NJIB No. S340898-07HAMILTON TOWNSHIPIMPROVEMENTS TO MELODY, MIDDLETON, AND ELKTON WASTEWATER PUMP STATIONSNOTICE TO BIDDERSTownship of HamiltonIMPROVEMENTS TO MELODY, MIDDLETON, AND ELKTONWASTEWATER PUMP STATIONSNOTICE IS HEREBY GIVEN that the Township of Hamilton will receive bids athttps://hamiltonnj.ionwave.net/ until 10:00 A.M. on TUESDAY, JUNE 2, 2026 for IMPROVEMENTS TO MELODY,MIDDLETON, AND ELKTON WASTEWATER PUMP STATIONS project.Work includes but is not limited to replacement of the Melody Wastewater Pumping Station with a new135 gpm/5 hp prefabricated station, replacement of the Middletown Wastewater Pumping Station with a new 177gpm/5 hp prefabricated station, and site improvements at the Elkton Pump Station.Proposals must be submitted to the Purchasing Agent, or her representative, no later than TUESDAY,JUNE 2, 2026 AT 10:00 A.M., at which time the bids will be opened in a public meeting, and the bid contents willbe read aloud in accordance with N.J.S.A. 40A:11-23(b).Proposal packages and/or any addendums are available at https://hamiltonnj.net/ and all proposals andquestions, shall be submitted to the same. Bidders, if help is needed during bid submission, on the IonWaveebidding system, click the “HELP LINK” at the top right of the screen under “QUICK LINKS”. Bids shall besubmitted on the form(s) provided and shall be in accordance with the specifications contained in the Instructionsto Bidders and other bidding documents. Bidders are required to comply with the requirements of the Local PublicContracts Law, the Prevailing Wage Act, N.J.S.A. 34:11-56.25 et seq,, the requirements of P. L. 1975, c.127, andN.J.S.A 10:5-31 et seq. and N.JA.C. 17:27-1.1 et seq., Affirmative Action, and all requirements as set forth in theInstructions to Bidders.Bids must be made on standard proposal forms and must be accompanied by a Non-Collusion Affidavit,as per N.J.S.A. 52:34-15 and a bid bond or certified check for not less than ten percent (10%) of the amount of thebid, providing that said check or bid bond need not be more than $20,000.00 nor shall not be less than $500.00, asper N.J.S.A. 40A:11-21, and be delivered at the place and on or before the hour named above.The project or contract is funded in part by New Jersey wastewater treatment financing programs and thesuccessful bidder must comply with all the provisions of NJAC 7:22-9.1 et seq. for the participation of smallbusiness enterprises owned and controlled by socially and economically disadvantaged individuals.N.J.A.C. 7:22-3.17(a)24, 4.17(a)24, 6.17(a)24 and 7:22A-2.4(a) provide that a goal of not less than 10percent be established for the award of contracts to small business concerns owned and controlled by one ormore socially and economically disadvantaged individuals. The goal of 10 percent applies to the total amount ofall contracts for building, materials and equipment, or services (including planning, design and building relatedactivities) for a construction project. The project sponsor has identified that the SED utilization goal for thisproject is 10%The 10 percent SED utilization requirement shall be accomplished by the following: 1. The bid documents, however, shall include a statement to the effect that thesuccessful bidder must fulfill the SED utilization requirements by subcontracting portions or the work to SEDs; or2. Contractors also have the option of establishing unrestricted bidding procedures to fulfill the 10 percent SEDutilization requirement for the project.All project sponsors, at least 10 days prior to public advertisement for bids, shall notify the NJDEP Officeof Equal Opportunity and Public Contract Assistance via H2Loans, of the availability of opportunities for SEDs toprovide services, to bid on unrestricted contracts or subcontracts, or to provide any other necessary purchase orprocurement.This contract or subcontract is expected to be funded in part with funds from the New Jersey Departmentof Environmental Protection and the New Jersey [Environmental Infrastructure Trust] Infrastructure Bank. Neitherthe State of New Jersey, the New Jersey [Environmental Infrastructure Trust] Infrastructure Bank nor any of theirdepartments, agencies or employees is, or will be, a party to this contract or subcontract or any lower tier contractor subcontract. This contract or subcontract is subject to the provisions of N.J.A.C. 7:22-3, 4, 5, 9 and 10.N.J.A.C. 7:22-9.1(a): (a) This subchapter establishes procedures for providing opportunities for sociallyand economically disadvantaged ("SED") contractors and vendors to supply materials and services under Statefinanced construction contracts for environmental infrastructure facilities. To implement the policies establishedin N.J.S.A. 58:11B-26, 40:11A-41 et seq., and 52:32-17 et seq., this subchapter applies to environmentalinfrastructure projects receiving financial assistance from the Department and the Trust pursuant to N.J.A.C. 7:22-3, 4 and 6 and 7:22A-6 and 7. Under the provisions of N.J.A.C. 7:22-3, 4 and 6 and 7:22A-6 and 7, the Departmentand the Trust require recipients of Trust and Fund loans and other assistance to establish such programs forsocially and economically disadvantaged small business concerns, to designate a project compliance officer, andto submit to the Department and Trust procurement plans for implementing the SED program.In accordance with the provisions of NJSA 58:11B-26, NJAC 7:22-3.17(a)24 and 4.17(a)24, the contractor(subcontractor) shall comply with all of the provisions of NJAC 7:22-9.Awards will be made only to socially and economically disadvantaged business concerns that arecertified by the New Jersey Commerce, Economic Growth and Tourism Commission, the New Jersey Departmentof Transportation, the Port Authority of New York and New Jersey, New Jersey Transit or other agencies deemedappropriate by the Office as eligible minority businesses or female businesses. The invitation to bid is on anunrestricted basis whereby the successful bidder must fulfill the SED utilization requirements.N.J.A.C. 7:22-9.7 requires project sponsors to adhere to specific advertisement criteria and duration.Specifically, relating to advertisement duration: In no case shall the advertisement for bids be published less than30 days prior to the date fixed for receiving bids on the purchase or contract.N.J.A.C. 7:22-9.10 Lowest bid resulting in payment of unreasonable price (a) If the contracting agencydetermines that the acceptance of the lowest responsible bid will result either in the payment of an unreasonableprice or in a contract otherwise unacceptable pursuant to the statutes and rules governing public contracts, thecontracting agency shall reject all bids. (b) Bidders and the office shall be notified of the rejection of all bids, thereasons for the rejection, and the contracting agency's intent to solicit bids for a second time. (c) If the contractingagency determines a second time that the acceptance of the lowest responsible bid will result either in theApril 2026NTB - 2NOTICE TO BIDDERS03 - Notice to BiddersNJIB No. S340898-07HAMILTON TOWNSHIPIMPROVEMENTS TO MELODY, MIDDLETON, AND ELKTON WASTEWATER PUMP STATIONSpayment of an unreasonable price or in a contract otherwise unacceptable pursuant to the statutes and rulesgoverning public contracts, the contracting agency shall reject all bids and notify the NJDEP Office of EqualOpportunity and Public Contract Assistance and, after receipt of the NJDEP Office of Equal Opportunity and PublicContract Assistance’s approval, shall amend the project plan accordingly. (d) Bidders shall be notified of thecancellation, the reasons for the cancellation and the contracting agency's intent to resolicit bids on anunrestricted basis. SEDs may participate in the bidding on an unrestricted basis.The Township may reject any or all bids, as per N.J.S.A. 40A:11-13.2. A bidder may request that it bidbe withdrawn due to a “mistake” on the part of the bidder, as defined in N.J.S.A. 40A11-23.3. Otherwise, nobids may be withdrawn for a period of sixty (60) days after the date and time set for the opening of the bids.All bidders are invited to attend a Pre-Bid Conference at the Hamilton Township Department of WaterPollution Control Wastewater Treatment Plant on 300 Hobson Avenue, Hamilton, NJ to be held on FRIDAY, MAY15, 2026 AT 10:00 A.M. HARD HATS MUST BE WORN TO ALL SITE VISITS AND/OR TOURS. Bidder attendance isnot mandatory, but is strongly recommended in order to fully understand the project.Also, under N.J.S.A. 34:11-56.48 at seq. and N.J.S.A. 34:11-56.55, the Contractor and all subcontractorsmust be registered pursuant to the Public Works Registration Act. It is recommended that a copy of theContractor’s and Subcontractor’s current Certificate of Registration is submitted with the bid proposal as well asthe Business Registration Certificate issued by the State of New Jersey. If copies are not provided with the bidsubmittal the copies must be provided prior to contract award.All Bid Addenda will be issued at (https://hamiltonnj.net). All interested respondents should still check thewebsite from now through bid opening. It is the sole responsibility of the respondent to be knowledgeable of alladdenda related to this procurement. In accordance with NJSA 40A:11-23(c), Notice shall be provided no laterthan seven days, Saturdays, Sundays, or holidays excepted, prior to the date for acceptance of bids, to any personwho has submitted a bid or who has received a bid package in any of the following ways: i) in writing by certifiedmail or ii) by certified facsimile transmission, meaning that the sender's facsimile machine produces a receiptshowing date and time of transmission and that the transmission was successful or iii) by a delivery service thatprovides certification of delivery to the sender.April 2026NTB - 3NOTICE TO BIDDERS03 - Notice to Bidders
