NOTICE TO BIDDERSPUBLIC NOTICE IS HEREBY GIVEN that sealed bids will be received by the Borough ofCollingswood for the Comly Avenue Water Treatment Plant Upgrades in the Borough of Collingswood,Camden County, New Jersey.In general, this project consists of improvements to the Comly Avenue Water Treatment Plant (WTP) forthe Borough of Collingswood located in Camden County, New Jersey.This project is funded in part by the New Jersey Environmental Infrastructure Trust Program and thesuccessful Bidder must comply with all the provisions of N.J.A.C. 7:22-9.1 et seq. for the participation ofsmall business enterprises owned and controlled by socially and economically disadvantaged individuals(SED).This contract or subcontract is expected to be funded in part with funds from the New Jersey Departmentof Environmental Protection and the New Jersey Environmental Infrastructure Trust. Neither the State ofNew Jersey, the New Jersey Environmental Infrastructure Trust nor any of their departments, agencies, oremployees is, or will be a party to this contract or subcontract or any lower tier contractor orsubcontractor. This contract is subject to the provisions of N.J.A.C. 7:22-3, 4, 5, 9 and 10. In accordancewith the provisions of N.J.S.A. 58:11B-26, N.J.A.C. 7:22-3.17(a) 24 and 4.17(a) 24, the contractor(subcontractor) shall comply with all the provisions of N.J.A.C. 7:22-9.Bid forms, contracts and specifications are available by contacting Remington & Vernick EngineersContact shall be made by phone or by email to make bid purchase arrangements at 856-795-9595 or bysubmitting RVEbidinterest@rve.com.Said Bids will be received at Collingswood Borough Hall Municipal Clerk’s office, located at678 Haddon Avenue, Collingswood, Camden County, New Jersey, 08108, on Tuesday, January 27, 2026,at 10:30 AM prevailing time and then opened and read aloud in public at the Collingswood SeniorCommunity Center Conference Room, 30 West Collings Avenue, Collingswood, Camden County, NewJersey 08108.Electronic download link for copies of the bid forms, contracts and specifications may be obtained fromsaid Remington and Vernick Engineers, by prospective bidders upon request, upon payment of the sum of$50.00 for each set. Should interested bidders not have the ability to handle electronic download sets, aset may be arranged to be sent overnight by calling 856 795 9595.NO BIDS ARE TO BE PICKED UP AT THE ENGINEER’S OFFICE OR AT THE MUNICIPALITYOFFICES.PAYMENT MUST BE RECEIVED PRIOR TO OBTAINING SAID SPECIFICATIONS.NO BIDS ARE TO BE DROPPED OFF AT THE ENGINEER’S OFFICE.The Borough of Collingswood reserves the right to consider the bids for sixty (60) days after the receiptthereof, and further reserves the right to reject any or all bids, either in whole or in part and also to waiveany informality in any and make such awards or take action as may be in the best interest of the Boroughof Collingswood, in accordance with applicable law. N.J.A.C. 7:22-9.7- In no case shall the advertisementfor bids to be published less than 30 days prior to the date fixed for receiving bids on the purchase orcontract.Bids must be on the bid form prepared by Remington and Vernick Engineers, in the manner designatedtherein and required by the specifications, must be enclosed in sealed envelopes bearing the name andaddress of the bidder on the outside and also bearing on the outside reference to the particular work bidupon. Said bids shall be addressed to Cassandra Duffey, Administrator, Borough of Collingswood, 678Haddon Avenue, Collingswood, New Jersey 08108-3704.Each bid shall be accompanied by a certified check, cashier’s check or bid bond duly executed by thebidder as principal and having as surety thereon a surety company listed on the Federal Treasury List(Environmental Protection Department Circular 570 Surety Companies Acceptable on Federal Bonds) asrequired by N.J.A.C.7:22-3.17(g) and approved by the Borough of Collingswood in an amount not lessthan ten percent (10%) but in no case in excess of $20,000.00 of the amount bid. Any such bid bond shallbe without endorsement or conditions. Bid shall also be accompanied by a certificate letter from a suretycompany stating that it will provide the bidder with the completion bond.N.J.A.C. 7.22-3.17(a)24, 4.17(a)24, 6.17(a)24 and 7:22A-2.4(a) provide that a goal of not less than 10percent be established for the award of contracts to small business concerns owned and controlled by oneor more socially and economically disadvantaged individuals. The goal of 10 percent applies to the totalamount of all contracts for building, materials and equipment, or services (including planning, design andbuilding related activities) for a construction project. The project sponsor has identified that the SEDutilization goal for this project is 10 PERCENT.In accordance with N.J.A.C. 7:22-9.10 the lowest bid resulting in a payment of unreasonable price.Bidders and the office shall be notified of the rejection of all bids, the reasons for the rejection, and thecontracting agency’s intent to solicit bids for a second time.The award of the contract shall be made subject to the necessary moneys to do the work being providedby the Borough of Collingswood in a lawful manner. The contract to be executed by the successfulbidder will provide that it shall not become effective until the necessary moneys to do the work have beenprovided by the Borough of Collingswood in a lawful manner. The award shall further be subjected tothe securing of necessary State, Federal or Local permits governing the work.Awards will be made only to socially and economically disadvantaged business concerns that are certifiedby the New Jersey Commerce, Economic Growth and Tourism Commission, the New Jersey Departmentof Transportation, the Port Authority of New York and New Jersey, New Jersey Transit or other agenciesdeemed appropriate by the Office as eligible minority businesses or female businesses. The invitation tobid is on an unrestricted basis whereby the successful bidder must fulfill the SED utilizationrequirements.Bidders are required to comply with the requirements of N.J.S.A. 10:5-31 et seq., N.J.A.C. 17:27(Affirmative Action), N.J.S.A. 34:11-56.25 et seq.(New Jersey Prevailing Wage Act), and Americanswith Disabilities Act of 1990 (42 U.S.C. S12101, et seq.).The contractor (subcontractor) is further notified that they must comply with N.J.S.A. 52:25-24.2, andsubmit a Disclosure Statement listing stockholders with his/her bid.The contractor is further notified that they must comply with N.J.S.A. 34:11-56.48 et seq. Public WorksContractor Registration Act and they and any subcontractors must be registered in accordance with theact.The contractor is also further notified that they must comply with N.J.S.A. 52:32-44 and submit proof ofbusiness registration and submit proof of business registration for any named subcontractors inaccordance with the act.This Notice shall appear in the Newspaper not less than ten (10) working days before the bid opening; andnotice of revisions or addenda to advertisements or bid documents will be as outlined in N.J.S.A. 40A:11-23.For all contracts the date fixed for receiving the bids shall not fall on Monday, or any other day directlyfollowing a State or Federal Holiday as outlined in N.J.S.A. 40A:11-23A.By Order of the Mayor & CommissionersBorough of CollingswoodCamden County, New JerseyDated: November 24, 2025
