Scope of Services
The Special Magistrate shall be appointed by the City of Kissimmee City Commissioners (the “Board”)

and shall serve at the pleasure of the Board. The Board may appoint up to three (3) Magistrates to

serve on a rotating basis, in the case of legal conflict of interest or in the absence of a Special

Magistrate.
1.) The Special Magistrate shall provide professional services for the City as needed and in

accordance with the provisions of Chapter 162, Florida Statutes, Chapter 53, City of Kissimmee City

Code, Rules and Procedures for the Code Enforcement Special Magistrate.
2.) The Special Magistrate shall be an attorney who is admitted to the Florida Bar and possesses

experience and a working knowledge of code enforcement, zoning and land use law, building and fire

code regulations, administrative law and the law of evidence.
3.) The Special Magistrate has jurisdiction to hear violations of all codes and ordinances of

City of Kissimmee with respect to non-residential properties or uses and cases involving

residential properties as assigned. The Special Magistrate shall have the same status, powers and

duties as Code Enforcement Board pursuant to Chapter 162, Florida Statutes, as amended.
4.) Special Magistrate hearings will be held at City Hall, which is 101 Church Street, Kissimmee

Florida 34741.
5.) The anticipated hours should not exceed ten (10) to twelve (12) hours per month.
6.) The Special Magistrate shall not serve in more than one office in violation of Article II, section 5(a) of the Florida Constitution.
