The projectlimits are: Busti Avenue between Virginia Street and Massachusetts Avenue and Porter Avenuebetween Lakeview Avenue and Niagara Street.The work includes providing all labor, materials, machinery, tools, equipment and other means ofconstruction necessary and incidental to the completion of the work shown on the plans anddescribed in these specifications including, but not necessarily limited to the following: work zonetraffic control, traffic signal modifications, concrete sidewalks, granite curbs, granite curb ramps,catch basin modifications and reconstruction, manhole adjustments, limited drainage and sewerpiping, underdrain reconstruction, limited areas of pavement reconstruction, flashing crosswalkbeacons, tree plantings, and signing and pavement striping.This is a Federal Aid Project and NYSDOT Standard Specifications, officially finalized andadopted on January 1, 2026 as posted on the New York State Department of Transportation’swebsite must be followed by the successful bidder.The DBE goal for this project is: 0%NOTE: Bidders must submit their DBE Participation Commitments on Company Letterheadwith the bid.The EEO Employment goals for this project are: 7.7 % Minority Employment Goal6.9% Women Employment GoalThe use of the NYSDOT approved civil rights reporting software, Equitable BusinessOpportunities (EBO), is required. Payment can be submittedonly by company check or money order made payable to the City of Buffalo, Dept. of PublicWorks, Parks and Streets. NO CASH AND NO PERSONAL CHECKS.AD - 1No questions or inquiries regarding this bid will be accepted within three (3) business days priorto the bid opening.The City of Buffalo will not be responsible for full or partial set of Contract Documents, includingany Addenda obtained from any other source. The City of Buffalo reserves the right to reject anyand all bids and to waive any informalities therein.Addenda will be emailed from Avalon Document Services to Bidders listed on the official PlanHolders List. Bidders must acknowledge receipt of all Addenda by securely stapling in place alladdenda within the front or back covers of the proposal book. No bidder may withdraw his/her bid within forty-five (45) calendar days after the actualdate of the opening thereof.Pursuant to New York State Department of Labor (NYSDOL) requirements for public workprojects: Contractors and Subcontractors need to register before submitting any new bidsor commencing new work on a covered project on or after December 30, 2024. NYSDOLencourages all contractors and subcontractors to register as soon as possible to obtain aCertificate of Registration to avoid negatively impacting a bidding period or project schedule.Proof of Certificate of Registration must be submitted with each bid.Bids to be considered must be received by the Commissioner of Public Works, Parks & Streetsno later than: WEDNESDAY, APRIL 8, 2026, AT 11:00 AM.It is the bidder’s responsibility to ensure the sealed proposal is delivered before the bidopening and bidders must utilize one of the following methods:1.) Drop off the sealed proposal to Room 502 of City Hall, Buffalo, New York, 14202 onWednesday, April 8, 2026 between the hours of 9:00 AM and 11:00 AM. The DPW willset a bid box up just inside Room 502 for the bidder to deposit the sealed proposal. Theremay be multiple bids on this date; it is the bidder’s responsibility to properly label thesealed proposal and place the proposal inside the correct box.2.) Mail the sealed proposals to Room 502, City Hall, Buffalo, New York, 14202 with ATTN tothe Commissioner of Public Works, Parks and Streets. Bidders should allow for deliverybefore the bid opening (highly encouraged to schedule for delivery on or prior to Tuesday,April 7, 2026). It is also highly encouraged that bidders track delivery of their mailedproposals and use appropriate priority mail as necessary. City of Buffalo staff is availableto accept deliveries on standard business days Monday-Friday from 8:00 AM to 4:00 PM.AD - 2Bids will be opened by City of Buffalo Representatives on WEDNESDAY, APRIL 8, 2026 at11:00 AM LOCAL TIME via video/phone conference call. Bidder representatives can view thepublic bid opening by emailing Tom Duk at tduk@buffalony.gov by 5:00 PM on Tuesday, April7, 2026 to be added to the meeting invitation. An updated meeting invitation will be sent prior tothe bid opening to all who request to be added.BIDDERS SHALL COMPLY WITH ALL APPLICABLE LOCAL LAWS AND ORDINANCES.The Bidder to whom the Contract is awarded will be required to furnish Performance, Paymentand Guarantee Bonds from an acceptable Surety Company for an amount not less than 100% ofthe accepted bid. The successful Bidder and all subcontractors must have an approved CCA-2on file with NYSDOT prior to being awarded a contract. If the successful Bidder does not currentlyhave a CCA-2 on file with NYSDOT, the Bidder may find the CCA-2 forms and instruction forcompletion online at https://www.osc.state.ny.us/state-vendors/vendrep/vendrep-system.The successful Bidder will be required to comply with all provisions of the Federal GovernmentEqual Employment Opportunity clauses issued by the Secretary of Labor on May 2, 1968 andpublished in the Federal Register (41 CFR Part 60-1, 33 F.2 7804). Successful bidders will berequired to pay prevailing wage rates on this contract.The City of Buffalo reserves the right to consider the bids for forty-five (45) days after receiptbefore awarding any Contract, and to waive any minor informalities in, and to reject, any and allbids.
