The purpose of this solicitation is to establish
Respondents to this RFP must have
continuing contracts for Construction Management at Risk (CMAR) for General
Construction Services Projects (this "Solicitation"). Work will be
assigned to selected CMARs through individual Task Orders, as may be negotiated
and assigned, and which may include new construction, renovation, renewal,
replacement, building maintenance, equipment installation, utility work and
other miscellaneous projects and the Estimated Construction Costs for each
individual project in a continuing contract as defined in 255.103(4), Florida
Statutes, as amended from time to time.
proven expertise and extensive experience in the CMAR execution process related
to water, wastewater, and reclaimed water infrastructure including, but not
limited to, construction management of pumping stations, water treatment
facilities, and wastewater treatment facilities and improvements.
Self-performing and emergency projects may be requested by JEA. The selected
continuing CMAR firms under this RFP will cover a period of 5 years from the
date of execution of the underlying Contract.
JEA will issue Task Orders on an
as-needed basis for individual projects throughout the contract term. Each Task
Order will define the specific project scope, budget, schedule, and
deliverables. CMARs may be assigned Task Orders based on project type, complexity,
availability, past performance, and JEA's assessment of best fit foreach
project. There is no guarantee of a minimum or maximum number of Task Orders or

In June 1997, JEA also assumed operation of the water and sewer system previouslymanaged by the city. JEA is located in Jacksonville, Florida, where we proudly serve an estimated522,469 electric, 396,566 water and 316,441 sewer and 26,902 reuse water customers. JEA isFlorida's largest community owned utility and the eighth largest municipal in the United States.1.4) Invitation - Submitting a ResponseRespondents that meet the Minimum Qualification stated herein are invited to submit a Response tothis Solicitation to perform the Work. A complete copy of this Solicitation, the TechnicalSpecifications, forms and all other documents referenced in this Solicitation are on JEA’s E-Procurement and Contract Management Portal which is provided by Zycus Supplier Network whichcan be accessed at https://zsn.zycus.com/guest/genericRegister/JEA074. Instructions on how to loginto Zycus is provided below in this Solicitation.All Responses are due at the time indicated on the title page of this Solicitation. Section 1 of thisSolicitation are the instructions for submitting a Response for this Solicitation. Section 2 of thisSolicitation contain the definitions and commercial contract terms associated with this procurement.A Contract will be presented to the Respondent awarded this Work and the Contract will incorporateby reference this entire Solicitation and all associated Addenda.All documentation submitted with a Response must reference the Solicitation Title and Number statedherein. All Responses must be made on the appropriate forms and formats as specified by thisSolicitation and uploaded to JEA’s procurement platform.All Responses should be delivered electronically to JEA via the Zycus platform. An automated,detailed auditing system provides sealed Response integrity. Responses remain sealed on the platformuntil the Close Date & Time (Due Date & Time).A Respondent shall be solely responsible for timely delivery of its Response to the Zycus SupplierNetwork. Respondents are strongly encouraged to acquire log in credentials early as possible.Additionally, Respondents are encouraged to submit Responses early to ensure uploading processgoes smoothly. If Respondent is fnot able to submit its Response via Zycus, then please email theResponse to the JEA Buyer identified in the Section below titled "Questions".Responses are due by the time and on the date stated on the cover page of this Solicitation. LATERESPONSES MAY BE REJECTED.1.5) QuestionsAll Questions must be submitted in writing to the JEA Buyer listed herein at least five business daysprior to the opening date. Questions received within five business days prior to the opening date maynot be answered.1.6) Pre-Response MeetingThere may be a mandatory Pre-Response meeting associated with this Solicitation at the date and timelisted on the cover page of this Solicitation. All interested Respondents are invited to attend the Pre-Response meeting. Those planning to attend the Microsoft Teams or teleconference may email theirname and contact information to the JEA Buyer listed herein at least 48 hours prior to the Pre-Response meeting to facilitate roll call. A Respondent must only sign in representing one company,unless otherwise agreed to by JEA in writing.1.7) Opening of ResponsesAll Responses received shall be publicly announced and recorded via Microsoft Teams at the date andtime indicated on the cover page of this Solicitation.The details for the Microsoft Teams will be on jea.com at the following website:https://www.jea.com approximately 48 hours before the Response opening.At the opening of Responses, a JEA representative will publicly open each Response that wasreceived prior to the Date and Time, except for those Responses that have been properly withdrawn.JEA has the right to waive irregularities or informalities in the Responses to the extent allowableunder applicable laws.1.8) Type of ContractThe services under this continuing contract will be provided through individual Task Orders issued toqualified Construction Management-at-Risk (CMAR) firms. The base Contract establishes the generalterms and conditions, while each Task Order will specify the detailed scope of work, schedule, andcompensation for a specific project. The General Terms and Conditions will be finalized throughnegotiations as set forth herein. The initial scope of work for each project under the Contract shallconsist of providing the specified pre-construction phase services on a fixed-price lump sum basis ona Task Order basis. The Contract shall be amended to include construction phase services generallyrequiring the CMAR to deliver the completed project following negotiation of a mutually acceptableGuaranteed Maximum Price (GMP) and completion deadlines for the construction phase work.Task Order Issuance Process: JEA will solicit Task Order proposals from a qualified CMAR underthis continuing contract when a project is identified. The CMAR selection for each Task Order will bebased on factors including but not limited to project type and complexity, CMAR availability andcurrent workload, past performance on JEA projects, schedule requirements, and proposed feestructure.Each Task Order issued under this continuing contract shall include:• Task Order number and project identification• Detailed scope of work and project description• Project location and site conditions• Pre-construction phase deliverables and fixed-price compensation• Estimated construction budget and GMP negotiation requirements• Project schedule including key milestones• Specific insurance and bonding requirements for the Task Order• JSEB goals if applicable to the specific project• Liquidated damages provisions specific to the project• Any special conditions or requirements unique to the project• The CMAR shall not commence work on any Task Order until a fully executed Task Order isissued by JEA. Work performed prior to Task Order execution is at the CMAR's sole risk andmay not be compensated.1.9) Minimum QualificationsRespondent must meet the following Minimum Qualifications to be considered eligible to have itsResponse evaluated by JEA. Respondent must complete and submit the Minimum Qualification Formprovided in this Solicitation. Respondents that are working or have worked for JEA in the past 2 yearsinvolving similar work must submit JEA as a reference. JEA reserves the right to ask for additionalback up documentation or additional reference projects to confirm the Respondent meets therequirements stated above.JEA will reject Responses from Respondents not meeting all of the following MinimumQualifications:I. The Respondent must have successfully completed at least three (3) similar projects relatedto Water, Wastewater, and Reclaimed water infrastructure as a CMAR or Design-Builddelivery method within the last ten (10) years of the RFP due datei. A similar project is defined as:• Pump Station work (inside or outside the fence)• Water and Wastewater Treatment Plants (including mechanical, structural,electrical, and instrumentation & control work inside the fence)• Reclaimed water tanks or other infrastructureAny Respondent whose contract with JEA was terminated for default within the last two years shall haveits Response rejected.1.10) Number of Contracts to be AwardedJEA intends to Award multiple continuing CMAR contracts. JEA reserves the right to Award up tofour (4) Contracts based on qualifications, however, JEA may Award more, or fewer contracts, if JEAdetermines that it is in its best interest.Task Order Distribution: JEA will distribute Task Orders among awarded CMARs based on projectrequirements, CMAR capacity and availability, past performance, and JEA’s determination of bestvalue. JEA is under no obligation to distribute Task Orders equally among CMARs or to guaranteeany minimum or maximum number of Task orders or dollar value of work to any CMAR. CMARsmay decline Task Order requests if unable to meet project requirements or schedule, subject toContract provisions.1.11) Insurance RequirementsPrior to JEA issuing a Purchase Order to the Company to begin the Work, the Company shall submit acertificate of insurance (COI) that is in compliance with amounts and requirements as indicated in thisSolicitation. Note that the COI shall specifically indicate JEA as additional insured on all requiredinsurance except Worker's Compensation and Professional Liability (if applicable). Furthermore,waiver of subrogation must be provided for all required insurance in favor of JEA, including its boardmembers, officers, employees, agents, successors, and assigns.1.12) Liquidated Damages in ContractThe Contract issued pursuant to this Solicitation contains liquidated damages tied to projectcompletion deadlines. The Respondent should review the specific time frames and liquidated damageamounts prior to submitting its Response.1.13) Optional Use of Small and Emerging Business (JSEB) ProgramIt is at the Respondent's option as to whether it chooses to subcontract with a JSEB firm. JEAencourages the use of JSEB firms; however, the Respondent is not required to utilize a JSEB to beawarded a Contract under this Solicitation.For more information regarding the JSEB program, please contact Bill Hickey, JEA, Manager ofSupplier Diversity Programs and Procurement Services, hickwj@jea.com or jsebprogram@jea.com.1.14) Basis of Award - Highest EvaluatedJEA will Award a Contract to the responsive and responsible Respondents whose Response meets orexceeds the Minimum Qualifications set forth in this Solicitation, and whose Responses receives thehighest number of points based upon JEA’s evaluation of the Selection Criteria stated herein. JEA willnot Award this Contract on a price only basis but will Award based on an evaluation of how well eachRespondent meets the “Selection Criteria” stated herein.1.15) Evaluation Methodology for CMAR ServicesJEA shall evaluate the Respondent's qualifications, rank the qualifications from all Respondents, andnegotiate a Contract for the Work in accordance with Florida Statute, Section 287.055, known as theConsultants' Competitive Negotiation Act ("CCNA").In evaluating the qualifications, JEA will not consider price, but may consider factors including, butnot limited to, the Selection Criteria listed below. JEA may also request interviews or presentationsfrom the Responders during its selection. Interviews or presentations, if any, will be evaluated and upto twenty-five (25) points will be added to the Respondents written Response evaluation score.Responses from qualified firms will be scored and ranked by a committee of evaluators. Eachevaluator will individually score the Responses using the evaluation matrix attached to thisSolicitation. Using these scores, each evaluator will rank the Responses using "1" for the Responsereceiving the highest number of points from the matrix. Responses with an equal number of pointswill receive the same numerical ranking. JEA will total the numerical rankings for each Response andconsider the Response with the lowest total to be the most highly qualified Respondent.After approving the rankings of all the Respondents, JEA will enter into negotiations with the bestranked Respondent (s). During negotiations, JEA will consider detailed information regarding theRespondent's hourly rates, and scope of the Contract.If JEA and the Company are unable to negotiate a satisfactory Contract, JEA will formally terminatethe negotiations with the Respondent and undertake negotiations with the next ranked Respondent.
