Sealed bids are due on December 29th by 9:30 a.m.at the Office of the First Selectman, on the second floor of Town Hall, 31 Park Street, Guilford,CT 06437 at which time they will be opened publicly. Bids received after this date and timewill be rejected. Sealed Bid envelopes (including overnight packaging) should be labeled withbid number, bid title and marked “time sensitive”. Bid specifications may be obtained from theTown of Guilford’s website at www.guilfordct.gov or the Department of Administrative Servicesprocurement website https://portal.ct.gov/DAS/CTSource/BidBoardA mandatory pre-bid walk through is scheduled for December 16, 2025 at 9:00 a.m. atBittner Park, 1450 Durham Rd Guilford, CT 06437. Please meet in the main entrance ofthe park.Any questions regarding the specifications shall be directed, in writing by email only, no laterthan December 23, 2025 at 4:00 p.m. to Pam Gery, Director of Parks & Recreation atgeryp@guilfordct.gov with a copy to Darlene Minore, Manager of Purchasing & Accounting atpurchasing@guilfordct.gov .Each bidder is required to submit to the Office of the First Selectman their original proposalplus three (3) copies and one (1) electronic copy (flash drive), as well as bid security in the formof a bid bond or cashier’s check in the amount of ten percent (10%) of the base bid. Each biddershall honor its bid price for ninety (90) business days from the date of the bid opening, withoutmodification. Upon award of the bid, the winning bidder shall be bound by the bid proposal pricethroughout the contract period.The minimum rates to be paid for labor on various classifications of the project shall be inaccordance with the current schedule of prevailing wages established by the ConnecticutDepartment of Labor, Wage and Workplace Standards Division. Refer to the prevailing wagerates included within the specifications.The Town of Guilford reserves the right to reject any or all bids; or to waive defects in same,if it deems such to be in the best interest of the Town. The conditions outlined become a formalpart of each Invitation to Bid and are incorporated into/made a part of thecontract entered into by the Town and the successful bidder, unless otherwisespecified. All Bidders are expected to fully inform themselves as to theconditions, requirements and specifications before submitting bids. Failure todo so will be at the Bidder's own risk.The terms and conditions outlined in the Invitation to Bid become part of theformal contract following award, unless specified otherwise.1. BIDDING PROCEDURE1.1 Bidder shall submit three (3) complete sets of the bid documents,flash drive and all supporting material, unless otherwise stated in theInvitation to Bid. All appropriate blanks shall be completed. The signer ofthe bid shall initial any interlineations, alteration or erasure on thespecification document. Bidders shall not change the Proposal Form normake additional stipulations on the specifications document.1.2 Bid prices shall be submitted on the Proposal Form included in thebid document.1.3 The Base Bid is the sum stated in the bid for which the Bidder offersto perform the work or provide merchandise or equipment described in thebid package as the base, to which work or materials may be added or fromwhich work or materials may be deleted from sums stated in alternatebids.1.4 Conditional bids are subject to rejection in whole or in part. Aconditional bid is defined as one which limits or modifies any of the termsand conditions and/or specifications of the Invitation to Bid.1.5 Alternate bids will not be considered unless specifically requestedin the original bid package. An alternate bid is defined as one which issubmitted in addition to the Bidder’s Base Bid set forth in the Invitation toBid. Town shall have the right to accept alternates in any order orcombination, unless otherwise specifically provided in the bid documents,and to determine the low Bidder on the basis of the sum of the Base Bidand alternates accepted.1.6 Unit prices will not be considered unless specifically requested inthe original bid package. Unit price is defined as an amount proposed byBidders, stated on the Proposal Form, as a price per unit of measurement3for material or services added to or deducted from the base bid byappropriate modification, if estimated quantities of work required by thecontract documents are increased or decreased.1.7 Each bid must be legible (no pencil), include the full name, businessand e-mail address, and telephone number of the Bidder and be signed inink by the Bidder.1.8 A bid by a firm or organization other than a corporation mustinclude the name and address of each member.1.9 A duly authorized representative of a Bidder entity must sign thebid and any applicable bond(s) in the name of such entity. Suchrepresentative must attest that he/she is duly authorized to bind suchentity or submit a corporate resolution or limited liability/partnershipconsent evidencing such authority.1.10 Bids received after the time and date established for receiving bidswill be rejected.1.11 At bid opening all bids are publicly opened and received. The bidswill be considered unverified and subject to further review foracceptance/disqualification. The Town shall prepare a bid summary bythe Town of Guilford, which summary shall be available to all Biddersupon the request.1.12 Estimated quantities may be listed as part of a bid package in orderto assist Bidders, but Bidders are reminded that actual quantities orderedmay vary from figures listed and the Town will not be held liable for anydifference. On “as required” bids, acceptance of this bid will bind the Townto pay for, at unit price only, quantities ordered and delivered. The Townwill not be required to accept delivery of any balances unordered as ofthe contract expiration date.1.13 Bidders shall submit catalogues, descriptive literature anddetailed drawings, fully detailing features, designs and constructionnecessary to fully describe the material or work proposed in the bid.2. ALLOWABLE MARKUP FOR OVERHEAD AND PROFIT ON CHANGEORDERS:2.1 Self-Performed Work: Ten Percent (10%) overhead and FivePercent (5%) for a total of Fifteen Percent (15%) of the Cost of the Workfor that portion of the Change Work to be performed by Contractor withits own forces.2.2 Subcontractors: Ten Percent (10%) overhead and Five percent(5%) profit for a total of Fifteen Percent (15%) of the Cost of the Work forthe Work to be performed by a first Tier Subcontractor with its ownforces, plus two and a half percent (2.5%) thereon for Contractor Markup.42.3 Sub-subcontractors: Ten Percent (10%) overhead and FivePercent (5%) profit for a total of Fifteen Percent (15%) of the Cost of theWork to be performed by Sub-subcontractors of the second and lower Tierwith their own forces, plus two and a half percent (2.5%) thereon for theSubcontractor, plus two and a half percent (2.5%) on the combined totalthereof for Contractor Markup.3. BIDDER’S SECURITY3.1 Bid Security, as a guarantee of good faith, in the amount of tenpercent (10%) of the base bid and in the form of a certified check, cashier’scheck, or Bidder’s bond, shall be required to be submitted with the bidpackage for all bids.3.2 Such bid security will be returned to the unsuccessful Bidderswhen the award of bid is made.3.3 Bid security will be returned to the successful Bidder as follows:3.3.1 For bids with specified quantities for which the awarded bidpackage and delivery of award notice constitute the contract; upon thedelivery of all equipment or merchandise (and/or performance ofservices, if applicable), and upon final acceptance by the Town.3.3.2 For all other contracts; upon receipt by the Town of the executedcontract and applicable bonds, if any.3.4 Town shall have the right to retain the bid security of Bidders towhom an award is being considered until either:3.4.1 A contract has been executed and bonds have beenfurnished.3.4.2 The specified time has elapsed so that the bids may bewithdrawn.3.4.3 All bids have been rejected.3.5 Bid security will be forfeited to the Town as full liquidateddamages, but not as a penalty, for any of the following reasons:3.5.1 If the Bidder fails to deliver the equipment or merchandisein full compliance with the accepted proposal and specifications.3.5.2 If the Bidder fails or refuses to enter into a contract on formsprovided by the Town, and/or if the Bidder fails to providesufficient bonds or insurance within applicable time periods setforth in the bid package.3.6 The surety company executing the bond must be licensed to dobusiness in the state, or the bond must be countersigned by a company solicensed. The bond must be signed by an official of the surety companyand corporate seal must be affixed over his/her signature. Signatures oftwo witnesses for both the principal and surety must appear on the bond,5
