The Department of Natural and Cultural Resources (DNCR) has notified all bidders that the Request for Bids (RFB) for Project CAP2610 has been cancelled and will be re-advertised. During our review of the bids, DNCR identified inconsistencies within the document that may have limited the clarity of the project requirements. We sincerely apologize for any inconvenience this may have caused.
DNCR has revised the RFB (attached) to include a more detailed and accurate scope of work so that the project expectations are fully and clearly outlined. Our goal is to ensure all bidders have the information needed to provide complete, informed, and competitive proposals. Invitation to BidThe New Hampshire Department of Natural and Cultural Resources (DNCR), Division of Parksand Recreation, invites qualified environmental contractors to submit sealed bids for soil andgroundwater contamination sampling at Mount Washington State Park. This project supports theMount Washington Master Plan requirement for an independent third-party environmentalassessment, including soil and groundwater investigations. The selected contractor will prepareall required sampling plans, conduct field sampling, install temporary groundwater wells,perform laboratory analyses, and complete all associated reporting as outlined in the Scope ofWork.DNCR seeks experienced firms able to meet all applicable regulatory standards, includingNHDES Env-Or 600/610, PFAS soil requirements, and EPA Region 1 QAPP and QA/R-5standards. Bidders must meet the minimum qualifications specified in this RFB and provide allrequired submission materials for consideration.Sealed bids will be evaluated and awarded to the lowest responsible and responsive biddermeeting all minimum qualifications. Contract AwardThe award shall be made to the Vendor meeting the criteria established in this Request for Bidsand providing the lowest cost in total. The State reserves the right to reject any or all bids or anypart thereof and add/delete items/locations to the contract. All awards shall be in the form of aState of New Hampshire Contract.The successful Vendor shall not be allowed to require any other type of order, nor shall thesuccessful Vendor be allowed to require the filling out or signing of any other document by Stateof New Hampshire personnel.Section 2 – Instructions to BiddersA. Bid SubmittalAll bids shall be submitted on this form (or an exact copy), shall be typed, or clearly printed inink, and shall be received on or before the date and time specified below.All bid submissions will be received by the Owner until 2:00 P.M. prevailing time on Friday,June 5th, 2026. Submissions received after the date and time specified shall be marked as“Late” and shall not be considered in the evaluation process.Interested parties may submit a bid to the State of New Hampshire, Department of Natural andCultural Resources by email to the Bid Contact indicated above. All bids shall be clearly markedwith bid/project number and date due.All offers shall remain valid for a period of one hundred eighty (180) days from the bidsubmission date. Bid PricesBid prices shall remain firm for the entire contract period and shall be in US dollars and shallinclude delivery and all other costs required by this bid invitation. Special charges, surcharges(including credit card transaction fees), or fuel charges of any kind (by whatever name) may notbe added on at any time. Any and all charges shall be built into the bid price at the time of thebid. Unless otherwise specified, prices shall be F.O.B. DESTINATION, (included in the bidprice), which means delivered to a state agency’s receiving dock or other designated point asspecified in this contract or subsequent purchase orders without additional charge. Shipmentsshall be made in order to arrive at the destination at a satisfactory time for unloading duringreceiving hours.Per Administrative Rule 606.01(e) “if there is a discrepancy between the unit price and theextension price in a response to an RFP, RFB or RFQ, the unit price shall be binding upon thevendor.”Price decreases shall become effective immediately as they become effective to the generaltrade or the Vendor’s best/preferred customer.C. Terms of SubmissionAll material received in response to this bid shall become the property of the State and shall notbe returned to the Vendor. Public Disclosure of Bid or Proposal SubmissionsGenerally, the contents of any bid (including all materials submitted in connection with it, suchas attachments, exhibits, addenda, and vendor presentations) become public information uponcompletion of final contract or purchase order negotiations with the selected vendor. Certaininformation concerning bids, including but not limited to pricing or scoring, is generally availableto the public even before this time, in accordance with the provisions of RSA 21-G:37.Page 4 of 14Contractor InitialsDateTo the extent consistent with applicable state and federal laws and regulations, as determinedby the State, including, but not limited to, RSA Chapter 91-A (the “Right-to-Know” Law), the Stateshall, after final negotiations with the selected vendor are complete, attempt to maintainconfidentiality of portions of a bid that are clearly and properly marked by bidder as confidential.Any and all information contained in or connected to a bid that a bidder considers confidentialshall be clearly designated in the following manner:If the bidder considers any portion of a submission confidential, they shall provide aseparate copy of the full and complete document, fully redacting those portions byblacking them out and shall note on the applicable page or pages of the document thatthe redacted portion or portions are “confidential.” Use of any other term or method, suchas stating that a document or portion thereof is “proprietary”, “not for public use”, or “for client’suse only”, is not acceptable. In addition to providing an additional fully redacted copy of the bidsubmission to the person listed as the point of contact on Page (1) of this document, theidentified information considered to be confidential must be accompanied by a separate letterstating the rationale for each item designated as confidential. The letter must specifically statewhy and under what legal authority each redaction has been made. Submissions which do notconform to these instructions by failing to include a redacted copy (if required), by failing toinclude a letter specifying the rationale for each redaction, by failing to designate redactions inthe manner required by these instructions, or by including redactions which are contrary to theseinstructions or operative law may be rejected by the State as not conforming to the requirementsof the bid. The State will generally assume that a bid submitted without an additional redactedcopy contains no information which the bidder deems confidential. Bids which contain noredactions, as well as redacted versions of submissions that have been accepted by the State,may be released to the public, including by means of posting on State websites.The State shall have no obligation to maintain the confidentiality of any portion of a bid, orrelated material, which is not marked in accordance with the foregoing provisions. It isspecifically understood and agreed that the bidder waives any claim of confidentiality as to anyportion of a response to this Request for Bid that is not marked as indicated above, and thatunmarked (or improperly marked) submissions may be disseminated to any person, withoutlimitation. Marking an entire bid, attachments, or full sections thereof confidential without takinginto consideration the public’s right to know shall neither be accepted nor honored by the State.Notwithstanding any provision of this request for submission to the contrary, proposed pricing shallbe subject to public disclosure REGARDLESS of whether or not marked as confidential.If a request is made to the State by any person or entity to view or receive copies of any portionof a bid and if disclosure is not prohibited under RSA 21-G:37 or any other applicable law orregulation, bidders acknowledge and agree that the State may disclose any and all portions ofthe bid or related materials which is not marked as confidential. In the case of bids, or relatedmaterials that contain portions marked confidential, the State shall assess what information itbelieves is subject to release; notify the bidder that the request has been made; indicate what, ifany, portions of the bid or related material shall not be released; and notify the bidder of the dateit plans to release the materials. The State is not obligated to comply with a bidder’s designationregarding confidentiality.
