A bid guarantee from each bidder equivalent to five percent of the bid price. The "bidguarantee" shall consist of a firm commitment such as bid bond, certified check, or othernegotiable instrument accompanying a bid as assurance that the bidder will, upon acceptanceof his bid, execute such contractual documents as may be required within the time specified.2. A performance bond on the part of the contractor for 100 percent of the contract price. A"performance bond" is one executed in connection with a contract to secure fulfillment of allof the contractor's obligations under such contract.3. A payment bond on the part of the contractor for 100 percent of the contract price. A "paymentbond" is one executed in connection with a contract to assure payment as required by law ofall persons supplying labor and material in execution of the work provided for in the contract.INSURANCEThe Contractor shall purchase and maintain such insurance as will protect it from claims set forthbelow which may arise out of or result from the CONTRACTOR'S execution of the WORK,whether such execution be done by the CONTRACTOR and SUBCONTRACTOR, or by anyonedirectly or indirectly employed by any of them, or by anyone for whose acts any of them may beliable:Claims under worker's compensation, disability benefit and other similar employee benefitacts;Claims for damages because of bodily injury, occupational sickness or disease, or death ofemployees;Claims for damages because of bodily injury, sickness or disease, or death of any personother than employees;Claims for damages insured by usual personal injury liability coverage which are sustained(1) by any person as a result of an offense directly or indirectly related to the employment of suchperson by the CONTRACTOR, or (2) by any other person; andClaims for damages because of injury to or destruction of tangible property, including lossof use resulting therefrom.Certificates of insurance acceptable to the Owner shall be filed with the Owner prior tocommencement of the Work. These certificates shall contain a provision that coverage's affordedunder the policies will not be canceled unless at least fifteen (15) days prior WRITTEN NOTICEhas been given to the OWNERThe CONTRACTOR shall procure and maintain, at the CONTRACTOR'S own expense,during the CONTRACT TIME, liability insurance as hereinafter specified:CONTRACTOR'S General Public Liability and Property Damage Insurance includingvehicle coverage issued to the CONTRACTOR and protecting the CONTRACTOR fromall claims for personal injury, including death, and all claims for destruction of or damageto property, arising out of or in connection with any operations under the CONTRACTDOCUMENTS, whether such operation be by the CONTRACTOR or by anySUBCONTRACTOR employed by the CONTRACTOR or anyone directly or indirectlyemployed by the CONTRACTOR or by a SUBCONTRACTOR employed by theCONTRACTOR. Insurance shall be written with a limit of liability of not less than$1,000,000.00 aggregate for any such damage sustained by two or more persons in any oneaccident. Insurance shall be written with a limit of liability of not less than $500,000.00 forall property damage sustained by any one person in any one accident; and a limit of liabilityof not less than $200,000.00 aggregate for any such damage sustained by two or morepersons in any one accident.The CONTRACTOR shall procure and maintain, at the CONTRACTOR'S own expense,during the CONTRACT TIME in accordance with the provisions of the laws of the Statein which the work if performed, Worker's Compensation Insurance, including occupationaldisease provision, for all of the CONTRACTOR'S employees at the site of the project andin case any WORK is sublet, the CONTRACTOR shall require suchSUBCONTRACTOR similarly to provide Worker's Compensation Insurance, includingoccupational disease provisions for all the latter's employees unless such employees arecovered by the protection afforded by the CONTRACTOR. In any case of the employeesengaged in hazardous work under this contract at the site of the PROJECT is not protectedunder Worker's Compensation Statute, the CONTRACTOR shall provide, and shall causeeach SUBCONTRACTOR to provide, adequate and suitable insurance for the protectionof its employees not otherwise protected.The CONTRACTOR shall secure, If applicable "All Risk" type Builder's Risk Insurancefor WORK to be performed. Unless specifically authorized by the OWNER, the amountof such insurance shall not be less than the CONTRACT PRICE totaled in the BID. Thepolicy shall not be less than the losses due to fire, explosion, hail, lighting, vandalism,malicious mischief, wind, collapse, riot, aircraft, and smoke during the CONTRACTTIME, and until the WORK is accepted by the OWNER. The policy shall name as theinsured the CONTRACTOR, and the OWNER.INFORMATION FOR BIDDERS1. The City of Jacksonville (herein called “Owner”) invites bids on the form attached hereto,all blanks of which must be appropriately filled in. The Owner will receive bids at theOffice of the Finance Director, #1 Municipal Drive, Jacksonville, AR until 10:00 amCentral Standard Time on April 28, 2026 and then at said office, publicly opened andread aloud. The envelopes containing bids must be sealed addressed to the City ofJacksonville, Finance Director, #1 Municipal Drive, Jacksonville, AR and designated asbid for 2026 Asphalt Overlay Program. The owner may consider informal any bid notprepared and submitted in accordance with the provisions hereof and may waive anyinformalities or reject any and all bids. Any bid may be withdrawn prior to the abovescheduled time for the opening of bids or authorized postponement thereof. Any bidreceived after the time and date specified shall not be considered. No Bidder may withdrawa bid within thirty (30) days after the actual date of the opening thereof.2. PREPARATION OF BIDAll blank spaces for bid prices must be filled in, in ink or typewritten, in both words andfigures. Each bid must be submitted in a sealed envelope bearing on the outside the nameof Bidder, his address, and the name of the project for which the bid is submitted. Ifforwarded by mail, the sealed envelope containing the bid must be enclosed in anotherenvelope addressed as specified in the bid form.3. SUBCONTRACTSThe Bidder is specifically advised that any person, firm, or other party to whom it isproposed to award a subcontract under this contract must have certified eligibility in writtencontracts containing Federal Labor Standards Provision. Although the Bidder is notrequired to attach such certifications by proposed subcontractors to his bid, the Bidder isadvised of this requirement so that appropriate action can be taken to prevent subsequentdelay in subcontract awards.4. TELEGRAPHIC MODIFICATIONAny Bidder may modify his bid by telegraphic communication at any time prior to thescheduled closing time for receipt of bids, provided such telegraphic communication isreceived by the Owner prior to the closing time, and provided further, the Owner is satisfiedthat a written confirmation of the telegraphic modification over the signature of the Bidderwas mailed prior to the closing time. The telegraphic communication should not reveal thebid price but should provide the addition or subtraction or other modification so that theOwner will not know the final prices or term until the sealed bid is opened. If writtenconfirmation is not received within two (2) days from closing time, no consideration willbe given to the telegraphic modification.5. METHOD OF BIDDINGThe Owner invites the following bid (s):2026 Asphalt Overlay Program6. QUALIFICATION OF BIDDERThe Owner may make such investigations as he deems necessary to determine the abilityof the Bidder to perform the work, and the Bidder shall furnish to the Owner all suchinformation and data for this purpose as the Owner may request. The Owner reserves theright to reject any bid if the evidence submitted by, or investigation of, such Bidder fails tosatisfy the Owner that such Bidder is properly qualified to carry out the obligations of thecontract and to complete the work contemplated therein. Conditional bids will not beaccepted.7. BID SECURITYEach bid must be accompanied by cash, certified check of the Bidder or a Bid Bondprepared on the form of Bid Bond attached hereto, duly executed by the Bidder as principleand having as surety thereon a surety company approved by the Owner, in the amount offive (5) percent of the bid. Such cash, checks or Bid Bonds will be returned to all exceptthe three lowest Bidders within three (3) days after the opening of bids, and the remainingcash, checks, Bid Bonds will be returned promptly after the Owner and the accepted Bidderhave executed the contract, or, if no award has been made within 30 days after the date ofthe opening of the bids, upon demand of the Bidder at any time thereafter, so long as hehas not been notified of the acceptance of his bid.8. LIQUIDATED DAMAGES FOR FAILURE TO ENTER INTO CONTRACTThe successful Bidder, upon his failure or refusal to execute and deliver the contract andbonds required within then (10) days after he has received notice of the acceptance of hisbid, shall forfeit to the Owner, as liquidated damages for such failure or refusal, the securitydeposited with his bid.9. TIME OF COMPLETION AND LIQUIDATION DAMAGESBidder must agree to commence work on or before a date to be specified in a written“Notice to Proceed” of the Owner and to fully complete the project within 30 consecutivecalendar days thereafter. Bidder must agree also to pay as liquidated damages, the sum of$250.00 for each consecutive calendar day thereafter.10. CONDITIONS OF WORKEach Bidder must inform himself fully of the conditions relating to the construction of theproject and the employment of labor thereon. Failure to do so will not relieve a successfulBidder of his obligations to furnish all material and labor necessary to carry out theprovisions of his contract. In so far as possible, the Contractor in carrying out his workmust employ such methods or means as will not cause any interruption of or interferencewith the work of any other Contractor.11. ADDENDA AND INTERPRETATIONSNo interpretations of the meaning of the Plans, Specifications or other Pre-bid Documentswill be made to any Bidder orally.
