Allreferences contained herein to “county” shall be construed to mean Jackson County. ThisRequest, together with all pages, documents, and attachments contained herein orsubsequently added or made a part hereof, submitted as a fully and properly executed bid, shallconstitute a contract with Jackson County, subject to the limitations set forth herein and anyspecific quantities that Jackson County may commit to herein and the successful and mostresponsible bidder, as determined by Jackson County.RFB Access:Jackson County officially posts bid documents online at https://www.mijackson.org/Bids.aspxand BidNet via Michigan Inter-governmental Trade Network (MITN)https://www.bidnetdirect.com/mitn sites. It will be the bidder’s responsibility to monitor for anyaddendums or amendments to this solicitation.Communications and Contacts with Jackson County Personnel:All contact with Jackson County regarding this RFB or any matter relating thereto must be sentin writing via e-mail to: Jim Couling (jcouling@mijackson.org). This is to ensure fairconsideration for all interested vendors. The County prohibits communications to or with anyother employee at the departmental level during the submission and evaluation period.2Section 1.0 – SPECIFICATIONS AND SCOPE OF WORK1.1 INTRODUCTION TO SPECIFICATIONSJackson County Department of Transportation (JCDOT) is seeking bids for overbandcrack sealing and a separate line item for applying Mastic pavement repair as a test ondedicated roads. The length of the proposed contract shall be for a two year period witha one year extension possible, if mutually agreed by both parties. Bid prices shall remainfirm for the course of this contract. The budget for this project is $250,000.00 per year.Contractor will follow attached list of roads (Attachment E) until yearly budget isdepleted. We will continue on the list of roads (Attachment E) the second year of thecontract. JCDOT has the rights to add or remove roads from (Attachment E) wheneverit’s in their best interest. The most responsive bid shall include the followingspecifications and requirements:1.2 SPECIFICATIONSThis work consists of furnishing all labor, equipment, and materials necessary for application ofjoint and crack sealant. All surface preparation and crack sealing shall be done in accordancewith the latest MDOT Specifications and the following requirements. The Jackson CountyDepartment of Transportation (JCDOT), will provide a list of roads with precedence to thecontractor prior to commencing work. All work will be coordinated through a representative ofthe road agency. These specifications are to be considered as a minimum to be used. Any othertypes of materials used, temperature changes or application must meet or exceed the listedspecifications and requirements1.2.1 REQUIREMENTSa) All joints and cracks will be waterproofed using the D-3405 Parking Lot Sealer orequivalent to sealant. The material shall be extruded under high temperature (370 to 390degrees F) and directly applied into and over the joints and cracks.b) Preparation of Surface - The surface shall be thoroughly clean and dry when thesealant/membrane is applied. Cleaning of cracks will be with minimum 100 PSIcompressed air and hand tools as necessary to remove dust, dirt, moisture, vegetationand foreign materials that would prevent bonding of the material. Cleaning work is to bedone concurrently with the application process. Air compressors shall be portable andcapable of furnishing not less than 100 PSI air pressure at the nozzle. The compressorshall be equipped with traps that will maintain the compressed air free of oil and water.c) The materials shall be blended in an oil jack doubled wall kettle equipped with anagitator (reversing rotary auger action) and separate thermometers for the oil bath andthe blending vat. A 2-inch recirculation pump is required to provide circulation of thematerials when not applying the crack sealant. The unit shall be capable of mixing 2,000pound minimum batches of material. When using field mixed material, add the polyesterfibers to the polymer modified asphalt cement and thoroughly mix in the kettle. Do notexceed 400 degrees in the field mix or prepackaged materials. Apply the material byeither a wand followed by a "V" or "U" or a “BOX” shaped squeegee or a round head3having a concave underside. Apply 4 inches wide for a standard coverage and not toexceed a maximum of 6 inches to provide complete and uniformed coverage over multi-crack areas. Apply sealant at a thickness necessary for a neat job and that preventsexcess material from being applied.d) No material shall be applied unless the ambient air temperature is 50 degrees and rising.No material shall be applied while the surface is wet.e) Traffic shall be kept off the newly placed sealant until it has cooled and set enough toprevent tracking by vehicle tires and/or pullout of the sealant.f) The completion date for all proposed projects is October 15th, of each year. A pre-construction meeting will be conducted before work begins. The contractor will providethe agency with the name and telephone number of its employee in charge. Thesuccessful bidder, as part of the project award, shall be required to execute, and abideby, the terms and conditions of this contract. All work will be coordinated throughrepresentative of the agency. All work will be done in a workmanlike manner and issubject to inspection by the road agency. The job will be left in a condition acceptable tothe road agency.g) Successful bidder shall provide the agency with a "Daily Sheet" for documentinginformation referencing the job.h) All signing and barricades required shall be the responsibility of the contractor and shallconform to the requirements for construction signing in the latest version of the MichiganUniform of Traffic Control Devices. The contractor will maintain local traffic flow at alltimes.i) Overbanding may be performed on State Trunklines.1.2.2 MODIFICATION TO WORK:a) Jackson County or its designated representative reserves the right to modify this serviceduring the course of this agreement. Such modification may include changing thelocations to be serviced, additional locations to be serviced, method or manner ofperformance of the work, number of day’s service to be performed, addition or deletionof tasks to be performed, and/or any other modifications deemed necessary by JacksonCounty. Changes to proposed pricing by the Contractor resulting from the proposedchanges are subject to acceptance by Jackson County. Modifications to workassignment may be to increase or decrease projects.1.3 PRICEPricing as submitted by bidders on Attachment D shall be for the duration of the agreement.4Section 2.0 – BIDDER INFORMATION AND ACCEPTANCE1. The undersigned declares that the Bid Documents, including, without limitation, any RFBAddenda and Exhibits have been read.2. The undersigned is authorized, offers, and agrees to furnish the articles and/or servicesspecified in accordance with the Specifications, Terms & Conditions of the Bid Documentsof RFB #189 – Overband Crack Sealing.3. The undersigned has reviewed the Bid Documents and fully understands the requirementsin this Bid including, but not limited to, the requirements under the County Provisions, andthat each Bidder who is awarded a contract shall be, in fact, a prime Contractor, not asubcontractor, to County, and agrees that its Bid, if accepted by County, will be the basis forthe Bidder to enter into a contract with County in accordance with the intent of the BidDocuments.4. The undersigned acknowledges receipt and acceptance of all addenda.5. If selected for award, the following certifications will be required before work commences: Certification Regarding Debarment, Suspension, Ineligibility and Voluntary Exclusion Certification Regarding Nondiscrimination Under Federally and State Assisted Programs Assurance Regarding Access to Records and Financial Statements Iran Economic Sanctions Act6. The undersigned acknowledges that Bidder will be in good standing in the State ofMichigan, with all the necessary licenses, permits, certifications, approvals, andauthorizations necessary to perform all obligations in connection with this RFB andassociated Bid Documents.7. It is the responsibility of each bidder to be familiar with all of the specifications, terms andconditions and, if applicable, the site condition. By the submission of a Bid, the Biddercertifies that if awarded a contract they will make no claim against the County based uponignorance of conditions or misunderstanding of the specifications.8. Patent indemnity: Vendors who do business with the County shall hold the County ofJackson, its officers, agents and employees, harmless from liability of a nature or kind,including cost and expenses, for infringement or use of any patent, copyright or otherproprietary right, secret process, patented or unpatented invention, article or appliancefurnished or used in connection with the contract or purchase order.9. Insurance certificates are not required at the time of submission. However, if awarded, theContractor agrees to meet the minimum insurance requirements posted in the terms andconditions. This documentation must be provided to the County, prior to award, and shallinclude an insurance certificate and additional insured certificate, naming the County ofJackson, which meets the minimum insurance requirements, as stated in the terms andconditions.5
