The selected contractor shall provide alllabor, expertise, testing, reporting, and operational support required to ensure the compliant,continuous, and safe operations of the water well and wastewater treatment systems, in accordancewith requirements established by the Mississippi Department of Health (MSDH) and theMississippi Department of Environmental Quality (MDEQ). Services include routine inspections,sampling, recordkeeping, equipment monitoring, emergency response, and participation inregulatory inspections as detailed in the Scope of Services.Interested and qualified vendors with the resources and capability to perform the scope of servicesoutlined in Section 3 shall submit a completed response utilizing the Quote Form (Attachment C)no later than 2p.m. on June 10, 2026. Bidder must also submit proof of required Operator’s Licensewith Quote Form.It is recommended that vendors be registered with the State of Mississippi. The agreement will include clauses detailed in Attachment A and Attachment B. Thesuccessful bidder must be registered to do business with the State of Mississippi within three (3)days of receiving notice of award. The successful bidder must be able to pass MDOC NCICbackground check.1. SERVICE LOCATIONMississippi State Penitentiary (MSP)MS Hwy 49 WestParchman, MS 387382. DURATION OF SERVICES TO BE PROVIDEDMDOC anticipates that the contract term will be effective July 1, 2026 to June 30, 2027for a period of one (1) year.3. SCOPE OF SERVICE3.1 Water Well Operations3.1.1 Bidder shall conduct operational visits a minimum of three (3) times perweek. Bidder shall check in and out with the MSP Maintenance Staff.3.1.2 Bidder shall monitor well to ensure it is functioning correctly.3.1.3 Bidder shall check chlorine tanks and change tanks, when needed.3.1.4 Bidder shall record chlorine residuals (both total and free) in stateapproved log book.3.1.5 Bidder shall report any and all problems immediately to facilitymaintenance staff and notify the Deputy Administrator of Maintenanceand MSP Maintenance Facility Supervisor in writing.3.1.6 Bidder must collect all required samples and deliver to the MississippiDepartment of Health (MSDH).3.1.7 Bidder must be present at all inspections conducted by the MSDH.3.1.8 Bidder shall be available to respond to any after-hour emergency calls atno additional cost.3.1.9 Bidder must prepare and provide the cost of annual Consumer Cost Report(CCR) by July 1st of each year.RFx 3140004571Page 2 of 153.1.10 Bidder shall be responsible for all associated costs for testing, reporting,and sampling as required by MSDH.3.1.11 Bidder shall comply with all MDOC rules and regulations.3.2 Wastewater Treatment Plan Operations3.2.1 Bidder shall possess a Class III Operator License (or higher)3.2.2 Bidder shall monitor lagoon levels and assist facility maintenance staffwith pump(s) and runtime3.2.3 Bidder shall provide runtime sheets to calculate monthly flow.3.2.4 Bidder shall complete weekly data using certified equipment and recordfindings in log book.3.2.5 Bidder shall service all equipment according to manufacturer’srecommendations.3.2.6 Bidder shall immediately notify MDOC of any equipment failures.3.2.7 Bidder shall be present at all inspections conducted by the MississippiDepartment of Environmental Quality (MDEQ).3.2.8 Bidder shall maintain the grounds of the wastewater plants.3.2.9 Bidder shall coordinate quarterly samples with MDEQ approved testingcompany and record data in approved log books.3.2.10 Bidder shall report samples that are outside limits to the DeputyAdministrator of Maintenance and Facility Maintenance Supervisor inwriting.3.2.11 Bidder shall provide all quarterly sampling.3.2.12 Bidder shall be responsible for all associated cost for testing, repolling,and sampling that is required by MDEQ.4. AGENCY RESPONSIBILITIESMDOC shall ensure a successful partnership with the successful bidder by providing thefollowing:• The chlorine needed for the well water tanks;• All extra parts and supplies for wastewater plant blowers;• A small boat and life jackets;• All repairs on equipment; andRFx 3140004571Page 3 of 15• Needed assistance when necessary as determined by MDOC.5. SOLICITATION CLAUSES5.1 ACKNOWLEDGMENT OF AMENDMENTS. Bidder shall acknowledge receipt ofany amendment to the RFQ in writing. The acknowledgment shall be submitted toMDOC by signing and returning the provided signature form via email to the emailaddress listed on the form. Each bidder shall submit a written acknowledgment ofevery amendment to the MDOC on or before the submission deadline.5.2 CERTIFICATION OF INDEPENDENT PRICE DETERMINATION. Bysubmitting a proposal, the bidder certifies that the prices submitted in response to thesolicitation have been arrived at independently and without any consultation,communication, or agreement with any other bidder or competitor for the purpose ofrestricting competition.5.3 CONTRACT RIGHTS. Contract rights do not vest in any party until a contract islegally executed. The MDOC is under no obligation to award a contract followingissuance of this solicitation.5.4 EXPENSES INCURRED IN THE PROCUREMENT PROCESS. All partiesparticipating in the procurement process with regard to this solicitation shall bear theirown costs of participation, pursuant to Section 1.4.4 of the Public Procurement ReviewBoard Office of Personal Service Contract Review Rules and Regulations.5.5 MINOR INFORMALITIES AND IRREGULARITIES. The MDOC has the rightto waive minor defects or variations of a proposal from the exact requirements of thespecifications that do not affect the price, quality, quantity, delivery, or performance ofthe services being procured and if doing so does not create an unfair advantage for anybidder. If insufficient information is submitted by a bidder for the MDOC to properlyevaluate the offer, the MDOC has the right to require such additional information as itmay deem necessary after the submission deadline, provided that the informationrequested does not change the price, quality, quantity, delivery, or performance time ofthe services being procured and such a request does not create an unfair advantage forany bidder. (Information requested may include, for example, a copy of business orprofessional licenses, or a work schedule.)5.6 OFFEROR’S REPRESENTATION REGARDING CONTINGENT FEES. Byresponding to the solicitation, the offeror represents that it has not retained any personor agency on a percentage, commission, or other contingent arrangement to secure thiscontract. If the offeror cannot make such a representation, a full and completeexplanation shall be submitted in writing with the offeror’s response.RFx 3140004571Page 4 of 15ATTACHMENT A:REQUIRED CLAUSES FOR SERVICE CONTRACTSRESULTING FROM THIS REQUEST FOR QUOTES1. APPLICABLE LAW. The contract shall be governed by and construed in accordance withthe laws of the State of Mississippi, excluding its conflicts of laws provisions, and anylitigation with respect thereto shall be brought in the courts of Mississippi.2. APPROVAL. It is understood that if this contract requires approval by the PublicProcurement Review Board (“PPRB”) and/or the Department of Finance andAdministration Office of Personal Service Contract Review (“OPSCR”), and if thiscontract is not approved by the PPRB and/or OPSCR, it is void and no payment shall bemade hereunder.3. AVAILABILITY OF FUNDS. It is expressly understood and agreed that the obligationof MDOC to proceed under this agreement is conditioned upon the appropriation of fundsby the Mississippi State Legislature and the receipt of the appropriated funds. If the fundsanticipated for the continuing time fulfillment of the agreement are, at any time, notforthcoming or insufficient, regardless of the source of funding, MDOC shall have the rightupon 10 business days written notice to Contractor, to terminate this agreement withoutdamage, penalty, cost or expenses to the MDOC of any kind whatsoever. The effectivedate of termination shall be as specified in the notice of termination.4. COMPLIANCE WITH EQUAL OPPORTUNITY IN EMPLOYMENT POLICY.Contractor understands that the MDOC is an equal opportunity employer and therefore,maintains a policy which prohibits unlawful discrimination based on race, color, creed,sex, age, national origin, physical handicap, disability, genetic information, or any otherconsideration made unlawful by federal, state, or local laws. All such discrimination isunlawful, and Contractor agrees during the term of the agreement that Contractor willstrictly adhere to this policy in its employment practices and provision of services.5. COMPLIANCE WITH LAWS. Contractor shall comply with, and all activities underthis agreement shall be subject to, all applicable federal, state, and local laws andregulations, as now existing and as may be amended or modified.6. CONFIDENTIALITY. MDOC is a public agency of the State of Mississippi and issubject to the Mississippi Public Records Act of 1983. Mississippi Code Annotated §§ 25-61-1, et seq. If a public records request is made for any information provided to MDOCby Contractor, MDOC shall follow the provisions of Mississippi Code Annotated §§ 25-61-9 and 79-23-1 before disclosing such information – unless Contractor has previouslyindicated the information is not a trade secret or confidential commercial and financialRFx 3140004571Page 5 of 15
