Annual Maintenance, Recovery, & Response - Construction
Materials and Services
for Lincoln County
The Board of Lincoln County Commissioners is requesting formal, price-based competitive sealed
bids for various construction materials and services for Lincoln County. Sealed bids will be
accepted until December 9th, 2025, at 2:00 PM MST at the Lincoln County Administration
Building, Finance Department, 300 Central Ave, Carrizozo, New Mexico. Bids that are received
from bidders deemed responsible will be reviewed and a recommendation for award will be made
to the Board of County Commissioners based on the lowest responsive price(s) with any
applicable preferences. Lincoln County reserves the right to accept or reject any bid or any part
thereof; to defer action on the invitation for bids; to reject all bids; to waive technicalities or
informalities and to accept the bids which, in its judgment, are most advantageous to the County.

ADDRESS MUST appear clearly on the sealed envelope or package of all bids.
IF THERE IS ANY PROBLEM REGARDING THE FOLLOWING SPECIFICATIONS OR CONDITIONS
THAT WOULD PREVENT YOU FROM SUBMITTING A BID, CONTACT THE PROCUREMENT
MANAGER IMMEDIATELY FOR CLARIFICATION AND/OR CONSIDERATION OF AN ADDENDUM.
NOTE: WHEN SHIPPING OVERNIGHT DELIVERY, IT IS RECOMMENDED THAT SHIPMENT BE MADE NO
LESS THAN 2 DAYS PRIOR TO DEADLINE IF POSSIBLE, TO ENSURE DELIVERY. IT IS ALSO
RECOMMENDED TO VERIFY DELIVERY PRIOR TO DEADLINE.

Federal funding may be used for purchases under this contract. If federal funds are used, the
Contractor is required to comply with federal regulations in addition to local law. Applicable
federal requirements are set forth in this IFB under section VI FEDERAL FUNDING CONTRACT
REQUIREMENTS. If federal funds will not be used, anything in section VI. of this IFB is not a
requirement. It is the responsibility of the Contractor to determine if federal funds will be used
under any contract, and the responsibility of the Participating Agency to provide such
information upon request. Performance of work under federal funds is at the discretion of the
contractor.

Annual Maintenance, Recovery, & Response Construction Materials and Supplies for Lincoln County
I. DEFINITION OF TERMINOLOGY
This section contains definitions that are used throughout this procurement
document, including appropriate abbreviations.
Addendum” A written or graphic instrument issued prior to the opening of
Bids which clarify, corrects, supplements, or changes the Bidding Documents
or Contract Documents. Plural: Addenda.
Alternate Bid” If required by the Bidding Documents, the amount to be
added to the Base Bid if the corresponding change in the project scope,
materials, and/or methods of construction is awarded by the Owner.
Base Bid” Amount stated in the Bid as the sum for which the Bidder offers
to perform the work, excluding alternate Bids.
Bid” The offer of the Bidder submitted on the prescribed form setting forth
the prices for the work to be performed in conformance with the Bidding
Documents. This amount does not include gross receipts or local options
taxes.
Bid Lot” A major item of work for which a separate quotation or proposal is
requested.
"Bidder" One who submits a Bid directly to the Owner, as distinct from a
Subcontractor who submits a Bid to a Contractor.
Bidding Documents” The Bidding Requirements and Contract Documents.
Bid Form” A form which includes a specific space in which the Bid price shall
be inserted and which the Bidder shall sign and submit along with all other
necessary submissions. Oral, telephonic, and telegraphic bids are invalid and will not be
considered
Bidding Requirements” Invitation for Bid, Pre-bid Conference (if mandatory), Terms
and Conditions, Instructions to Bidders, Bid Form, Addenda, Bid Guaranty, and other
related documents to any of these.
"Bid Sample" A sample furnished by a bidder that shows the characteristics of an
items offered in the bid.
"Board of County Commissioners" also "BOCC" The elected board in whom all
powers of the County are vested and who are responsible for the proper and
efficient administration of the County government.
"Close of Business" 5:00 P.M. Mountain Standard Time (MST) or Mountain
Daylight Time (MDT), whichever is in effect on the date specified.
