Brief Description: MnDOT requests responses for a Contractor to provide design build verification for State Project (SP) 1901-207 on Trunk Highway (TH) 13 & Nicollet Design Build Project. Project Limits: The project is located in the City of Burnsville, Dakota County, Minnesota. The project limits extend a total of 0.8 miles from I-35W to Portland Ave along TH 13 and between River Ridge Lane and E Travelers Trail on Nicollet Ave. The project scope is to design and construct a grade separated interchange including roadway, bridges and bicycle and pedestrian facilities. The project scope also includes retaining walls, drainage infrastructure, traffic signals and sanitary sewer, etc. The Design Build Project letting is August 19, 2026. The goal of the Design Build Verification contract is for State to receive assistance in performing the tasks necessary to verify that the Design Build contractor is in conformance with the Design Build Conformed Contract.

MnDOT Contract No. 1062380Exhibit C: Specification, Duties, and Scope of Work1 Introduction and Background Information1.1 General Statement of Scope of WorkWork with State as the Design-Build Verification Consultant (DBVC), which will be called theContractor throughout this scope of work. The State Staff and Contractor are collectively known as theDesign-Build Verification Team (DBVT) for the State Project (SP) 1901-207 on Trunk Highway (TH) 13 &Nicollet Design-Build Project (Project). Contractor will provide design verification, constructionverification, and environmental compliance for the Project. The goal of the DBVC contract is that Statereceives assistance in performing the tasks necessary to verify that the Design Build Constructioncontractor (DB contractor) is meeting all requirements of the Design Build Conformed Contract for theProject. Contractor will attend conferences or meetings necessary for close coordination during day-to-day progress of the work or as required to carry out the Project. Contractor will notify State’s ProjectManager immediately of any unanticipated Project conditions. Contractor will maintain a record ofdesign submittals, approvals, changes, and modifications using State’s Document Control System(Microsoft SharePoint). Contractor will collect, properly label or identify, and deliver to State all originalcalculations, drawing and sketches, electronic design files, records, reports, and other documentsprepared by the DB contractor in the performance of the work as described in this contract uponcompletion or termination of the Project. Contractor will provide interpretations of the plans,specifications and contract provisions. Contractor will consult with State’s Project Manager when aninterpretation involves complex issues or may have an impact on the cost of performing the work. Whenwarranted, State’s Project Manager may request an interpretation from the Contractor.1.2 Co-locationThis project will be a partial co-location project. Contractor must meet the following requirements:1.2.11.2.21.2.31.2.41.2.51.2.61.2.71.2.8DB Project Manager. Locate in the co-located facility one day per week, plus available asneeded for face-to-face meetings.Change Management/Contract Engineer. Locate in the co-located facility one day per week, plusavailable as needed for face-to-face meetings.Construction Manager. Must be physically present at the project office or on-Site daily duringactive construction. Must remain involved with constructability and other reviews during thedesign phase of the project.Design Manager. Locate in the co-located facility one day per week for the duration of thedesign, plus available as needed for face-to-face meetings.Utility Coordination Lead: Locate in the co-located facility 50 percent during design and then co-located 75 percent of the time once construction starts.Design Team (Lead Structural Engineer, Lead Roadway Engineer, Lead Drainage Engineer, TrafficEngineer, Maintenance of Traffic Engineer, Americans with Disabilities Act [ADA] Engineer,Geotechnical Engineer, Retaining Wall Engineer, Intelligent Transportation Systems [ITS]Engineer, Stormwater Pollution Prevention Plan [SWPPP] Designer). Locate in the co-locatedfacility one day per week for the duration of the design, plus available as needed for face-to-facemeetings.Environmental Compliance Manager. Locate in the co-located facility 75 percent of the timeduring design and 50 percent of the time for the duration of the Project.Office and Document Control Manager. Co-located personnel are expected to be physically located in the project office for thetime indicated for each role. Co-located personnel will have a physical workspace, computer, phone andother common office supplies at the co-location office. Keep in mind, all personnel on the DBVT areobligated to meet the requirements of the Flexible Workforce section of this scope.In order to effectively manage the budget for the DBVT, co-located personnel will be expected toinform the Verification Consultant Project Manager and the State Project Manager, if co-locationrequirements are excessive based on the current verification activities of that role. If, in agreement withthe State’s Project Manager, it is decided that the co-located role can be just as effectively performedpartly from the team member’s home office then it may be determined that the co-locationrequirements be temporarily relaxed.Personnel that are not to be co-located at the project office can perform their role from their homeoffice. However, non-co-located personnel are required to report to the project office or project site asneeded for specific meetings, over the shoulder reviews, inspections, and other duties in a timely andefficient manner to fulfill the obligations of their roles on the DBVT.It is incumbent upon all DBVT members to utilize current web-conferencing best practices to be aneffective resource to the DBVT and the DB contractor during meetings, over the shoulder reviews andquestions that arise from the DB contractor for the DBVT. The purpose of a co-location office is tominimize difficulty of communication between the DBVT and the DB contractor, so technology cannotbe a hindrance in this relationship. If web-conferencing is not working efficiently to communicatebetween the two teams, the role member will be expected to be present at the co-location office asneeded so the DB contractor is not unduly delayed. It is important that any phone or web conferencetechnical difficulties be minimized or eliminated so that co-location can be effectively minimized foreach role.1.3 Project LettingThe Design Build Project letting is August 19th, 2026.1.4 Project ScopeThe project is located in the City of Burnsville Dakota County, Minnesota. The project limits extenda total of 1 mile from I-35W to Portland Ave along both TH 13 and Nicollet Ave.The project scope is to design and construct TH 13 and Nicollet including roadway, bridges, trafficsignals and bicycle and pedestrian facilities. Perform all worknecessary to assist with managing the DB Conformed Contract.2.1 DBVC Project ManagerThe responsibilities of the DBVC Project Manager are as follows:(A) Management of the contract including budget and performance management. The Contractorwill be expected to proactively review and manage the performance of Contractor teammembers without State involvement.(B) Assist State on strategy and high level project management and assist with implementation ofnationwide Design-Build best practices and lessons learned.(C) Assist with Independent Cost Estimating for Change Order negotiation purposes. The co-located office is expected to be located within one mile of the TH 13 andNicollet.2.3 Construction ManagerThe responsibilities of the Construction Manager are as follows:Supply one person to perform the duties of the Construction Manager. This person is assigned theoverall responsibility for verifying that the DB Contractor is meeting all requirements of the DB’s QualityManagement System (QMS) and requirements of the DB Conformed Contract and will:(A) Verify that the DB Contractor is training workers in the operation of the QMS,(B) Monitor that the QMS is being properly implemented and used,(C) Report to the State Project Manager on the QMS effectiveness and performance, and(D) Identify problems with the QMS and make recommendations to the State Project Managerfor revisions to improve the QMS.(E) Advise MnDOT staff on DB construction documentation.(F) Review project documentation.The Construction Manager has no responsibilities in the production of the Work, technical reviewof design documents, or performance of construction inspection.2.3.1 Co-locationMust be physically present at the project office or on-Site daily during active construction. Mustremain involved with constructability and other reviews during the design phase of the project.2.3.2 Flexible WorkforceDBVC personnel approved by the State’s Project Manager are considered by the State to becommitted to performing services for the durations listed in this scope of work. Any changes willrequire written approval from the State’s Project Manager and include both adding additional staff andreducing staff.Contractor will be advised of the official Notice of Award of the DB Conformed Contract and will beready to fully staff all personnel on the DBVT for the project within one week after notification. Nopersonnel will be assigned until written notification by the State’s Project Manager has been issued.If the DB Contract is suspended for any reason, the Contractor’s forces will be adjusted tocorrespond with the type of cessation, either complete or partial suspension. Contractor willcontinuously look ahead to fully understand what type of staff are needed and in what numbers. TheContractor’s schedule will be dictated by the DB contractor’s schedule. Contractor will provide a flexiblework force so that only those staff that can be fully utilized during any given project activity are presentand billing hours to the contract.Contractor will continuously monitor all activity to ensure that all work carried out is within theagreed scope and completed with resources that can complete the work as budgeted. In the event itbecomes necessary to complete work outside the original scope of work, the Contractor’s ProjectManager will notify State’s Project Manager immediately before proceeding. No work outside theoriginal scope will be done without written authorization from State’s Project Manager.Throughout this scope of work, the availability in the co-located facility will be defined as full-time(40 hours per week) or part time (less than 40 hours per week) for a specified duration.Throughout the course of the Project, it may become evident that two or more Contractor roleswould be more efficiently staffed by a single qualified person.
