All work shall be in accordance with the requirements statedherein, Scope of Work Specifications, Drawings and Reference documents, Insurance Requirementsand applicable State of Alabama and Federal Laws. The project site is the barge mooring area inGarrows Bend, near the Alabama Port Authority’s McDuffie Terminal in Mobile, AL.The work consists principally of providing bonds, labor, materials, equipment, insurance, andsupervision necessary to remove damaged barge mooring dolphin piles, furnish and install newmooring dolphin piles, and dispose of all removed materials associated with the work. The projectincludes but is not limited to: removing existing damaged dolphin piles at locations shown on thePlans, furnishing and installing new 42” dolphin piles with mooring bit per the attached drawings, anddisposal of all removed piles. All materials, labor, tools, rigging and equipment necessary to performthe work shall be included by the Contractor in the proposal. It is the Contractor’s responsibility tofield verify all dimensions and site conditions essential for the successful completion of the work. TheContractor shall not be entitled to any additional compensation for any work or expense resultingfrom the neglect of verifying all existing site conditions.All Contractors submitting bids are to carefully examine the site of the proposed work and thoroughlyreview the contract requirements prior to submission of a bid proposal. Each Bidder shall satisfyoneself as to the character, quality, and quantities of work to be performed, and as to therequirements of the proposed contract. The submission of a proposal shall be proof that the biddingContractor has made such examination and is satisfied as to the conditions to be encountered inperforming the work and as to the requirements of the proposed Contract. All bidding Contractorsmust hold a current license from the State Licensing Board for General Contractors, Montgomery, ALwith the classification of (H/RR) Heavy/Railroad, or (H/RR-S) Specialty Construction-MarineConstruction, or (H/RR-S) Pile Driving.The work performed under this contract shall not commence until the Contractor has submitted aPerformance Bond, Labor & Material Bond, and Certificate of Insurance (COI) in an acceptable form.Performance Bond and Labor & Material Bonds shall be in an amount equal to 100% of the contractprice; Certificate of Insurance shall be as per the attached requirements and countersigned by alicensed resident agent in the State of Alabama.Form ENG-FR-003 R&P TemplateLast Revised 1/31/12Alabama Port AuthorityRequisition and ProposalProject Name Replace Barge Fleet Mooring PilesProject No. 11751 Task No. 12|P a g eThe Contractor shall comply with all Federal and State laws, local ordinances and regulations, and allorders and decrees of bodies or tribunals having any jurisdiction or authority, which in any manneraffect those engaged or employed on the work, or which in any way affect the conduct of the work.The Alabama Port Authority will utilize its sales tax exemption status on this project.The Contractor will be responsible for the purchase of all materials and will be required to apply for asales and use tax certificate of exemption upon contract award.Following receipt of “Notice to Proceed,” the Contractor will be required to furnish proof of purchaseof materials within 10 calendar days and supply a schedule for the work. The Contractor will berequired to complete all on-site work under the Contract within 30 calendar days after commencingwork. The work will have to be scheduled and performed in a manner that will not interfere with theoperations of McDuffie Terminal in the immediate and adjacent areas. APA intent is that work hourswill be during normal daylight hours.The Alabama State Docks is a full-time operating facility; operating 24 hours a day, 365 days a year,including nights, weekends and holidays. The Contractor will be required to coordinate work withbarge fleet operations as necessary to facilitate barge staging. Coal barges are moved in and out ofthe area on a daily basis. The contractor is responsible for working diligently to minimize anydisruption and avoid unnecessary delays. The Contractor is responsible for the disposal of all wastematerials associated with the work.The Contractor shall place a competent superintendent on the Project who shall have experience inthe work being performed under the Contract. The assigned superintendent shall have theresponsibility for the day-to-day operations of the work and shall remain on the Project site while thework under the Contract is being performed. It is the responsibility of the Contractor to becomefamiliar with all conditions affecting the nature and manner of the work.The Contractor will agree to comply with the safety rules, standards and regulations of the FederalOccupational Safety and Health Administration (OSHA) applicable to each of its operations, and tothose established and recommended safety standards inherent in the industry; and to comply withU.S. Coast Guard regulations applicable to waterfront facilities and the policies of the Alabama PortAuthority while occupying any property of the Alabama Port Authority.Time is an essential element in the contract. As the prosecution of the work will inconvenience theterminal and interfere with business, it is important that the work be pressed vigorously tocompletion. Also, the cost to the Alabama Port Authority of the administration of the contract,supervision, inspection and engineering will be increased as the time occupied in the work islengthened. Therefore, exclusive of Sundays and national holidays, for each day that the workremains incomplete after the time specified, an amount of $500.00 shall be paid by the contractor tothe Alabama Port Authority as liquidated damages for the loss sustained by the State because offailure of the contractor to complete the work within the specified time.Form ENG-FR-003 R&P TemplateLast Revised 1/31/12Alabama Port AuthorityRequisition and ProposalProject Name Replace Barge Fleet Mooring PilesProject No. 11751 Task No. 13|P a g eSubsequent to the final acceptance of this project by the Engineer, the following requirements mustbe satisfied by the Contractor before final payment can be made.a) The Contractor must execute copies of CONTRACTOR'S AFFIDAVIT OF PAYMENT OF CLAIMS ANDDEBTS on the form furnished by the Engineer.b) The Contractor must have their surety execute copies of CONSENT OF SURETY TO FINAL PAYMENTon the form furnished by the Engineer.c) The Contractor must furnish a letter on their letterhead acknowledging that acceptance of finalpayment by the Contractor constitutes a waiver of all claims, present or future, in connection withthis project.d) The Contractor must furnish a written guarantee on their letterhead covering all defects inmaterial and workmanship for a period of one (1) year commencing on the date of finalacceptance.e) If any purchased items have been incorporated in the work, the Contractor must furnish a letteron their letterhead assigning those warranties to the OWNER. The Owner may terminate the contract, or any portion thereof, for just cause by written noticeto the Contractor. If the contract, or any portion thereof, is terminated before completion of allitems of work in the contract, payment will be made for the actual number of units or items ofwork completed or started. No claims for loss of anticipated profits will be considered.7. If the Contractor to whom this contract is awarded does not provide adequate service orworkmanship, APA reserves the right to cancel the contract and re-bid this work excluding thatContractor from consideration.8. All questions about the meaning or intent of the Contract Documents shall be submitted to theengineer in writing to brandon.taylor@alports.com. Replies will be issued by Addenda posted tothe APA website. All addenda issued shall become part of the Contract Documents. Onlyquestions answered by formal written Addenda will be binding. Oral and other interpretationsor clarifications will be without legal effect. Deadline for questions is seven (7) calendar daysprior to the bid opening unless noted otherwise.9.
