Screening 12 Panel T-Cups” needed at 520 S. Raleigh Street, Martinsburg, WV, 25401. Berkeley County
Day Report Center currently purchases approximately 6,000 cups per quarter, at minimum.The County Commission (or its designated representatives) will be evaluating submissions to this
request and will ultimately select a firm judged to be both responsible and responsive to the request in
every way, including having offered the most beneficial, appropriate price proposals. The County
Commission reserves the right to interview some or all prospective firms to discuss Price Proposals.

9831 Ext 6204.Two (2) copies of submittals of Qualification & Price information from interested businesses
should be enclosed in a sealed opaque envelope marked “Drug Screening 12 Panel T-Cups”. Proposals
must be submitted and time-stamped into the County Commission Office, 400 W. Stephen Street, Suite

INTRODUCTION:Proposals are being requested from Vendor to submit bid for Drug Screening 12 Panel T-Cups asordered by the County Commission of Berkeley County, West Virginia, (hereinafter referred to as“County Commission” or “Commission”). Only written responses to this RFP shall be considered. Allmaterials submitted shall become part of the proposal. Berkeley County Day Report Center currentlypurchases approximately 6,000 cups per quarter, at minimum.II. BACKGROUND:Berkeley County is located in the eastern panhandle of West Virginia. According to 2020 Censusinformation, Berkeley County has a population of 122,076, making it the second-most populouscounty in West Virginia. Martinsburg is the County Seat.The county lies adjacent to the Washington-Baltimore Metropolitan area and is one of three counties in theHagerstown-Martinsburg, MD-WV Metropolitan Statistical Area.Partly because of its proximity to Washington, D.C., Berkeley County is the fastest growing county in theState of West Virginia and among the fastest growing in the entire country.Berkeley County is currently governed by a five (5) member County Commission.III. SCOPE OF WORKA. GENERALThe County Commission is requesting bids for Drug Screening Cups 12 panel T-Cupslocated at 520 S. Raleigh Street, Martinsburg, WV 25401.1. The following items are needed: 12 panel T-Cup minimum that tests for thefollowing substances.DrugAmphetamineBenzodiazepineBuprenorphineCannabinoids (thc)CocaineEcstasy (mdma)Ethyl GlucuronideFentanylMethadoneMethamphetamineOpiatesOxycodoneCutoff300 ng/ml300 ng/ml10 ng/ml50 ng/ml150 ng/ml500 ng/ml500 ng/ml10 ng/ml300 ng/ml500 ng/ml300 ng/ml100 ng/ml*********Additional panels are acceptable but 12 are required.IV. Vendors must contact Tim Czaja, Director, 304-262-9831 Ext 6204, shouldthere be any questions or problems.V. Berkeley County is a tax-exempt organization. Tax number 556000296.VI. Q&E / TECHNICAL PROPOSAL:Respondent shall respond to and reference each section and subsection for portion(s) of RFPproposal. At a minimum, your Qualifications Proposal shall include the following information.Failure to discuss each item may deem the submittal nonresponsive and may result innonconsideration of respondent’s s e r v i c e s .A. Firm Information1. Name, address, telephone number, fax number of firm and parent company, ifany, from which the materials will be supplied.B. Miscellaneous Requirements1. All technical proposals should include any conclusions, remarks and/orsupplemental information that is pertinent to this request. Submitters are alsorequired to provide written information regarding their inability to conform to anyof the technical requirements listed above. Failure to do so will result indisqualification of proposal.VII. PRICE PROPOSAL:A. At a minimum, your Price Proposal shall include the following:1. A price per cup based on 6,000 per quarter volume and for all items listed onAttachment A to include shipping cost, if any.2. Fully executed Non-Collusion Certificate Attachment B.3. Any conclusions, remarks and/or supplemental information pertinentto this request.VIII. TERM OF CONTRACT:A. The initial term of this contract shall be for three (3) years commencing July 1, 2025.B. If the Firm and/or Company awarded the bid subsequently fails to comply with thespecifications, it will be given thirty (30) calendar days’ notice to render satisfactory service.If at the expiration of such thirty (30) calendar days’ notice, the unsatisfactory conditionshave not been corrected, the County Commission reserves the right to terminate thecontract.C. During the term of the contract, the Company may increase prices once per year with atleast thirty (30) days’ notice to the Commission, provided, however, that the CountyCommission may terminate the contract if it objects to the amount of the increase and theparties cannot reach an agreement on the amount of such an increase.IX. USE OF EXISTING DOCUMENTS:Berkeley County will cooperate to the fullest extent by making available to the Firm/Companyall documents pertinent to this service that may be in the County Commission’s possession.Berkeley County makes no warranty as to the accuracy of existing documents nor will the CountyCommission accept any responsibility for errors and omissions that may arise from theFirm/Consultant having relied upon them.X. COMPENSATION TO THE CONTRACTOR:Invoices must be submitted to:Berkeley County Commission400 W. Stephen St, Suite 201Martinsburg, WV, 25401Payment will be made within thirty (30) days of receipt and approvalIX SELECTION PROCESS:A. This solicitation is issued pursuant to the implementation of Berkeley County’sPurchasing Policy. Berkeley County shall not be liable for any costs not included in theproposal, not contracted for subsequently, or in regard to preparation of your proposal.B. A Selection Committee appointed by the County Commission will evaluate responses tothis request and select those firms judged to be most qualified.C. Since it is the County Commission’s desire to select the most qualified firm, theSelection Committee reserves the right to schedule oral presentations from those firmsit deems most qualified to take place within ten (10) business days following notification.X. PROPOSALS AND AWARD SCHEDULE:A. Proposals received prior to the deadline will be treated as confidential, until receipt of allProposals and opening of the same. Proposals received after the deadline will not beconsidered in the evaluation process and will be returned unopened.B. It is expected that the contract award will be made within thirty (30) calendar days afterthe opening of proposals. The contract will be awarded to the Company whose proposal,conforming to this request, will be the most advantageous to Berkeley County.C. Proposals must give the full name and address of the proposer and the person signing theproposal shall indicate his or her title and/or authority to bind the firm in a contract.D. Proposals may not be altered or amended after they are opened.E. The approval or disapproval of the Company’s Proposal will be determined by its responseto this request and on past performance. No assumptions should be made on the part of theFirm/Company as to this Committee’s prior knowledge of their abilities.F. Berkeley County reserves the right to request clarification of information submitted andto request additional information of one or more applicants.XI. TERMS AND CONDITIONS:
