All responses must be submitted through the bid portalITEM AND DESCRIPTIONShawnee County seeks proposals from qualified vendors to provide professional pharmaceutical consultationservices for the Shawnee County Health Department (SCHD), per the following minimum requirements.SCOPE & INFORMATIONShawnee County seeks proposals from qualified vendors to provide professional pharmaceutical consultationservices for the Shawnee County Health Department (SCHD). Services must be provided by a Kansas-licensed pharmacist eligible to serve as Pharmacist-in-Charge, with responsibilities including oversight ofordering, maintaining, distributing, and documenting pharmaceutical products used in SCHD patient servicesand clinical programs.This contract does not require daily onsite presence. Routine activities (consultation, policy review,questions) may be conducted remotely, with scheduled onsite quarterly audits and occasional onsite visitsas needed.Page 1 of 14Important Program Note: SCHD does not stock controlled substances or drugs of concern. All services andcompliance requirements described herein are limited to non-controlled, FDA-approved medications used inSCHD’s clinical operations.The vendor is to provide professional pharmaceutical consultation services for the County. Professionalpharmaceutical consultation services are pharmaceutical consolation services, which are usually provided bya licensed Pharmacist under the law of the State of Kansas. The vendor should be able to provideprofessional pharmaceutical consultation services for the County for ordering and maintaining certainpharmaceutical products for the patients of Shawnee County Health Department.1. To meet the requirements set forth in K.S.A. 65-1648(d)(1) and K.A.R. 68-7-18K.S.A. 65-1648 - Distribution and control of prescription medications by a medical care facilitypharmacy, health department, indigent health care clinic, federally qualified health center or familyplanning clinic; maintenance and use of emergency medication kit by adult care home; rules andregulations(d)(1) The department of health and environment, any county, city-county or multicounty health department,indigent health care clinic, federally qualified health center and any private not-for-profit family planningclinic, when registered by the board, may keep drugs for the purpose of distributing drugs to patients beingtreated by that health department, indigent health care clinic, federally qualified health center or familyplanning clinic. Distribution and control of prescription medications in a health department, indigent healthcare clinic, federally qualified health center or family planning clinic shall be under the supervision of apharmacist in charge. A designated registered nurse or nurses or a licensed physician assistant approved bythe pharmacist in charge shall be in charge of distribution and control of drugs in the health department,indigent health care clinic, federally qualified health center or family planning clinic under the supervision ofthe pharmacist in charge when a pharmacist is not on the premises. Drugs supplied to patients when apharmacist is not on the premises shall be limited to the quantity necessary to complete a course of treatmentas ordered by the practitioner supervising such treatment.K.A.R 68-7-18 - Health departments and private not-for-profit family planning clinicsThe supply and control of drugs provided by health departments, private not-for-profit family planningclinics, federally qualified health centers, and indigent healthcare clinics authorized under K.S.A. 65-1648(d)(1), and amendments thereto, shall conform to the following requirements:(a) The approved drugs that may be stored and supplied by health departments, not-for-profit familyplanning clinics, and indigent healthcare clinics shall be only noncontrolled drugs that are approved by thefood and drug administration.(b) The approved drugs that may be stored and supplied by a federally qualified health center shall be onlydrugs that are approved by the food and drug administration.(c)(1) The pharmacist-in-charge shall ensure that health departments, family planning clinics, federallyqualified health centers, and indigent healthcare clinics maintain and implement written policies andprocedures for the following:(A) Supervision of all personnel in the supply and control of drugs;(B) storage, control, supply, labeling, and prepacking of drugs;Page 2 of 14(C) documentation of at least quarterly checks of drug records, drug storage conditions, anddrugs stored in all locations within the facility by a pharmacist;(D) drug recall procedure that can be effectively implemented; and(E) maintaining records of supplying and prepacking of drugs.(2) Drugs packaged in advance of immediate need shall meet the requirements of K.A.R. 68-7-15 and68-7-16.(d) The procedures for the control and supplying of drugs within health department facilities, familyplanning clinics, federally qualified health centers, and indigent healthcare clinics shall be consistent with thefollowing requirements:(1) Adequate records of the drugs supplied by the designated registered professional nurse or nursesshall be maintained and shall include the prescriber's order or written protocol.(A) If the prescriber's order was given verbally, the designated registered professional nurseor nurses shall reduce that order to writing. The written copy of the order shall be maintainedin a permanent patient file.(B) The records shall include the following:(i) The full name of the patient;(ii) the date ordered;(iii) the name of the drug, strength, and the quantity supplied;(iv) the directions for use;(v) the prescriber's name and the name of the supervising physician if the prescriber isa physician's assistant; and(vi) if the order is received verbally, the first and last name of the registeredprofessional nurse that received that order.(C) The following shall be recorded in a log or accessible in a searchable database:(i) The full name of the patient;(ii) the name of the drug, strength, and quantity supplied;(iii) the date supplied;(iv) the internal ID number assigned to the supply of the drug provided.(2) A supply of drugs shall be provided to a patient by a designated registered professional nurse ornurses pursuant to a prescriber's order. Only a designated registered professional nurse or nurses mayaccess the pharmacy area and remove the supply of the drugs. The supply shall conform with thelabeling requirements of K.A.R. 68-7-14.(e) The designation of a pharmacist-in-charge of a health department, family planning clinic, federallyqualified health center, or indigent healthcare clinic shall be subject to the provisions of K.A.R. 68-1-2a and68-7-13.Page 3 of 14Scope of Services1. The successful pharmacist-in-charge contractor will be qualified as a pharmacist-in-charge incompliance with K.A.R. 68-1-9.K.A.R. 68-1-9 - Pharmacist-in-charge; responsibilities(a) Each pharmacist-in-charge shall develop, supervise, and coordinate all pharmaceutical servicesperformed within the pharmacy to ensure compliance with the Kansas pharmacy act, the state and federaluniform controlled substances act, the state and federal food, drug, and cosmetic act, and all applicableregulations.(b) Each pharmacist-in-charge shall be personally available to the extent required to ensure comprehensivepharmaceutical services within the pharmacy and to develop a staff of additional licensed pharmacists andsupportive personnel as necessary to serve the needs of the pharmacy. Each pharmacist-in-charge shallmaintain records in the pharmacy describing the training and education regarding work functions performedby all pharmacy personnel. Each pharmacist-in-charge shall maintain in the pharmacy written procedures forthe following:(1) Designating the person or persons functioning as pharmacy technicians and supportive personnel;(2) describing the job duties of all personnel;(3) documenting the procedural steps taken by the pharmacist-in-charge to limit the functions of allpersonnel to their respective pharmacy work functions; and(4) documenting training and related education for non-discretionary tasks performed by pharmacytechnicians.(c) Each pharmacist-in-charge shall be responsible for direct supervision of all pharmacy personnel, for thesecurity of the pharmacy, and for the security of all drugs in the pharmacy.(d) Each pharmacist-in-charge shall ensure that the pharmacy maintains adequate drug informationreferences commensurate with services offered and a current copy of the state laws and regulations listed insubsection (a).(e) Each pharmacist-in-charge shall be responsible for establishing a drug recall procedure that can beeffectively implemented.(f) Each pharmacist-in-charge shall be responsible for developing written procedures for maintaining recordsof drug distribution, prepackaging, repackaging, and compounding. Prepackaging and repackaging of drugsshall be done in accordance with K.A.R. 68-7-15 and labeled in accordance with K.A.R. 68-7-16.(g) Each pharmacist-in-charge shall be responsible for reviewing each published board newsletter andposting the newsletter in a conspicuous area within the pharmacy until publication of the next boardnewsletter.(h)(1) Each pharmacist shall submit to the board, on a form provided by the board, notice of ceasing to serveas the pharmacist-in-charge at a pharmacy or facility required to have a pharmacist-in-charge no later thanfive days after ceasing to serve as the pharmacist-in-charge.Page 4 of 14(2) Each pharmacist ceasing to serve as the pharmacist-in-charge shall inventory all controlledsubstances and drugs of concern, as defined by K.S.A. 65-1682 and amendments thereto, in thepharmacy or facility in accordance with the inventory requirements of K.A.R. 68-20-16 no more thantwo days before ceasing to serve as the pharmacist-in-charge and no later than the day ceasing toserve as the pharmacist-in-charge.(3) Each pharmacist beginning to serve as the pharmacist-in-charge shall inventory all controlledsubstances and drugs of concern, as defined by K.S.A. 65-1682 and amendments thereto, in thepharmacy or facility in accordance with the requirements of K.A.R. 68-20-16 after beginning to serveas the pharmacist-in-charge but no more than two days after beginning to serve as the pharmacist-in-charge. The inventory may be taken simultaneously with the previous pharmacist-in-charge on thelast day of the previous pharmacist-in-charge if both pharmacists are present in the pharmacy,actively participate in the inventory, and sign the inventory.(4) If a pharmacist ceasing to serve as pharmacist-in-charge is unable to complete the inventoryspecified in paragraph (2) of this subsection or is terminated for a suspected or known violation of theKansas pharmacy act, the pharmacy or facility owner shall request approval from the board todesignate another pharmacist to conduct the inventory. If the board approves the request, thepharmacy or facility owner may designate another pharmacist to conduct the inventory specified inparagraph (2) of this subsection within the designated time frame.CONTRACT TERMThis will be a one-year agreement with options for automatic renewal.LICENSE & INSURANCE REQUIREMENTSThe vendor is required to meet all current Kansas Board of Pharmacy standards. Must have professionalliability and malpractice insurance as required by the State of Kansas.A. Licensing• Contractor must be licensed by the Kansas State Board of Pharmacy and eligible to serve asPharmacist-in-Charge.• Contractor must comply with applicable provisions referenced in K.S.A. 65-1648(d)(1), K.A.R. 68-7-18, and K.A.R. 68-1-9.B.
