Town of Orange, ConnecticutBID DOCUMENTSMUNICIPAL SOLID WASTE (MSW)HAULING & DISPOSAL SERVICES1.0 INVITATION TO BID1.1 The Town of Orange requests bids for the hauling and disposal of Municipal Solid Waste(MSW) from its Transfer Station on South Orange Center Road to the WIN WasteBridgeport CT waste-to-energy facility, or other facility approved by the Connecticut DEEPand by the Town of Orange.1.2 Bidders are required to comply with the instructions contained in these Bid Documents, andto provide information where requested. All questions will be answered by email.2.6 Bidders must provide contact information to the town by emailing afaustini@orange-ct.govand bbrinton@orange-ct.gov, to ensure that they receive bid addenda and other notifications.3.0 BID FORMS AND SUBMISSION INSTRUCTIONS3.1 Copies of the bid documents may be obtained from the Town of Orange Website and Stateof Connecticut Contracting Portal (CTsource).3.2 Ditto marks are not considered writing; shall not be used; and can be reason for non-acceptance of a bid.3.3 All bids must be submitted in a sealed envelope, clearly marked “MSW Hauling &Disposal”, and received in the Public Works office by the time of the bid opening specified above.In addition to the BID FORM, the bidder’s BIDDER QUALIFICATION STATEMENT and NON-COLLUSIVE AFFIDAVIT OF PRIME BIDDER must also be enclosed in the sealed envelope.Page 1 of 17Bids, corrections, and/or modifications received after the time the town officials open the first bidwill not be accepted.Bidders are responsible for checking the bid posting on the state contracting portalhttps://portal.ct.gov/DAS/CTSource/CTSource or on the Town of Orange website for bidaddenda and responses to bidders’ questions, up to the time of the bid opening.3.4 The BID FORM must be signed by an authorized agent of the submitting company.3.5 All information submitted, must be in ink or typewritten. Mistakes may be crossed out andcorrections inserted. The person signing the bid form must initial corrections.3.6 The inability to meet any specified requirement(s) shall be clearly stated in writing andattached to the bid form or written on the bid form.3.7 At the time of opening the bids, bidders shall be presumed to have inspected the site and bethoroughly familiar with the bid documents. Failure of any bidder to inspect the project site, askquestions, or to examine the bid documents, shall not relieve any bidder from obligations withrespect to their bid.3.8 The specifications listed are to be interpreted as meaning those acceptable to the Town ofOrange. Substitutions that are “an approved equal,” will be considered.3.9 Prior to submitting a bid, bidders must visit the Orange Transfer Station site. Bidders mustsign in at the scale house near the front gate. Change orders related to conditions that could beobserved on a site visit will not be approved.3.10 The bidder must have significant experience performing municipal solid waste hauling anddisposal. Qualifications and references must be provided on the bid forms.4.0 CONTRACT DURATION4.1 The contract shall run for four years from July 1, 2026 to June 30, 2030.5.0 PAYMENT5.1 Payment shall be at the bid unit prices per ton. Net MSW weight shall be as determined bythe town scale. Scale tickets from the disposal facility, as well as scale tickets from the towntransfer station scale, shall be submitted to the town with invoices. The contractor shall submitmonthly invoices with supporting documentation (scale tickets).6.0 MISCELLANEOUS6.1 Bidders may withdraw their bid any time prior to the time of bid opening. No bidder shallwithdraw, cancel, or modify their bid for a period of sixty (60) days after bid opening.6.2 The Town of Orange is exempt from Connecticut Sales and Use Taxes and Federal ExciseTaxes. Bidders shall avail themselves of these exemptions.Page 2 of 176.3 The Town of Orange reserves the right to accept any bid, to reject any or all bids, to waiveany minor bid informality or irregularity, to take into account the residency and business location ofbidders within the Town of Orange, and to award the bid deemed by the Town of Orange to be in itsbest interest. Lowest price shall not be the sole determining factor when awarding the bid. Bidderswho are delinquent in taxes or fees to the Town of Orange will not be considered responsiblebidders.7.0 TERMINATION7.1 Failure to comply with any of the requirements herein may be considered breach of contractand as such shall be subject to termination of the contract by the town.8.0 BID AND PERFORMANCE BONDS8.1 GENERAL All bonds required herein shall be provided by companies licensed to issuesuch documents in the State of Connecticut. Each bond shall have a contact person’s name, theissuing office’s address, telephone number and fax number shown thereon and shall beautomatically renewable.8.2 BID BOND Each bidder shall submit a bid security in the amount of 10% of the bid priceper ton for the first year of the contract multiplied by 4,500 tons. The security shall be in the form ofa certified or bank cashier’s check or a surety bond issued by a company licensed to do so by theState of Connecticut. Should the bidder fail to provide a performance bond, insurance certificate,and other submittals required by the bid documents within 15 calendar days of the date of notice ofaward, said bid security may be forfeited to the town. All bidders’ bid security will be returnedafter issuance of bid award, and submission of the required bond, insurance, and other submittals bythe awarded contractor.8.3 PERFORMANCE BOND A properly executed surety Performance Bond, in the amountof 100% of the price bid per ton for the first year of the contract multiplied by 4,500 tons of MSW,shall be submitted, within fifteen (15) calendar days of the date of notice of award, to the followingtown official:Director of Public Works / Town EngineerTown of Orange617 Orange Center RoadOrange, Connecticut 06477The Performance Bond shall guarantee performance of the contract in accordance with the terms ofthe Bid Documents and shall automatically renew each year of the contract period. Failure toperform the contract in accordance with the terms of the Bid Documents and termination of thecontract for cause shall allow the town to call the surety bond for recovery of all additional costsincurred by the town in obtaining a replacement contractor to provide the services called for in thecontract.Page 3 of 179.0 INSURANCE9.1 Contractor shall agree to maintain in force at all times during the contract the followingminimum coverages and shall name the Town of Orange as an Additional Insured on a primary andnon-contributory basis to all policies, except Workers Compensation. All policies should alsoinclude a Waiver of Subrogation.Insurance shall be written with Carriers approved in the State of Connecticut and with a minimumAM Best Rating of A- (Excellent) and minimum Financial Size Category of VIII. Should any of the above-described policies be cancelled, limits reduced orcoverage altered, 30 days’ written notice must be given to the Town of Orange.For purposes of insurance, all certificates and communications should be addressed to:Director of Public Works/Town EngineerTown of Orange617 Orange Center RoadOrange CT 06477Page 4 of 1710.0 GENERAL WORK REQUIREMENTS10.1 The work covered by the plans and specifications consists of furnishing all labor, material,supplies, equipment, tools, and incidentals necessary to perform hauling and disposal of MunicipalSolid Waste (MSW) from the Town of Orange Transfer Station on South Orange Center Road tothe WIN Waste Bridgeport CT waste-to-energy facility, or other facility approved by theConnecticut DEEP and by the Town of Orange. All bids shall contain the cost of all items andwork, whether specified herein or not, required to provide a complete project. Failure to includesuch items and work specifically in the bid documents shall not be grounds for extra cost.All materials and equipment supplied by the contractor shall conform to the requirements of the BidDocuments. No changes shall be allowed unless they are approved, in writing, by the town. Allwork shall be in accordance with federal, state, and town laws.10.2 The Transfer Station has a hopper type compactor, designed to accommodate closed toptransfer trailers. The successful bidder must provide trailers that accommodate our equipment,including locking with the compactor hooks to provide a tight connection between the trailer andthe compactor, so that MSW does not escape.10.2 Hours of WorkThe contractor must pick up full trailers and return empty trailers to the Transfer Station during theTransfer Station’s hours of operation. At least 1 empty trailer, in addition to the trailer attached tothe compactor, must be on site at all times.The Transfer Station is open six (6) days a week as follows:Monday, Wednesday, Friday & Saturday: 8:00 a.m. to 4:30 p.m.Tuesday & Thursday:8:00 a.m. to 2:00 p.m.The Transfer Station is closed on the following holidays: New Year’s Day, Memorial Day,Independence Day (July 4th), Labor Day, Thanksgiving, and Christmas.10.3 Total annual MSW tonnage is not guaranteed, but the annual average has beenapproximately 4,500 tons. Records are available for inspection at the Public Works Departmentoffice.10.4 The town will shift full trailers from the compactor to storage on the site and replace withempty trailers left at the site with its own equipment.Page 5 of 17
