The envelope containing the bids for the shall be sealed,addressed to the City of Lowell, Purchasing Department and designated as “Proposal forDOWNTOWN AREA SEWER IMPROVEMENTS PROJECT ”BIDDERS ARE REQUIRED TO SUBMIT A BID INCLUDING ALL BID FORMSCONTAINED IN THIS PACKAGE. DO NOT REMOVE PAGES.The bids will be for all labor, materials, equipment, tools, appliances etc. necessary forconstruction of the DOWNTOWN AREA SEWER IMRPOVEMENTS PROJECT whichincludes, but is not limited to, Trenchless rehabilitation and excavation repair of sewers locatedapproximately in the City of Lowell. Work includes sewer excavation spot repairs, replacementof existing sewers and manholes, cured in place pipe lining, manhole rehabilitation, and allmaterials, equipment, construction, and services inherent to the work..The contract work period shall be for the period beginning on or about July 13, 2026 or as statedin the NOTICE TO PROCEED, WHICHEVER IS LATER and end on September 1, 2027.Bid Documents, including Plans and Specifications may be obtained after April 8, 2026 on theCity’s Website at the following address:http://www.lowellma.gov/Purchasing/Pages/General/OpenSolicitations.aspxBid Number: IFB-26-65The Project being bid is subject to Massachusetts General Laws, Chapter 30, Section 39M.This Project is to be funded in part with monies made available by the Clean Water StateRevolving Fund (SRF) and is to be funded in part by the Massachusetts Clean Water Trust (the“Trust”), and compliance with the following is required: Environmental Protection Agency’s(EPA) Diesel Retrofit Program; EPA/Massachusetts Department of Environmental Protection(MassDEP) Division of Municipal Services (DMS) requirements; the American Iron and Steelrequirements of P.L. 113-76 (the Consolidated Appropriations Act of 2014); the Build America,Buy America (BABA) Act requirements; Davis-Bacon Act and wage requirements; and otherMassDEP/DMS provisions and policies. BABA implementation is not required for this projectas the project is not receiving federal assistance based on EPA’s Build America, Buy AmericaAct Implementation Procedures for EPA Office of Water Federal Financial Assistance ProgramsMemorandum issued November 3, 2022.Procurement Considerations - Six Good Faith Efforts. 40 CFR, Part 33, Subpart C:Pursuant to 40 CFR Section 33.301, Bidders must agree to make good faith effortsINV-1whenever procuring construction, equipment, services, and supplies. Recordsdocumenting compliance with the six good faith efforts shall be retained. The specific sixgood faith efforts can be found at: 40 CFR Section 33.301 (a)-(f).INV-2Each bid proposal must be secured by an accompanying deposit of five percent (5%) of the totalbid amount and submitted in a sealed envelope clearly marked, “Proposal for Downtown AreaSewer Improvements Project”. The deposit shall be in the form of a Bid Bond, Certified Check,Cashier’s or Treasurer’s Check, made payable to the City of Lowell, or cash.The successful bidder must furnish a Payment Bond and a Performance Bond of an amount equalto One Hundred (100%) percent of the total Contract Price, issued by a Surety Company,satisfactory to the Director of the Department of Planning and Development.Prevailing wage rates as issued by the Director of the Executive Office of Labor and WorkforceDevelopment, Department of Labor Standards under the provisions of Massachusetts GeneralLaws, Chapter 149, Sections 26 to 27D inclusive, as amended, apply to this Project. It is theresponsibility of the Bidders, before Bid opening, to request if necessary, any additionalinformation on prevailing wage rates for those trades people who may be employed for theproposed Work under the resulting Contract. Federal Minimum Wage Rates as determined by theUnited States Department of Labor and the Davis-Bacon Act also apply to this Project per SRFrequirements. In case of discrepancy, the higher wage rates shall apply.Note: Bidders must also comply with Certification of Compliance G.L.C. 30 & 39S PublicConstruction More Than $10,000.00. See page BP-11.The City of Lowell, acting through its Chief Procurement Officer, reserves the right to waive anyinformality in, to reject any or all bids or to accept the one which appears in the best interest ofthe City of Lowell.MBE’s are encouraged to submit proposals.
