Vendors interested in bidding on the referenced items should read the entire document. The vendor must complete allsections of this document including the VENDOR RESPONSIBILITY FORM and sign where indicated. Your signatureidentifies your acceptance of all terms and conditions herein.2. All vendors must fill in the prices being requested in the places and formats indicated. All blank spaces in said bid shallbe filled in and no changes shall be made in the phraseology, or in the items, terms and conditions contained therein.3. Completed bids shall be mailed to the address indicated at the top of this page. Only sealed bids received hard copy willbe considered. Faxed or emailed bids are NOT PERMITTED.4. Please indicate the bid specification number and due date on the outside of your submitted bid mailing envelope.15. The City of New Rochelle is a sponsor of the Westchester Affirmative Action Equal Employment Agreement andencourages all minorities to submit bids. Firms qualified and certified as Minority Business Enterprises (MBE) andWomen Business Enterprises (WBE) are strongly encouraged to submit bids.Instructions, Terms and Conditions, Spec. # 58431. Submission of Bids: Each bid must be in a separate sealed envelope, clearly labeled with vendor name, bid numberand due date and addressed to City of New Rochelle, Department of Finance-Purchasing Office, City Hall, New Rochelle,New York 10801. All bids must be properly signed and received by the time and date specified in order to be valid.2. Method of Award: The contract if awarded will be to the lowest responsive/responsible bidder(s) in part or in wholewho meet(s) all the terms of the specifications and is in the best interest of the City of New Rochelle. The City guaranteesno minimum or maximum purchases or contracts as a result of award of this bid. The City of New Rochelle reserves theright to allow all municipal and not for profit organizations authorized under the General Municipal Laws of the State ofNew York, to purchase any goods and/or services awarded as a result of this bid in accordance with the latest amendmentsto NYS GML 100 through 104. However, it is understood that the extension of such contracts are at the discretion of thevendor and the vendor is only bound to any contract between the City of New Rochelle and the vendor. Additionally, theCity reserves the right to purchase any goods or services included as a part of this bid from any means legally available toit at any time. The City reserves the right to reject any and all bids or portion thereof, or any bids that are vague,incomplete or indefinite.3. Withdrawal of Bids: The submission of the bid proposal shall constitute an irrevocable offer which shall remain infull force and effect until the bid proposals received by the City are either accepted or rejected. Proposals may bewithdrawn at any time prior to the bid opening.4. Bid Deposits: Bid deposits, if required, will be returned to unsuccessful bidders after the bid has been awarded. Asuccessful bidder's deposit will be returned after a written contract has been executed, or after a performance bond, ifrequired, has been accepted by the City.5. Bid Format: Bidders are advised to become familiar with all conditions, instructions and specifications governingthis bid. Once the award has been made, failure to have read all the conditions, instructions and specifications shall notbe cause to alter the original bid.All bids must be priced per unit specified in the bid specifications or on the bid form submitted, and must be signed anddated. In the event of a discrepancy between the unit price and extension, the unit price will govern. No exceptions will beallowed with regard to errors made in the computation of a bid.Purchases by the City of New Rochelle are not subject to any federal, state or local taxes. Do not include any of thesetaxes when bidding or invoicing. Exemption certificates will be furnished upon request.6. Substitutions: Any deviation from specifications or indicated brand shall be clearly stated and fully explained byaccompanying specification sheets with submitted bid. Samples shall be supplied by the vendor, at no charge to the City,upon request. The City reserves the right to accept equals approved by it. If exception to indicated brand is not noted,bidder is required to deliver brand specified.7. Delivery of Product: All delivery are to be considered inside delivery to locations as specified by the authorized Cityagent. All items must be guaranteed against faulty material and workmanship and delivered as such. Deliveries ofincorrect or faulty items will be rejected and returned at vendors’ expense. Failure to deliver within the specified timemaybe cause for cancellation of the order.28. Shipping Terms: Shipping terms will be considered F.O.B. Destination and without charge for containers, packing,etc., unless specified on the bid and the cost thereof quoted.9. Payment Terms: The City of New Rochelle shall pay invoices at net 30 days after receipt of invoice and ofmaterial; whichever is later, unless alternate terms are indicated on the bid.10. ACH Payments: The City is moving toward ACH payments, awarded vendor will be supplied with our ACHauthorization form should you wish to accept payments via this method.11. Collusion Clause: By submission of this bid, each bidder and each person signing on behalf of any bidder certified,and in the case of a joint bid, each party thereto as to its own organization, under penalty of perjury, that to the best of itsknowledge and belief:A. The prices in this bid have been arrived at independently without collusion, consultation, communication oragreement, for the purpose of restricting competition, as to any matter relating to such prices with any otherbidder or any competitor; andB. unless otherwise requires by law, the prices which have been quoted in this bid have not beenknowingly disclosed by the bidder prior to the opening, directly or indirectly, to any other bidder or to anycompetitor; andC. no attempt has been made or will be made by the bidder to induce any other person, partnership or corporationto submit or not to submit a bid for the purpose of restricting competition.The bidder certifies that this bid is made without any connection with any other person making a bid for the same purpose,and is in all respects fair and without collusion or fraud, and that no elected official or other officer or employee orperson whose salary is payable in whole or in part from the city treasury is directly or indirectly interested therein, or insupplies materials and equipment to which it relates, or in any portion of the profits thereof.12. Cone of Silence – Cone of Silence, means a prohibition on any communication regarding a particular Request forProposal (“RFB”), Request for Qualification (“RFQ”) or Request for Bid ("RFB").Pursuant to State Finance Law §139-j and §139-k, this solicitation includes and imposes certain restrictions oncommunications between the City and a Bidder during the procurement process. A Bidder is restricted from contacting,other than designated staff, from the earliest notice of intent to solicit offers through final award and approval of theProcurement Contract by the Designated Contracting Officer ("Restricted Period") unless it is a contact that is includedamong certain statutory exceptions set forth in State Finance Law §139-j(3)(a). City employees are required to obtaincertain information when contacted during the Restricted Period. The designated staff contact is the Deputy FinanceCommissioner or his representative, telephone (914) 654-2353. Bidders responding to this RFB must familiarizethemselves with these State Finance Law requirements and will be expected to affirm that they understand and agree tocomply in their Proposal.3INTRODUCTIONThe City of New Rochelle is soliciting sealed bids from qualified and licensed plumbing contractors to provide on-callplumbing repair and maintenance services for City-owned buildings, facilities, and infrastructure. All work shall beperformed on an as-needed basis in accordance with all applicable New York State General Municipal Law (GML), NewYork State Labor Law Article 8 (Prevailing Wage), Westchester County codes, and all other applicable rules andregulations.SCOPE OF WORKThe selected contractor shall furnish all labor, materials, tools, transportation, equipment, and supervision necessary toperform plumbing services including, but not limited to:- Repair and replacement of water lines, fixtures, valves, and fittings- Maintenance of domestic water, sanitary, and storm systems- Installation and repair of hot water heaters, pumps, and backflow preventers- Detection and repair of leaks and blockages- Emergency response to pipe breaks, overflows, and system failures- Coordination with City departments and inspectors as neededContractor shall provide 24-hour emergency response service, 7 days a week, including holidays.TERM OF CONTRACTThe term of this contract shall be for one (1) year, commencing upon award, with the option for up to four (4) one-yearrenewals at the sole discretion of the City of New Rochelle, based on satisfactory performance and budgetary approval.PREVAILING WAGE REQUIREMENTSThis contract is subject to the New York State Department of Labor Prevailing Wage Schedule for the applicable trade andlocality (Westchester County). The contractor shall pay not less than the prevailing rate of wages and supplements,maintain and submit certified payrolls as required, and comply fully with NYS Labor Law §220. Failure to comply mayresult in contract termination and/or withholding of payments.QUALIFICATIONSBidders must:- Hold a valid Westchester County Master Plumber’s License- Have at least five (5) years of experience performing municipal or commercial plumbing work- Provide three (3) recent references for comparable work- Maintain insurance as required herein.BID SUBMISSION REQUIREMENTSEach bid must include the following:1. Completed Bid Form (Attachment A)2. Completed Pricing Sheet (Attachment B)3. Copy of Westchester County Plumbing License4. Proof of Insurance5. Non-Collusion Affidavit (per GML §103-d)6. Iran Divestment Act Certification (NYS Finance Law §165-a)7. Executive Order No. 16 Certification (Prohibiting contracts with entities doing business in Russia)8. Prevailing Wage Compliance CertificationIncomplete submissions may be rejected.4BASIS OF AWARDThe contract will be awarded to the lowest responsible and responsive bidder meeting all requirements in accordance withNYS GML §103. The City reserves the right to reject any or all bids, waive informalities, and accept the bid deemed mostadvantageous to the City of New Rochelle.Permits: When required by law, it is the contractor’s responsibility to apply for and receive any necessary permits from state,county or local city entities. If required, the documented costs may be added to invoicing.Response Timea) Non- Emergency Repairs:Repair services categorized by the City as non-emergency service will require next business day response time.b) Emergency Repairs:The successful bidder(s) must be able to respond to emergencies as categorized as such by the City within one (1) hourresponse time, twenty four (24) hour per day, seven days per week.Prevailing Wage – PRC 2025014502Contractor agrees to comply with the Westchester County Prevailing Wage Rate Schedule for personnel providing serviceunder this contract. The wages paid under this contract shall not be less than the prevailing wages and supplements as setforth by law. The contractor is required to keep informed of all changes during the term of this contract that apply toindividuals supplied by the vendor for this contract. Contractor is solely liable for and must pay such required prevailingwage adjustments during the contract term as required by law.Workmanship Requirementsa) All work shall be performed in a first class manner, in strict accordance with the best-recognized and approvedstandards and to the satisfaction of the City.b) Damage to Public or Private Property: Under this agreement, the awarded vendors shall be responsible for makingnecessary repairs to public or private property damaged by their work at the contractor’s sole expense.c) All debris removal shall be the responsibility of the awarded contractor(s).d) All work must be performed in a safe manner and in accordance with all OSHA safety requirements, and complywith all Westchester County, New York State, and Federal Government Labor Laws.5
