conditions shall form an integral partof each purchase contract awarded by theCenter for Instruction, Technology &Innovation (CiTi).DEFINITIONS“CiTi” Shall be the legal designation of theOswego County Board of CooperativeEducational Services/ Center for Instruction,Technology & Innovation.“School District” Shall be the legaldesignation of the district.“Notice to Bidders” A formal statement,which, when issued by CiTi, constitutes aninvitation to bid on the materials, suppliesand equipment described by thespecifications“Board” The Board of CooperativeEducation Services Board of Education.“Bid” An offer to furnish materials,supplies, and/or equipment in accordancewith the invitation to bid, the generalconditions, special instructions, and thespecifications.“Bid Offer” The form on which thevendor/bidder submits his bid.“Bidder” A company, corporation orindividual submitting a bid.“Contract” A notice to the successfulbidder by the issuance of a purchase order,all documents relating to the transaction,including but not limited to, the bid offer ofthe successful bidder, notice to bidders,general information, general conditions,specifications, notice of award, bid proposalcertifications; a formal document signed bythe successful bidder and CiTirepresentative.“Successful Bidder” Any bidder to whoman award is made by CiTi.“Contractor” Any bidder to whom acontract award is made by the Board ofCooperative Education Services.“Specifications” defined as the descriptionof materials, supplies, equipment, and/orservices, including the conditions for itspurchase.BIDS1. The date, time, and place of bid openingwill be given in the Notice to Bidders.2. All bids must be submitted on bid forms,if provided, and in accordance withinstructions provided.3. All bids received after the time stated inthe Notice to Bidders may not be consideredand will be returned unopened to the bidder.The bidder assumes the risk of any delay inthe mail or in the handling of the mail byemployees of CiTi. Whether sent by mail orby means of personal delivery, the bidderassumes responsibility for having his/herbid deposited on time at the place specified.4. All information required by Notice toBidders, General Conditions, Specifications,and Bid Offer, in connection with each itemagainst which a bid is submitted, must begiven to constitute a regular bid.5. The Non-Collusive Bidding Certificationmust be included with each bid as requiredby General Municipal Law, Section 103-d.6. The submission of a bid will be construedto mean that the bidder is fully informed asto the extent and character of the supplies,materials, or equipment required and arepresentation that the bidder can furnishthe supplies, materials, or equipmentsatisfactorily in complete compliance withthe specifications.7. No alteration, erasure, or addition is to bemade in the typewritten, printed, orelectronic matter. Deviations from thespecifications must be set forth in spaceprovided in bid for this purpose.8. Prices and information required should betypewritten for legibility. Illegible or vaguebids may be rejected. All signatures must bewritten. Facsimile, printed, or typewrittensignatures are not acceptable.9. Sales to school districts are not affectedby any fair-trade agreements. (GeneralBusiness Law, Sec. 369-a, Sub. 3)10. No charge will be allowed for Federal,State or municipal sales and excise taxessince the school districts and CiTi areexempt from such taxes. The price bid shallbe net and shall not include the amount ofany such tax.11. In all specifications, the words “orequal” are understood after each articlegiving manufacturer’s name or catalogreference, or on any patented article. Thedecision of the school district as to whetheran alternate or substitution is in fact “equal”shall be final. If bidding on items other thanthose specified, bidder must provide inevery instance the trade designation of thearticle, manufacturer’s name, and detailedspecifications of item he proposes tofurnish. Otherwise, bid will be construed assubmitted on the identical item as specified.12. Bids on equipment must be on standardnew equipment, of latest model, and incurrent production, unless otherwisespecified.13. All regularly manufactured stockelectrical items must bear the label of theUnderwriters’ Laboratories, Inc.14. When bids are requested on a lump sumbasis, bidder must bid on each item in thelump sum group. A bidder desiring to bid“no charge” on an item in a group must soindicate; otherwise, bid for the group maybe rejected.15. All prices quoted must be “per unit” asspecified; e.g., do not quote “per case”when “per dozen” is requested; otherwisebid may be rejected.16. Bidder must insert the price per unit andthe extensions against each item in his bid.In the event of a discrepancy between theunit price and the extension, the unit pricewill govern. Prices shall be extended indecimals, not fractions. In the case ofelectronic filing via CD, diskette or traveldrive of a bid response form, the electronicdata will take precedence over any writtenor printed material submitted with the bidpacket.17. Prices shall be net; includingtransportation and delivery charges fullyprepaid by the successful bidder todestination indicated in the instructions tobidders. If award is made on any otherbasis, transportation charges must beprepaid by the successful bidder and addedto the invoice as a separate item.
