For further information, please contactplease contact Rusty Catlin or e-mail at rcatlin@montrosecounty.net.Bidder InstructionsSubmitted bids must be enclosed in a sealed opaque envelope marked “2026 Hot mixAsphalt (Material only)” with the name of the bidder and delivered to Montrose CountyPublic Works, Attn: Brandon Wallace, 63160 LaSalle Rd, Montrose, CO 81401, no laterthan 2 p.m. local time, April 7, 2026. The bids will be opened immediately thereafterand read aloud. Bids received after the time due will not be considered and will bereturned to the bidder un-opened.A 5% bid security is required with the bid as outlined in C.R.S. 24-105-201. The bidsecurity shall be placed in a separate envelop marked “Bid Security” that is eitherattached to the outside of the bid envelope or placed in a larger envelope that containsboth the sealed bid envelope and the bid security envelope. Bids not including a bidsecurity will not be considered and will be returned to the bidder un-opened.Bids are to be submitted on the Bid Forms included within the bid package. Bidder mustprovide the Unit Bid Price, Item Total Bid Price and Total Bid Price on the Bid ScheduleForm. In case of discrepancy on the Bid Schedule Form, the Unit Bid Price governs.Any bid questions must be received by 2 pm local time, March 31, 2026.Any modifications to the Invitation to Bid package will be an Addendum and posted tothe County website and distributed to all known bidders by 5 pm, April 2, 2026. It is theresponsibility of the bidder to verify if an addendum has been issued. Bidder shall2acknowledge Addenda in the Bid and Addenda Acknowledgment section of the BidForm.General ConditionsAll bids shall be irrevocable for 45 days from the date of the bid opening.The successful bidding Contractor will be required to enter into an agreement withMontrose County. A sample agreement is included in this bid package, but the finalagreement may be altered and/or contain additional or different provisions.A payment and performance bond equal to 100% of the bid amount will be required asoutlined in C.R.S. 38-26-106 and the contract agreement for the successful bidder.Contractor shall carry insurance coverage as outlined in the contract agreement.Payment to Contractor will be made upon submission and approval of invoice(s).Payment will follow normal County payment processing cycles for issuance of checks.Awarding of BidAward will be made to a responsive, responsible bidder meeting applicable county andstate procurement requirements. In reviewing the bids received, the County reservesthe right to reject, for any reason whatsoever, any and all bids, and to waive anyinformality or irregularity in a bid. The County reserves the right to accept the bid thatprovides the best value to the County in the County’s sole discretion. The Countyreserves the right to make a determination in the County’s sole discretion as to thesufficiency of qualifications of any bidder. The action to award a contract is subject toapproval by the Board of County Commissioners. The submission of a bid does not inany way commit the County to enter into an agreement or contract with that bidder.Bidder must identify for non-disclosure purposes, any information contained within theproposal that is proprietary in nature or protected by copyright, trademark, or otherintellectual property law. Montrose County will maintain confidentiality of such materialsto the extent permitted by law, the County is subject to the provisions of the Colorado3Open Records Act (CORA), C.R.S. 24-72-201, et seq., and cannot therefor guaranteethat any materials provided will not be produced in response to a CORA request.In addition to the physical proposal package, all documents are to be submitted digitallyby email, preferably in accessible format (Word or accessible PDF), to Rusty Catlin bye-mail at rcatlin@montrosecounty.net. Digital submissions are not official submissionsfor purposes of compliance with timing requirements.It is anticipated that award of the contract will be made within two (2) weeks of the bidopening. All bidders will be notified of the Commissioners’ decision. Within two weeksof award, any required submittals will be due. A purchase order will be used forauthorization to proceed.Requirements of Successful Bidder A payment and performance bond equal to 100% of the bid amount will berequired as outlined in C.R.S. § 38-26-106 and the contract agreement. Furnish certificates of required insurance coverage. Furnish a completed Form W-9 “Request for Taxpayer Identification Number andCertification”. Enter into a contract agreement with Montrose County. Furnish an Equal Employment Opportunity Certification letter.4Additional Terms and Scope of Services1. Contractor shall meet the specifications as shown on Attachment “A” – 2026Hot Mix Asphalt Specifications.2. Montrose County Standards for Roads and Bridges can be downloaded from thefollowing link: http://www.montrosecounty.net/DocumentCenter/Home/View/8863. Delivery shall be into Montrose County haul trucks, FOB producer’s batch plant,which shall be located within a 15-mile haul distance from the intersection ofMain Street and Townsend Avenue in Montrose, Colorado.4. The County, at its discretion, may take samples of the HMA to verify compliancewith material specifications. If the test results fail to meet the minimumspecifications, Montrose County will have the option to seek remedy or terminatethe contract.5. Pricing shall be guaranteed through October 30, 2026.6. County will place orders at least 3 working days prior to needing the material. Allorders will be for at least 100 tons of material or be coordinated during days withorders from other customers of the Contractor.7. The Contractor shall make reasonable accommodations to meet the County’sdaily order for HMA. If the County’s daily order cannot be met, the Contractorshall notify the County one day in advance and the County may purchase HMAelsewhere at the County’s own discretion to meet project needs.8. The hot mix bid quantity is estimated. There is no guarantee that the County willpurchase the bid quantity.9. Anticipated hot mix asphalt quantities may be exceeded if the County has need,and has appropriated additional money to pay for the additional hot mix asphalt.10. This bid for HMA is for materials the County will use in the Montrose area only5
