NOTICE TO BIDDERSSealed bid proposals endorsed "Proposal Phase 1 Sidewalk Improvements, TAP-9901 (859)", addressed tothe City of Battlefield, Missouri, 5434 S. Tower Dr, Missouri 65619, will be received by the City ofBattlefield until 11:00 a.m., Prevailing Local Time, on Wednesday, May 27, 2026, at Battlefield CityHall, 5434 S. Tower Dr. in Battlefield, Missouri and at that time will be publicly opened and read aloud.The proposed work generally includes the following:Construction of 8’ and 5’ wide concrete sidewalk, access connections, culverts, and any incidental workrelated thereto, in accordance with the plans and specifications. The project has two locations. The 8’-widesection is generally located on right-of-way between Battlefield City Park and Cloverdale Ln, and the 5’-wide section is generally located on the north side of 4th St. between Cloverdale Ln. and South WesternAve. in the City of Battlefield, Greene County, Missouri. The total length of improvements is approximately3,495 feet of sidewalk.Plans and specifications may be obtained at the offices of OWN, Inc, formerly Anderson Engineering, 3213South West Bypass, Springfield, Missouri, upon payment of a submission of a non-refundable deposit of$50.00 for each set. Additional shipping and handling expenses are applicable and the responsibility of thebidder. Checks for plans, specifications and shipping are to be made payable to OWN, Inc. Digital plansand contract documents may be obtained at no cost from the Engineer by contactinggcoggin@weareown.com or calling (417) 866-2741All labor used in the construction of this public improvement shall be paid a wage no less than the prevailinghourly rate of wages of work of a similar character in this locality as established by the Department ofLabor and Industrial Relations (Federal Wage Rate), or state wage rate, whichever is higher.The City of Battlefield hereby notifies all bidders that it will affirmatively ensure that in any contract enteredinto pursuant to this advertisement, businesses owned and controlled by socially and economicallydisadvantaged individuals will be afforded full opportunity to submit bids in response to this invitation andwill not be discriminated against on the grounds of race, color, religion, creed, sex, age, ancestry, or nationalorigin in consideration for an award. The bidder will ensure that Disadvantaged Business Enterprises willhave the opportunity to participate in the performance of this contract and or any subcontracts. Goals forthe amount of work to be awarded to DBE's will be 0%.All bidders must be on MoDOT’s Qualified Contractor List per Section 102.2 of the Missouri StandardSpecifications for Highway Construction, latest edition, including all revisions. The contractorquestionnaire must be on file seven (7) days prior to bid opening. Bidders are informed that all contractorsare subject to full compliance with all applicable laws, ordinances, rules and regulations, and therequirements of the Equal Opportunity Act and it is not the intent of the owner to arbitrarily dismiss anyauthorities.Each bidder shall file with his bid a bidder's bond in the amount of 5 percent of the contract price asindicated per the contract documents. The bidder to whom a contract is awarded will be required to furnisha performance bond and a payment bond on the forms provided, payable to the City of Battlefield, and inthe amount of 100 percent of the contract price in conformity with the requirements of the GeneralConditions.Proposals must be on forms provided and all unit price bids, extensions and totals provided thereon shallbe completed fully. The Contract, if awarded, will be awarded to the lowest, responsive, responsible biddercomplying with the Conditions of the Contract Documents and within the Owner's budget. The Bidder towhom the awards are made will be notified at the earliest possible date. The City of Battlefield, however,reserves the right to reject any and all Bids and to waive any informality in Bids received whenever suchrejection or waiver is in his interest.No bidder may withdraw his bid within 60 days after the actual date of the opening thereof.Contractors and subcontractors who sign a contract to work on public works projects must provide proofof participation in a 10-hour OSHA construction safety program, or similar program approved by theDepartment of Labor and Industrial Relations, to be completed by their on-site employees within sixty (60)days of beginning work on the construction project.No 2nd tier bidding will be allowed on this project.MAYOR AND BOARD OF ALDERMEN, CITY OF BATTLEFIELD, MISSOURI
