All questions will be answered by email.2.6 Bidders must provide contact information to the town by emailing afaustini@orange-ct.gov and bbrinton@orange-ct.gov, to ensure that they receive bid addenda and othernotifications.3.0 BID FORMS AND SUBMISSION INSTRUCTIONS3.1 Copies of the bid documents may be obtained from the Town of Orange Website andState of Connecticut Contracting Portal (CTsource)3.2 Ditto marks are not considered writing; shall not be used; and can be reason for non-acceptance of a bid.Page 1 of 163.3 All bids must be submitted in a sealed envelope, clearly marked “Bulky Waste Hauling& Disposal”, and received in the Public Works office by the time of the bid opening specifiedabove. In addition to the BID FORM, the bidder’s BIDDER QUALIFICATION STATEMENTand NON-COLLUSIVE AFFIDAVIT OF PRIME BIDDER must also be enclosed in the sealedenvelope. Bids, corrections, and/or modifications received after the time the town officials openthe first bid will not be accepted.Bidders are responsible for checking the bid posting on the state contracting portalhttps://portal.ct.gov/DAS/CTSource/CTSource or on the Town of Orange website for bidaddenda and responses to bidders’ questions, up to the time of the bid opening.3.4 The BID FORM must be signed by an authorized agent of the submitting company.3.5 All information submitted must be in ink or typewritten. Mistakes may be crossed outand corrections inserted. The person signing the bid form must initial corrections.3.6 The inability to meet any specified requirement(s) shall be clearly stated in writing andattached to the bid form or written on the bid form.3.7 At the time of opening the bids, bidders shall be presumed to have inspected the site andbe thoroughly familiar with the bid documents. Failure of any bidder to inspect the project site,ask questions, or to examine the bid documents, shall not relieve any bidder from obligationswith respect to their bid.3.8 The specifications listed are to be interpreted as meaning those acceptable to the Town ofOrange. Substitutions that are “an approved equal,” will be considered.3.9 Prior to submitting a bid, bidders must visit the Orange Transfer Station site. Biddersmust sign in at the scale house near the front gate. Change orders related to conditions that couldbe observed on a site visit will not be approved.3.10 The bidder must have significant experience performing bulky waste hauling anddisposal. Qualifications and references must be provided on the bid forms.4.0 CONTRACT DURATION4.1 The contract shall run for four years from July 1, 2026 to June 30, 2030.5.0 PAYMENT5.1 Payment shall be at the bid unit price per ton. Net bulky waste weight shall be asdetermined by the town scale. The contractor shall submit scale tickets from the town transferstation with monthly invoices. Invoices shall show the date of pickup of the roll-off containerfrom the transfer station, the net weight of bulky waste based on the town scale, the per tonhauling and disposal rate in effect at the time of pickup, the $ amount per load based on the ratemultiplied by the bulky waste weight, and the total $ amount for the month.Page 2 of 166.0 MISCELLANEOUS6.1 Bidders may withdraw their bid any time prior to the time of bid opening. No biddershall withdraw, cancel, or modify their bid for a period of sixty (60) days after bid opening.6.2 The Town of Orange is exempt from Connecticut Sales and Use Taxes and FederalExcise Taxes. Bidders shall avail themselves of these exemptions.6.3 The Town of Orange reserves the right to accept any bid, to reject any or all bids, towaive any minor bid informality or irregularity, to take into account the residency and businesslocation of bidders within the Town of Orange, and to award the bid deemed by the Town ofOrange to be in its best interest. Lowest price shall not be the sole determining factor whenawarding the bid. Bidders who are delinquent in taxes or fees to the Town of Orange will not beconsidered responsible bidders.7.0 TERMINATION7.1 Failure to comply with any of the requirements herein may be considered breach ofcontract and as such shall be subject to termination of the contract by the town.8.0 BID AND PERFORMANCE BONDS8.1 GENERAL All bonds required herein shall be provided by companies licensed to issuesuch documents in the State of Connecticut. Each Bond shall have a contact person’s name, theissuing office’s address, telephone number and fax number shown thereon and shall beautomatically renewable.8.2 BID BOND Each bidder shall submit a bid security in the amount of 10% of the totalbid price per ton for the first year of the contract multiplied by 900 tons. The security shall be inthe form of a certified or bank cashier’s check or a surety bond issued by a company licensed todo so by the State of Connecticut. Should the bidder fail to provide a performance bond,insurance certificate, and other submittals required by the bid documents within 15 calendar daysof the date of notice of award, said bid security may be forfeited to the town. All bidders’ bidsecurity will be returned after issuance of bid award, and submission of the required bond,insurance, and other submittals by the awarded contractor.8.3 PERFORMANCE BOND A properly executed surety Performance Bond, in theamount of 100% of the price bid per ton for the first year of the contract multiplied by 900 tons,shall be submitted, within fifteen (15) calendar days of the date of notice of award, to thefollowing town official:Director of Public Works / Town EngineerTown of Orange617 Orange Center RoadOrange, Connecticut 06477Page 3 of 16The Performance Bond shall guarantee performance of the contract in accordance with the termsof the Bid Documents and shall automatically renew each year of the contract period. Failure toperform the contract in accordance with the terms of the Bid Documents and termination of thecontract for cause shall allow the town to call the surety bond for recovery of all additional costsincurred by the town in obtaining a replacement contractor to provide the services called for inthe contract.9.0 INSURANCE9.1 Contractor shall agree to maintain in force at all times during the contract the followingminimum coverages and shall name the Town of Orange as an Additional Insured on a primaryand non-contributory basis to all policies, except Workers Compensation. All policies shouldalso include a Waiver of Subrogation.Insurance shall be written with Carriers approved in the State of Connecticut and with aminimum AM Best Rating of A- (Excellent) and minimum Financial Size Category of VIII. Should any of the above-described policies be cancelled, limits reduced orcoverage altered, 30 days’ written notice must be given to the Town of Orange.Page 4 of 16For purposes of insurance, all certificates and communications should be addressed to:Director of Public Works/Town EngineerTown of Orange617 Orange Center RoadOrange CT 0647710.0 GENERAL WORK REQUIREMENTS10.1 The work covered by the plans and specifications consists of furnishing all labor,material, supplies, equipment, tools, and incidentals necessary to perform hauling and disposal ofbulky waste, including construction and demolition waste, from the Town of Orange TransferStation on South Orange Center Road to a facility approved by the Connecticut DEEP and theTown of Orange. All bids shall contain the cost of all items and work, whether specified hereinor not, required to provide a complete project. Failure to include such items and workspecifically in the bid documents shall not be grounds for extra cost.All materials and equipment supplied by the contractor shall conform to the requirements of theBid Documents. No changes shall be allowed unless they are approved, in writing, by the town.All work shall be in accordance with federal, state, and town laws.The contractor shall supply a minimum of two (2) 40 CY open top roll-off dumpsters for bulkywaste. At least one (1) empty bulky waste dumpster must be on site at all times.10.2 Hours of WorkThe contractor must pick up full roll-off dumpsters and return dumpsters to the Transfer Stationduring the Transfer Station’s hours of operation. At least 1 empty bulky waste dumpster must beon site at all times.The Transfer Station is open six (6) days a week as follows:Monday, Wednesday, Friday & Saturday: 8:00 a.m. to 4:30 p.m.Tuesday & Thursday:8:00 a.m. to 2:00 p.m.The Transfer Station is closed on the following holidays: New Year’s Day, Memorial Day,Independence Day (July 4th), Labor Day, Thanksgiving, and Christmas.10.3 Total annual bulky waste tonnage is not guaranteed, but the annual average has beenapproximately 900 tons. Records are available for inspection at the Public Works Departmentoffice.10.4 The town will load the bulky waste dumpsters with its own equipment.Page 5 of 16
