Mondaythrough Friday, except weekends and holidays. No Bid Forms and Specifications will be available after 4:00P.M. on Thursday, April 2, 2026, this period being reserved in order to prepare data for receiving bids.Bids must be submitted on the Bid Proposal Forms provided and must be enclosed in a sealed envelopebearing on the outside the name and address of the bidder and marked "BID FOR LEASE OF BOROUGHPROPERTY FOR DOWNTON OUTDOOR DINING AREA " and addressed to Omar Stovall, BoroughClerk, Borough of Tenafly, 100 Riveredge Road, Tenafly, NJ 07670. To be considered, the Bid must beaccompanied by a Certified Check, Cashier's Check or bona fide Bid Bond made payable to the Borough ofTenafly, NJ in the minimum amount of Ten Percent (10%) of the Amount Bid. Bidders are required to complywith the requirements of N.J.S.A. 10:5-31 et seq. (P.L. 1975, c.127, as amended and supplemented from timeto time) and N.J.A.C. 17:27. No bid may be withdrawn within sixty (60) days after the scheduled time forreceipt of the bids.BIDS ARE TO BE RECEIVED NO LATER THAN 11:00 A.M. INSTRUCTIONS TO BIDDERS1. SubmissionsThe Borough of Tenafly, Bergen County, New Jersey, invites sealed bids pursuant tothe Notice to Bidders.A. Sealed bids will be received by the designated representative at the time and placestated in the Notice to Bidders, and at such time and place will be publicly openedand read aloud.B. The bid proposal form and required documentation shall be submitted, (1) in a sealedenvelope; (2) addressed to the Borough of Tenafly, Attn: Borough Clerk, 100Riveredge Road, Tenafly, New Jersey 07670; (3) bearing the name and address ofthe bidder written on the face of the envelope, and (4) clearly marked “BID FORLEASE OF BOROUGH PROPERTY FOR DOWNTON OUTDOOR DININGAREA -- DO NOT OPEN". All proposals must be returned on or before Monday,April 6, 2026 10:00 A.M., prevailing time.C. It is the bidder's responsibility to see that bids are presented to the Borough at thehour and at the place designated. Bids may be hand delivered or mailed; however,the Borough disclaims any responsibility for bids forwarded by regular or overnightmail. Bids received after the designated time and date will be returned unopened.D. Sealed bids forwarded to the Borough before the time of opening of bids may bewithdrawn upon written application of the bidder, who shall be required to produceevidence showing that the individual is or represents the principal or principals whosubmitted the bid.E. Each bid proposal form must give the full business address of the bidder and besigned by an authorized representative. Bids by partnerships must be signed in thepartnership name by one of the members of the partnership or by an authorizedrepresentative, followed by the signature and designation of the person signing. Bidsby corporations must be signed in the legal name of the corporation, followed by thename of the State in which incorporated and must contain the signature anddesignation of the president, secretary or other person authorized to bind thecorporation in the matter. When requested, satisfactory evidence of the authority ofBorough of Tenafly 2026 Downtown Outdoor Dining Area Lease BidPage 3 of 33the officer signing shall be furnished. Additionally, certain bid proposal forms mustbe notarized.2. Bid Security.Accompanying each bid shall be a bid security payment in the amount equal to ten percent(10%) of the initial year bid amount, but not in excess of $20,000. Checks shall be madepayable to Borough of Tenafly.When submitting a Bid Bond, it shall contain Power of Attorney for full amount of BidBond from a surety company authorized to do business in the State of New Jersey andacceptable to the Borough. The check or bond of the unsuccessful bidder(s) shall bereturned as prescribed by law. The check or bond of the bidder to whom the contract isawarded shall be retained until a contract is executed and the required performance bond orother security is submitted. The check or bond of the successful bidder shall be forfeited ifthe bidder fails to enter into a contract.3. Bid Documents.The bid must be returned in its entirety in order to be considered for an award. Each bidmust be accompanied by the items requested below in the form(s) attached.Failure to provide these items and the entire bid package may be cause for rejecting thisproposal.1. Proposal Form2. No oral interpretation shall be made to any bidder as to the meaning of any of thecontract documents or be effective to modify any of the provisions of thespecifications and contract documents.B. Any supplemental instructions or requirements will be in the form of a writtenAddendum which will be forwarded to all prospective bidders on record by emailnot later than five (5) working days prior to the date fixed for the opening of bids.Failure of any bidder to receive addenda shall not relieve the bidder from anyobligation under its bid.C. All Addenda issued prior to bid receipt date must also be signed and returned withthe bid.D. All Addenda issued prior to date of receipt of bids shall become part of the leasedocuments and included in bid prices.5. FAILURE TO EXECUTE A LEASE.Should the successful bidder fail to execute and deliver the Lease, as defined in Section 7,within ninety (90) days after bid award, the bidder forfeits to the Borough, as liquidateddamages, the bid security deposited with its bid. An extension of the 90-day window maybe granted by the Borough if the Borough determines, in its reasonable discretion, to do so.6. RIGHT TO REJECT BIDS.The Borough reserves the right to reject any and all bids or parts thereof and to waive anyinformality if deemed in the best interests of the Borough.7. AWARD OF BIDS.Successful bidder(s) will be awarded the right to enter into a lease with the Borough,consistent with the terms included herewith, for purposes of designing, constructing andoperating an outdoor dining area (“Lease”).8. TERMINATION.If through any cause the successful bidder shall fail to fulfill in a timely and proper mannerobligations under this contract or if the successful bidder shall violate any of therequirements of the Lease, the Borough shall thereupon have the right to terminate thisBorough of Tenafly 2026 Downtown Outdoor Dining Area Lease BidPage 5 of 33
