The time of day willremain 1:30 p.m.10. A public bid opening will take place on March 17, 2026, at 1:30p.m.11. All public bid openings hosted by CiTi are made available virtuallyvia the Zoom platform. For Sealed Bid Submissions: Bidders must supply signed hardcopies of their completed bids in a sealed envelope marked with thename of the bidder and the bid number on the front of the envelopeto the address listed in the manner specified within the BidDocuments. CiTi also strongly encourages the submission of thebid pricing (in excel format) on either a CD or flash drive alongwith the signed hard copies of all the required bid documents.Please refer to the “Instructions for the Submission of theVendor Response Sheet” for information on how to properlyfill out the forms.13. All express envelopes must be clearly marked with the words“Sealed Bid Enclosed” on the front of the outside envelope. Thisis important in assuring that the bid is delivered properly. Thesealed bid envelope must be included in the express envelope.14. For Electronic Bid Submissions: Bidders must supply a signedphotocopy of the bid forms and a completed vendor response sheet(in excel format) via BidNet Direct. Please refer to the“Instructions for the Submission of the Vendor ResponseSheet” for information on how to properly fill out the forms.15. The proposal as presented shall remain valid for a minimum periodof sixty days (60) from the date of bid opening.16. Bidder must insert the price per unit as specified and the priceextension accordingly against each item bid. In the event of adiscrepancy between the unit price and the extension, the unit pricewill govern. Prices shall be extended in decimals, not fractions.17. In order to ascertain that bid items conform to the specifications,vendors should provide CiTi with stock numbers for referenceduring the analysis process. If CiTi is unable to verify that the itembid conforms to the specifications through a catalog, website or cutsheets, CiTi reserves the right to reject that item bid.Bid Information, Instructions and Special Conditions, Page 1 of 318. The packaging of trash can liners under the subcategory “TCAN”on the Vendor Response Sheet will conform to the New York StateWeights and Measure Regulations, 1 NYCRR Part 221 datedMarch 29, 2007, and any amendments up to and includingAmending and Promulgation of Section 221.11 by theCommissioner of Agriculture and Markets of the State of NewYork on December 12, 2012.Specifically, polyethylene products will be bid and supplied inaccordance with but not limited to Section 221.13 (b) (17) of 1NYCRR Part 221. Cases should be labeled with case weight,bag dimensions, thickness and count.19. BIDDERS PLEASE NOTE: The words "Or Equivalent" shall beconsidered as added to each specification, except in instanceswhere “ONLY” or “NO SUB” is stated. CiTi reserves the right torequest samples of items where an equivalent is bid. It is theresponsibility of the bidder to notify CiTi when suchsubstitutions are incorporated. Please note any substitutions onthe bid form. Please indicate your Catalog/Vendor Item Number inthe space provided on the electronic bid form. Vendors may berequired to send catalogs to the School Districts if requested.20. If the vendor is offering a product in which the manufacturer’spackaging is not the same as the packaging requested in the bidspecifications, the bidder is required to adjust the number ofpackages needed of their product to equal the actual total individualunits requested in the specifications.21. If the vendor is offering a substitute item with the same packagingas the items specified, the vendor shall provide the substituteinformation as well as the packaging information. The bidsoftware will not recognize the vendor’s substitute offer if thepackaging information is not provided and will not evaluate thebidders pricing for that item. Failure to provide packaginginformation with a substituted item will result in the rejectionof the bid item.22. If the vendor is offering a product with a different unit of measurethan that which is indicated on the vendor response sheet, then theproduct is considered to be a substitute for data entry purposes.Therefore, the product information must be put in the last fourcolumns related to Substitute: “Substitute Desc”, “Subs UM”,“Subs Unit Cost”, and “Subs Qty”.23. The bidder shall not change or provide the bid sheets in a differentformat than the one provided. Any change in the electronic formatwill prevent the CD or travel drive from being read by the bidevaluation software and therefore will result in the rejection of thebidders’ submittal.24. The following three (3) forms are included herein and form a partof this bid proposal: 1. Bid Proposal Certifications (Non-CollusionBidding Certification and Conflict of Interest Certification). 2.Exceptions or Limitations/Acknowledgement of Terms andConditions. 3. Iran Divestment Act Certificate ofCompliance. Failure to fully execute these three (3) statements willconstitute grounds for rejection of a bid submission.B26-0401 Custodial SuppliesOswego County Board of Cooperative Educational ServicesHolly Cheeley, Bid Specialist25. The bidder shall state the discount that will be allowed in theSchool Districts for prompt payment. In the absence of such adiscount, payment will be made approximately thirty days (30)after receipt of materials and invoice.26. All bids are to be on the basis of delivery prepaid todestination.27. CiTi reserves the right to waive any informality on bids received.28. CiTi reserves the right to reject any or all bids and to re-advertise.Orders and Delivery29. Each participating School District will prepare its own individualPurchase Order for its respective share of the bid. Quantities listedon the bid are from the school districts listed as active participants.30. Products and quantities listed on the bid are from the schooldistricts listed as active participants and for the listed bid period. IfCiTi or the participating school districts’ instructional plans changedue to COVID-19 and/or a force majeure event, the actualquantities purchased might also change.31. Delivery is to be made to multiple locations in each School District.The Purchase Order shall designate the place of delivery.32. Invoices shall be presented to each School District for thequantities ordered as per the Purchase Order.33. Purchases made by the School Districts, because they aregovernmental agencies, are not subject to any sales tax.34. Delivery is to be made within 30 days ARO. Partial shipmentswill be expected if the full shipment cannot be made within 30days of a purchase order being received. Payment for a partialshipment will be made upon receipt of the invoice for the itemsdelivered.35. It is expected that any items bid with expiration dates will notexpire until after the conclusion of the bid contract. Any itemsreceived by the districts that expire before the conclusion of the bidcontract will be returned to the vendor at the vendor’s expense andwill be credited or replaced at no additional cost to the school.36. Items that are packaged for sanitary reasons, such as but not limitedto disposable gloves, feminine products and wound care should bebid as packaged by the manufacturer. Items repackaged by thevendor in loose plastic bags or other wrappings will be rejectedby the school districts as unacceptable.37. A MATERIAL SAFETY DATA SHEET must accompany each biditem delivered containing a Chemical Substance. If Material SafetyData Sheets are available on-line, please include a statement statingsuch and the on-line address. Failure to include these requisite datasheets or source for data sheets will prohibit the processing ofpayment.Bid Information, Instructions and Special Conditions, Page 2 of 338. TOXIC SUBSTANCE: The Successful Vendor must supplyinformation on any Items which contain any substance that is listedin the latest printed edition of the National Institute forOccupational Safety and Health Registry of Toxic Effects ofChemical Substance, or which has yielded positive evidence ofacute or chronic health hazards in human, animal, or otherbiological testing. Such information shall be sent with an order andshall be in conformance with New York State Law. Suchinformation shall include:a. The name or names of the toxic substance including thegeneric or chemical nameb. The trade name of the hazardous chemical and any othercommonly used name, if knownc. The level at which exposure to the substance is determined tobe hazardous, if knownd. The acute and chronic effects of exposure at hazardous levelse. The symptoms of such effectsf. The potential for flammability, explosion, and reactivity ofsuch substanceg. Appropriate emergency treatmenth. Proper conditions for safe use and exposure to such toxicsubstancei. Procedures for clean-up of leaks and spills of such toxicsubstance39. After receipt of an order, the vendor agrees to call the districtwithin three working days, concerning any out-of-stock items, ordefect in the purchase order. If a district is forced to purchase outof stock items or items not meeting specifications from anothervendor, the difference must be paid by the original vendor.40. During the scheduled delivery times, the vendor agrees to removeall damaged cases that are visible and all products that are founddamaged upon opening, or products which do not meetspecifications.41. Pertinent information:Damaged goods not removed by the vendor, as stated, will beregarded as abandoned and the district shall have the right todispose of them as its own property. This condition addresses thefollowing concerns:a. Damaged cases discovered during and after deliveryb. Products that do not meet specificationsc. Storage of such itemsd. Ownership of such items42. In any of the situations mentioned, the vendor is required to pickup damaged goods at the time of delivery and immediately issuecredit. Additionally, if the discrepancies are not noted until afterreceipt of the goods, the vendor agrees to pick up the items on thenext delivery. In either event, if the vendor does not adhere to theseterms, the district gains title to the property and needs only tomaintain a record of the delivery date and the item codes to beentitled to credit.B26-0401 Custodial SuppliesOswego County Board of Cooperative Educational ServicesHolly Cheeley, Bid SpecialistForce Majeure43. The successful bidder shall not be held responsible for any lossesresulting if the fulfillment of the terms of the contract shall bedelayed or prevented by wars, acts of public enemies, strikes, fires,acts of God, or for any other acts not within control of thesuccessful bidder and which by the exercise of reasonable diligencehe/she is unable to prevent.44. Products and quantities listed on the bid are CiTi’s best estimatebased on the projected instructional plan for CiTi and participatingschool districts. If CiTi or the participating school districts’instructional plans change due to unforeseen and/or a forcemajeure event, the actual quantities purchased might also change.Award45. Notice of Award shall be made to the successful bidder within sixtydays (60) from the date of bid opening. The award for this bid willtake place at the May 13, 2026, CiTi Board Meeting.46. The bid award will be in a line-by-line manner or by subcategorymethod.47. Vendors may not be considered for an award if there are not asubstantial amount of items or value of items to be awarded to thevendor and/or where an award of these items would result in theordering members processing purchase orders amounting to $25.00or less, or where the minimum ordering amount cannot be met.48. The CiTi/School District and the vendor will submit all complaintsin writing to the appropriate party(s) within four (4) days ofoccurrence of any incident. The Bid Coordinator will maintain afile of all complaints that are submitted from both the CiTi/SchoolDistrict and the vendor.49. This will be an annual bid. The bid period will be from 06-01-2026 to 05-31-2027.Term of Contract50. Any contract resulting from the award of this bid shall be for a termof twelve (12) months from the date of the award. CiTi reserves theright to renew all or any part of this contract for up to a maximumof two additional, (12) twelve-month periods but not less than (1)one-month if agreeable by awardee(s) and by resolution by the CiTiBoard of Directors.51. Failure to adhere to these instructions will constitute groundsfor rejection of the bid.Bid Information, Instructions and Special Conditions, Page 3 of 3Center for Instruction,Technology & InnovationA Board of Cooperative Educational Services179 County Route 64Mexico, NY 13114GENERAL CONDITIONS(For the Purchase of Materials, Supplies,Equipment, and Services)All invitations to bid issued by the abovenamed Board of Cooperative EducationalServices will bind bidders and successfulbidders to the conditions and requirementsset forth in these general conditions, andsuch conditions shall form an integral partof each purchase contract awarded by theCenter for Instruction, Technology &Innovation (CiTi).DEFINITIONS“CiTi” Shall be the legal designation of theOswego County Board of CooperativeEducational Services/ Center for Instruction,Technology & Innovation.“School District” Shall be the legaldesignation of the district.“Notice to Bidders” A formal statement,which, when issued by CiTi, constitutes aninvitation to bid on the materials, suppliesand equipment described by thespecifications“Board” The Board of CooperativeEducation Services Board of Education.“Bid” An offer to furnish materials,supplies, and/or equipment in accordancewith the invitation to bid, the generalconditions, special instructions, and thespecifications.“Bid Offer” The form on which thevendor/bidder submits his bid.“Bidder” A company, corporation orindividual submitting a bid.“Contract” A notice to the successfulbidder by the issuance of a purchase order,all documents relating to the transaction,including but not limited to, the bid offer ofthe successful bidder, notice to bidders,general information, general conditions,specifications, notice of award, bid proposalcertifications; a formal document signed bythe successful bidder and CiTirepresentative.“Successful Bidder” Any bidder to whoman award is made by CiTi.“Contractor” Any bidder to whom acontract award is made by the Board ofCooperative Education Services.“Specifications” defined as the descriptionof materials, supplies, equipment, and/orservices, including the conditions for itspurchase.BIDS1. The date, time, and place of bid openingwill be given in the Notice to Bidders.2. All bids must be submitted on bid forms,if provided, and in accordance withinstructions provided.3. All bids received after the time stated inthe Notice to Bidders may not be consideredand will be returned unopened to the bidder.The bidder assumes the risk of any delay inthe mail or in the handling of the mail byemployees of CiTi. Whether sent by mail orby means of personal delivery, the bidderassumes responsibility for having his/herbid deposited on time at the place specified.4. All information required by Notice toBidders, General Conditions, Specifications,and Bid Offer, in connection with each itemagainst which a bid is submitted, must begiven to constitute a regular bid.5. The Non-Collusive Bidding Certificationmust be included with each bid as requiredby General Municipal Law, Section 103-d.6. The submission of a bid will be construedto mean that the bidder is fully informed asto the extent and character of the supplies,materials, or equipment required and arepresentation that the bidder can furnishthe supplies, materials, or equipmentsatisfactorily in complete compliance withthe specifications.7. No alteration, erasure, or addition is to bemade in the typewritten, printed, orelectronic matter. Deviations from thespecifications must be set forth in spaceprovided in bid for this purpose.8. Prices and information required should betypewritten for legibility. Illegible or vaguebids may be rejected. All signatures must bewritten. Facsimile, printed, or typewrittensignatures are not acceptable.9. Sales to school districts are not affectedby any fair-trade agreements. (GeneralBusiness Law, Sec. 369-a, Sub. 3)10. No charge will be allowed for Federal,State or municipal sales and excise taxessince the school districts and CiTi areexempt from such taxes. The price bid shallbe net and shall not include the amount ofany such tax.11. In all specifications, the words “orequal” are understood after each articlegiving manufacturer’s name or catalogreference, or on any patented article. Thedecision of the school district as to whetheran alternate or substitution is in fact “equal”shall be final. If bidding on items other thanthose specified, bidder must provide inevery instance the trade designation of thearticle, manufacturer’s name, and detailedspecifications of item he proposes tofurnish. Otherwise, bid will be construed assubmitted on the identical item as specified.12. Bids on equipment must be on standardnew equipment, of latest model, and incurrent production, unless otherwisespecified.13. All regularly manufactured stockelectrical items must bear the label of theUnderwriters’ Laboratories, Inc.14. When bids are requested on a lump sumbasis, bidder must bid on each item in thelump sum group. A bidder desiring to bid“no charge” on an item in a group must soindicate; otherwise, bid for the group maybe rejected.15. All prices quoted must be “per unit” asspecified; e.g., do not quote “per case”when “per dozen” is requested; otherwisebid may be rejected.16. Bidder must insert the price per unit andthe extensions against each item in his bid.In the event of a discrepancy between theunit price and the extension, the unit pricewill govern. Prices shall be extended indecimals, not fractions. In the case ofelectronic filing via CD, diskette or traveldrive of a bid response form, the electronicdata will take precedence over any writtenor printed material submitted with the bidpacket.17. Prices shall be net; includingtransportation and delivery charges fullyprepaid by the successful bidder todestination indicated in the instructions tobidders. If award is made on any otherbasis, transportation charges must beprepaid by the successful bidder and addedto the invoice as a separate item.
