Decatur Street, Watkins Glen, N.Y. 14891. All bids must be submitted in a sealed envelope to the Clerk of the Legislature, 105 Ninth Street, Unit 6, Watkins Glen, NY 14891 by Thursday, March 12, 2026 at 10:00 a.m. Bids will be publicly opened that same day at 10:15 a.m. and will be considered by the Schuyler County Legislature at a later date. The County of Schuyler reserves the right to accept or reject any or all bids.

Objective:This bid document is published in order to obtain competitive prices for: Crushed Limestone.2. Acquisition of Bid Documents:a. Bid documents are available February 18, 2026 at the Schuyler County Highway Department,910 S. Decatur Street, Watkins Glen, New York. The office is open Monday – Friday, 7:00A.M. – 4:00 P.M., except holidays. Telephone number 607-535-2531. These documents arealso available on the Schuyler County website at www.schuylercounty.us/highwaybids.b. Each bidder bears sole responsibility for acquisition of bid documents. Request for biddocuments to be forwarded is neither a guarantee nor an incurred obligation on the partof Schuyler County to ensure requestor’s receipt of bid documents; timely or otherwise.c. Receipt of these bid documents, unsolicited or otherwise, shall not be construed a pre-determination of any prospective bidder’s qualifications to receive a contract award. Nor shallsaid receipt of these bid documents be interpreted as an endorsement that the recipient’sequipment, materials, products, and/or services are in compliance with the bid specifications.3. Examination, Interpretation, Correction of Bid Documents:Each bidder shall examine all bid documents and judge all matters relating to the adequacy and accuracyof such documents. Any inquiries, suggestions or requests concerning interpretation, clarification oradditional information pertaining to this bid solicitation shall be in writing and submitted to theHighway Department prior to the scheduled bid opening. The County shall not be responsible for oralinterpretations given by any county employee, representative or others. The issuance of writtenaddendum/addenda is the only official method whereby interpretation, clarification oradditional information can be given.4. Preparation of Bid Documents:Bids must be submitted on the forms provided in the bid documents and prepared in the followingmanner:a. All bid forms shall be legibly completed using a permanent medium (e.g. ink, typewriter, laserprinter, etc.).i. If the submission of unit price(s) is a requirement, said unit price(s) shall prevail.ii. Each price bid shall be expressed as a numerical dollar value; indicators such as ditto marks,arrows, etc. are not acceptable.b. All forms requiring the bidder’s signature shall be signed by the bidder or the bidder’s authorizedrepresentative. Erasures and/or alterations shall be initialed by the individual whose signatureappears on the bid forms.c. The bidder shall submit the bid in accordance with the bid documents and shall not make anychanges in the wording of the bid forms or make any stipulations or qualify the bid in anymanner.d. Unless otherwise specified by Schuyler County, all bids are required to be: FOBDestination, freight allowed. Destination to be designated by the County.e. All bids shall be firm for a period of forty-five (45) days from the bid opening date; during whichtime the County shall render its decision.page 2Crushed Limestone5. Standard Clauses and Insurance Requirements for all Schuyler County Contracts:The following appendices are annexed hereto, incorporated by reference as if set forth more fully hereinand shall govern all terms and conditions of this bid and any resulting contract:a. APPENDIX A: Standard Clauses for ALL Schuyler County Contracts.b. APPENDIX B: County Insurance Requirements for All ContractsContractor is a "Category II" contractor under the "County Insurance Requirementsfor All Contractors" and shall maintain and provide proof of insurance in accordancewith said standards and the terms and conditions of such contract, including allattachments and/or appendices hereto. Each awardee shall submit as original of itsCertificate of Insurance (which indicates the contractor's compliance with the above tothe following:Schuyler County Highway DepartmentAttention: Ken Thurston, Superintendent910 S. Decatur StreetWatkins Glen, NY 14891(607) 535-2531Note: "Additional Insured" shall read - “The County of Schuyler and its officers,employees and agents is named as Additional Insured with respect to this contract.” In theevent that the awardee's insurance lapses during the term of the contract, the Countyreserves, as its right, the right to cancel the awardees contract(s) and to purchase thecontracted product(s)/service(s) on the open market; with any increase to cost(s) toSchuyler County being charged to the awardee. Credit shall not be issued to the awardeewhere open market cost(s) to the County are less than the cost(s) contracted with theawardee.o Any bid which attempts to amend, change or delete said Appendices, or any provision thereof,shall be deemed “non-responsive” and rejected.6. Sales Tax Exemption:The County is exempt from payment of sales and compensating use taxes of the State of New York andof cities and counties within the State of New York.7. Equivalents:Where, in the bid documents, one certain kind, type, brand, technology or product manufacturer isnamed, it shall be regarded as the required standard of quality. It is not meant to exclude competition inany way. Similar equipment, products, or service, which are equal in quality, performance, compatibilityand equally adaptable for the intended purposes, as determined by the County, and are submitted asspecified in the bid documents, will be considered and may be accepted. The decision of the County asto equal will be final.8. Supportive Documentation:In addition to specifications stated herein, all equipment/material/products/services shall meet or exceedcurrent standards of the industry. All technical tolerances, ratings, power outputs or any technicallyspecified criteria contained within these specifications are considered to be within the current state of theart and are currently being met by commercially available equipment/material/products/services. Thefact that a manufacturer chooses not to produce equipment/material/products to meet these specificationsshall not be considered sufficient cause to adjourn these specifications as restrictive. Bidder shall offerthe equipment/material/products/services which comes closest to meeting these specifications. Wheredeviation(s) from the specifications contained herein is necessary, the bidder shall note suchdeviation(s). Bidder shall include supportive documentation that clearly indicates theequipment/material/products/services they bid is equivalent to that specified herein. Failure todetail all such deviations will comprise sufficient grounds for rejection of the entire bid.page 3Crushed Limestone9. Protection from Claim Against “Or Equal”:In the event of any claim concerning or relating to the issue of “equal or better” or “equal”, the awardeeagrees to hold the County of Schuyler free and harmless from any and all claims for loss or damagearising out of this transaction for any reason whatsoever. The County is to be free and harmless for anyand all legal fees and court costs.10. Addendum/Addenda:a. If any addendum/addenda has been issued prior to the County’s receipt of bids, Schuyler Countyshall attempt to notify potential bidders known to have received the bid documents and whosecontact information is on file with the County. Schuyler County does not ensure the potentialbidder’s receipt of addendum. It shall be the responsibility of each bidder, prior to submitting itsbid, to contact the Highway Superintendent (607) 535-2531, to determine if an addendum has beenissued.b. Any such addendum/addenda shall be available for review and/or copy at the HighwayDepartment, 910 S. Decatur Street, Watkins Glen, New York.c. It is a requirement that the bidder sign, date, and include any and all addendum/addenda with itsbid submission. Failure to do so may result in rejection of bid.11. Multiple/Alternate Bid Submission(s):For those bidders intending to submit multiple/alternate bids in response to this bid solicitation; thebidder is required and shall submit a completed bid documents packet for each bid submitted. Note:However, if there is a bid surety requirement, one (1) bid surety instrument, written for the highestrequired amount, shall suffice.12. Submittal of Bid(s):a. For each bid it submits, the bidder shall submit eight (8) sets of its bid;i. One (1) set shall be stamped (or otherwise indicated) as being the “ORIGINAL.”;including all required documents (e.g. signed clauses, statements, forms, bonds, insurance,manufacturer’s specifications, etc.)ii. Seven (7) sets shall be stamped (or otherwise indicated) as being the “DUPLICATE”or “COPY” of the bid pages (page 9 and 10).iii. Information presented in the “ORIGINAL” set of the bid submittal shall prevail.b. Requirements for Addressing the Bid Submission Envelope:i. The bid shall be submitted in a sealed opaque envelope marked on the outside with thebidder’s name and address and the designation: “Sealed Bid – Crushed Limestone.”ii. The envelope shall be addressed to Schuyler County Legislature, 105 Ninth Street,Watkins Glen, New York 14891.c. Sealed bids are to be submitted to the Schuyler County Legislative office prior to 10:00 a.m.,Thursday, March 12, 2026 and will be publicly opened at the office of the Schuyler CountyLegislature at 10:15 a.m., Thursday, March 12, 2026.d. Facsimile, email and/or electronically transmitted bids are not acceptable and shall be rejected.e. Security procedures are in effect at the Schuyler County Office Building. Interested parties,especially respondents who intend to hand deliver bids should allow sufficient time for any delaywhich may arise because of security procedures. To be considered “delivered on time,” a bidsubmission must be received at the Legislature Office by the appointed hour.13. Late Bids:Bidders shall bear sole responsibility for the delivery of their bid in a timely manner. Reliance upon theU.S. Postal Service or other carriers is at the bidder’s risk. Late bids shall not be considered and shall bereturned unopened.page 4Crushed Limestone14. Right of County to Seek Clarification, Accept or Reject Bid(s), etc.:a. Schuyler County reserves as its right, the right to require clarification from bidders for the purposeof assuring a full understanding of the bidder’s responsiveness to the solicitation requirements.b. Schuyler County reserves as its right; the right to accept or reject any and all bids (or separableportions thereof), the right to waive irregularities and technicalities, and the right to requestresubmittal of bids (re-bid).c. Schuyler County reserves the right to purchase items or services included in this bid on State,County or other Governmental Agency contracts if such items can be obtained on the same terms,conditions, specifications and at a lower price if applicable when available.15. Award of Bid:a. Award(s) shall only be made to bids submitted by qualified, responsive, and responsible bidderswho sufficiently meet the terms, conditions, and specifications stated herein. However, under allcircumstances and all statements to the contrary notwithstanding, Schuyler County reserves as itsright, the right to determine award(s)/awardee(s) in accordance with the best interest of SchuylerCounty.b. Award of bid is not made at the bid opening. All bids are subject to final review and acceptanceby the appropriate committee(s) of the Schuyler County Legislature before any award may bemade. Receipt of bids by the County shall not be construed as authority to bind the County.c. Best Value Competitive Offer/Award (Schuyler County Resolution 24-14;Local Law No. 1 of the year 2014):Section 103 of the General Municipal Law (and as defined in State Finance Law Section 163)authorizes the use of a Best Value Award methodology for purchase contracts (includingcontracts for service work, but excluding any purchase contracts necessary for the completion ofa public works contract pursuant to Article 8 of the labor law). The County of Schuyler reservesthe right herein to award this contract on the basis of best value, as determined by the County,rather than low bid, pursuant to such factors as experience, past performance, availability,delivery capability and other relevant considerations pursuant to Local Law No. 1 of the Year2014 and other applicable authority.16. Awardee’s Failure to Comply:The awardee’s failure to perform in compliance with the bid award shall result in a withholding ofpayment. The payment shall be withheld until the awardee fulfills its responsibilities. Compliance shallbe determined by and to the satisfaction of Schuyler County. Such action would not necessarily precludefurther initiatives on the part of Schuyler County to protect and preserve its interests.17. Sufficient Inventory, Equipment, and Staff:Awardee is required to have sufficient inventory, equipment and staff available and/or have guaranteedaccess to sufficient inventory, equipment and staff to fulfill its responsibility as a result of receiving thebid award.Failure of the awardee to fulfill its responsibility shall be sufficient cause for and entitle SchuylerCounty to:a. Damagesand/orb. Purchase the contracted product(s)/service(s) on the open market; with any increase in cost(s) toSchuyler County being charged to the awardee. Credit shall not be issued to the awardee whereopen market cost(s) to the County are less than the cost(s) contracted with the awardee.page 5
