This quote may be extended/renewed for two (2) additional one (1) year periods, by mutual consent, at the same prices,terms and conditions.Current contract prices can be obtained by accessing the Charlotte County Purchasing Division’s website athttp://purchasingbids.charlottecountyfl.gov/ under “Purchasing Bids Online”, Historical Catalog. The previous Contract numberfor this project is 23-016 and is entitled “Athletic Field Marking Dust – Annual Contract”.DELIVERY: Prices quoted shall include delivery to the Community Services Department, located at 7001 Florida Street, PuntaGorda FL 33950, or to any other specified Charlotte County location. Successful firm shall notify the County at least twenty-four (24) hours prior to delivery. The name and contact number for delivery notification may be different depending on thedelivery location and will therefore be indicated on each purchase order issued. Delivery can be made Monday through Friday,between the hours of 8 a.m. and 3 p.m., excluding holidays.NOTICE TO PROCEED: Notice to Proceed, or Purchase Order, shall be issued bearing the agreed-upon commencementdate. No work under the Contract shall begin until after the Notice to Proceed/Purchase Order has been issued.RESERVED RIGHTS: The County reserves the right to accept or reject any and/or all quotes, to waive irregularities andtechnicalities, and to request resubmission of quotes. Also, the County reserves the right to accept all or any part of the quoteand to increase or decrease quantities to meet additional or reduced requirements of the County. Any sole response receivedby the first submission date may be rejected by the County depending on available competition and timely needs of the County.FORM OF CONTRACT: The submitted Quote Form signed by the Quoter, together with the complete quote package furnishedby the County, shall constitute a binding contract. The Quoter shall be required to perform according to the Quoter’s submittedQuote Form and the County’s quote package.CANCELLATION: The County shall have the right to unilaterally cancel, terminate or suspend this Contract, in whole or inpart, by providing the Contractor 30 days written notice by certified mail.1RFQ No. 20260130Pursuant to Section 287.135(3)(b) of the Florida Statutes, Charlotte County may, at its sole option, terminate any Agreementin any amount if the Contractor is found to have been placed on the Scrutinized Companies that Boycott Israel List, or isengaged in a boycott of Israel.SPECIFICATIONS: The required athletic field marking dust is bright white in appearance, non-toxic, non-burning and harmlessto soil and turf. Athletic field marking dust shall conform to the National Collegiate Athletic Association (NCAA) guidelines andnot harm uniforms or players. The acceptable generic composition for the athletic field marking dust is as follows:Limestone (calcium carbonate)Magnesium CarbonateQuartz90-99%0-5%0-5%ESTIMATED QUANTITIES: The exact quantities of the required athletic marking dust for this quote cannot be determined atthis time. Annual past use by Charlotte County has been approximately 1,500 50-pound bags. These amounts are given forQuoter's guidance only; no minimum amount is guaranteed or implied. This quote award may result in similar quantities ofpurchases; however, no quantity is guaranteed. Purchase orders shall be issued on an "as required" basis.GENERAL CONDITIONS:1.Taxes – Charlotte County is exempt from Federal Excise, Transportation and Florida Sales Taxes.2.Payment: All invoices will be paid in accordance with the Local Government Prompt Payment Act (F.S. 218.7).SOCIAL, POLITICAL, OR IDEOLOGICAL INTERESTS: Charlotte County will not request documentation of, or consider avendor’s social, political, or ideological interests when determining if the vendor is a responsible vendor. Charlotte County doesnot give preference to vendors based on social, political, or ideological interests.CRITERIA FOR AWARD: Award of this quote shall be to the overall lowest responsive, responsible quoter meeting orexceeding the requirements of the specifications set forth herein. Another consideration of award may be delivery time.The County reserves the right to reject the quote of any quoter who has previously failed to perform properly, or on time,contracts of similar nature; or who is not in a position to satisfactorily perform the contract. If, after the due date and time, thelowest quoter is deemed non-responsible by the County, such quoter shall receive written notice from the County of thisdetermination. The quoter shall have five (5) business days from the date of this notice to dispute the determination and toprovide to the County any additional information it deems relevant regarding the quoter’s responsibility.
