The City of Newton, Iowa is seeking competitive quotations for the public improvement hereafter described. Contractors qualified to perform the work are invited to submit competitive quotations, pursuant to the requirements of Section 26.14 of the Iowa Code.

Contractors qualified to perform the work are invited to submit competitive quotations,pursuant to the requirements of Section 26.14 of the Iowa Code.1. Description of the Public Improvement Work to be Performed Pursuant to ThisSolicitation.The public improvement work for which the city is seeking competitive quotations is generallydescribed as follows:Traffic Signal Equipment InstallLocations:- 1st Avenue & W 3rd Street- 1st Avenue & W 4th StreetAt 1st Ave & W 3rd St:- Cabinet Assembly: P44 TS2-1 with 16-position backplane and ATC rack- (1) ATCeX2 Controller- (1) EDI Monitor Unit- (1) Clary Battery Backup with 41 Ahr Batteries- (2) Bus Interface Units (BIUs)- (1) Power Supply & Accessories- NoTraffic Video/Radar Detection System: (1) Control Unit, (4) Sensors, Antenna,Mounts, and Accessories- APS Buttons (Polara 8-iNS): Buttons, Push Button Signs, iCCU, SDLC Package,NEMA PlugAt 1st Ave & W 4th St:- (1) ATCeX2 Controller- (1) EDI Monitor- (2) BIUs- (1) Clary Battery Backup with 41 Ahr Batteries- NoTraffic Video/Radar Detection System: (1) Control Unit, (4) Sensors, Antenna,Mounts, and AccessoriesThe City of Newton is requesting quotations for the installation of traffic signal controland detection equipment as listed in General Traffic Controls Quote #7826, datedOctober 10, 2025. Equipment has been procured separately and will be provided by thecity. The work shall commence upon issuance of the Notice to Proceed, and shall be completedon or before February 13, 2025 , install completion date dependent upon supply chain.2. Plans and Specifications.Plans and specifications for City of Newton Traffic Signal Equipment install project areavailable for inspection in the office of the Public Works Director 303 W 4th St N, Suite 501,Newton, Iowa, or by contacting the Public Works office at 641-792-6622 ext. 23183. Site Visit.Interested contractors are further advised that a site visit may be arranged by contacting MikeWard, operations superintended at 641-792-6622 ext. 2310.4. Time, Place and Manner for Filing Competitive Quotations.Competitive quotations for Traffic Signal Equipment Install shall be filed in one of the belowmanners to the office of the Public Works Director 303 W 4th St N, Suite 501, Newton, Iowa, on orbefore 11:00 am on December 4th, 2025.(1) placing them in the United States Mail, appropriately stamped and addressed to thePublic Works Director office at the City of Newton, 303 W 4th St N, Suite 501, Newton,Iowa 50208;(2) filing them in person / in hand at the office of the Public Works Director’s office at theaddress listed above;5. Competitive Quotations to be Submitted on Form Provided.Competitive quotations shall be filed on the Competitive Quotation form provided by the City andincluded with this RFQ. Competitive quotations which are filed in any other form shall bedetermined to be non-responsive and shall be rejected by the City.6. Costs to be Included in Competitive Quotations Submitted by Contractors;Documentation of Certain Costs.Interested contractors are required to include in their competitive quotations the price for labor,equipment and supplies required to perform the work.7. Quotation and Evidence of Insurance Required.Each contractor submitting a quotation pursuant to this RFQ shall include with its quotation acertificate or certificates of insurance, evidencing insurance with coverage’s and in amounts asrequired by the City.8. Project Notes.- Execution of the City’s standard contract.- Completion of work by February 15, 2025, , install completion date dependent uponsupply chain.- Compliance with all manufacturer installation requirements.29. Sales Tax.The City will issue special sales tax exemption certificates to the contractor awarded the contract toperform the work and to its subcontractors, pursuant to Iowa Code Section 422.42, (15) and (16)and Iowa Code Section 422.47 (5). The contractor awarded the contract for the work and itssubcontractors should present such certificate when procuring materials and equipment for theproject, and should not pay sales tax for such materials and equipment. Accordingly, thecontractor should not include sales tax in its competitive quotation for the work. The city will notaccept contractor claims for reimbursement of sales tax, will not attempt to obtain a refund of salestaxes paid from the State of Iowa, and will not reimburse the contractor for any sales taxesmistakenly paid by it or its subcontractors.10. Evaluation of Competitive Quotations.If a quoting contractor does not submit its quotation on the form required by the governmentalentity, or does not provide all information or documentation or make all commitments required bythe governmental entity, or does not cause said form to be executed as required by thegovernmental entity, said quotation shall be determined to be non-responsive and shall be rejectedby the governmental entity.11. Completion Date and Liquidated Damages.The Contractor hereby agrees to fully complete the project by February 15, 2025, installcompletion date dependent upon supply chain.; and to pay liquidated damages fornoncompliance with said completion provisions at the rate of Two Hundred dollars ($200) for eachcalendar day thereafter that the work remains incomplete.12. Execution of Contract Upon Acceptance and Evidence of Insurance.Upon the City’s determination which contractor has submitted the lowest responsive, responsiblequotation, the City will take action to award the contract to that contractor, conditioned upon thecontractor’s submission, and the City’s approval, of the contractor’s evidence of insurance, andfurther conditioned upon the contractor’s execution of a contract in the form provided by the City.13. Make such alterations in the contract documents or in the proposal quantities as it determinesnecessary in accordance with the contract documents after execution of the contract. Suchalterations shall not be considered a waiver of any conditions of the contract documents, and shallnot invalidate any of the provisions thereof.IV. Quoting Contractor’s Agreements:The Quoting Contractor hereby agrees:1. To enter into a Contract to Construct a Public Improvement with the City, if this CompetitiveQuotation is selected, in the form provided by the City.2. To provide proof of insurance as required in the RFQ.3. To complete the work on or before Completion of work by February 15, 2025, , installcompletion date dependent upon supply chain.4. To construct the work in accordance with the project plans and specifications, the Iowa StatewideUrban Standard Specifications for Public Improvements, 2025 Edition (a.k.a. Iowa SUDASSpecifications, 2025 Edition), and as further modified by any supplemental specifications andspecial provisions included in the contract documents.5. To not include sales tax in this Competitive Quotation, with the understanding that the City willissue a sales tax exemption certificate for purchase of materials to be incorporated into the project.2
