Does the City of Tulsa load Seller’s trucks or does the Seller provide a loader?The City asks that the Seller brings their own loader, and the Seller is responsible for loading thebiosolids into their trailers.2. Can the Seller back trucks down the drying bed ramp into the bed to load trucks?We don’t recommend it. It was something we tried at one time, but it is easier to just load the trucksfrom the side of the drying bed even if the loader must keep going back and forth bringing thebiosolids to the trucks.3. Item 203.6 talks about hauling a minimum of 900 cubic yards per day. Is that a hard rule requiredeach day?While we state a minimum in the contract, we understand that things don’t always work out. Forexample, trucks may break down or drivers must haul lighter loads due to hauling wet material. As aresult, we understand if there are times that less cubic yards are hauled to the field in a day.4. Can you describe how many beds you expect to clean out or how many loads you expect to have theSeller(s) haul each time the Seller(s) service is requested?We budget to clean out 8 beds a year, but we use some of our leftover lagoon cleanout money toclean out a few more beds. STATEMENT OF PURPOSE:1. Overview and GoalsThe goal of this solicitation is to secure a Secondary Seller to purchase Biosolid Hauling for theWater and Sewer Department of the City of Tulsa.2. Term of ContractThe City intends to award a one-year annual contract. The City may offer the Seller the opportunityfor additional one-year terms. The City also reserves the right to make multiple or partial awards. Todo business with the City, You must agree to the terms and conditions of the City’s standardPurchase Agreement, indicated by Your Authorized Agent’s signature on the Purchase Agreement.Capitalized terms used in this IFB and not defined in the Purchase Agreement shall have themeanings as ascribed to them in Title 6, Chapter 4 of the Tulsa Revised Ordinances.The entire Invitation for Bid (IFB), including any additional information submitted by Bidder andAccepted by City will be included as part of the Agreement between Seller and City. All sheets ofthis IFB (including Sections I-VI) must be submitted.Authorized AgentSeveral parts of the Bid (Affidavits, Purchase Agreement) must be signed by an “AuthorizedAgent.” An Authorized Agent means an agent who is legally authorized to bind the Seller under thelaw of the state in which the Seller is legally organized. For instance, under Oklahoma law, theAuthorized Agent for each of the following types of entities is as stated below:o Corporations – the president, board chair or board vice chair (or the vice president if the corporationwas formed in Oklahoma) can sign; others can sign if they have and provide the City with (i) a corporateresolution giving them authority to bind the Seller, and (ii) a recent certificate of secretary indicatingthe authority is still valid and was in full force and effect on the date of the signature. (See IFB SectionVI for sample of a Certificate of Secretary)o General Partnerships – any partner can sign to bind all partners.o Limited Partnerships – the general partner must sign.o Individuals – no additional authorization is required, but signatures must be witnessed and notarized.o Sole Proprietorship – the owner can sign. Any other person can sign if s/he provides a recent Powerof Attorney, signed by the owner, authorizing him/her to bind the sole proprietorship.o Limited Liability Company (LLC) – any manager of the LLC elected by the members of the LLC, orany member signing as manager of the LLC. All other signers will need a Consent of Members signedby all the Members of the LLC authorizing their signature on or up to 30 days before the date of theirsignature. SCOPE OF SERVICES AND SPECIFICATIONS1. Scope of ServicesThe City is requesting Bids for a Secondary Seller for Biosolids Hauling for use by the Water andSewer Department.Delivery RequirementsAll prices quoted shall be based on delivery F.O.B. Tulsa, Oklahoma or to any other points as maybe designated in the Specifications, with all charges prepaid by Seller to the actual point of delivery.Bids must state the number of Days required for delivery under normal conditions.Absolutely no items over 500lbs. may be directly shipped to the City requiring the City personnel tounload from the shipping truck or trailer. The City carries no responsibility for any damages incurredduring an unloading occurrence. All unloading shall be the responsibility of the Seller and/or shippingentity.2. SpecificationsThe Bid must meet or exceed the following Specifications.201.0 GENERAL:201.1 Project work will take place at the Southside Biosolids Storage Beds at 236 W. 71stStreet in Tulsa.201.2The Seller(s)’s operations shall include all equipment, labor, and incidentals necessaryfor the loading of biosolids directly from the Southside Wastewater Treatment PlantDewatering Facility Storage Beds, transporting the biosolids to the land application sitesand unloading the biosolids as required by the Specifications contained in thisAgreement.201.3The City’s contact person during the term of this Agreement is Steven Meier, SupportServices Manager, Water and Sewer Department (herein referred to as the “Engineer”).ANY CONTACT WITH CITY EMPLOYEES OR OFFICIALS, OTHER THAN THEASSIGNED PROJECT BUYER (Julie Miller, jamiller@cityoftulsa.org) FOR OR ABOUTTHIS SOLICITATION WILL DISQUALIFY YOUR BID AND IT SHALL BE DEEMEDNON-RESPONSIVE.202.0 BIOSOLIDS QUALITY AND CHARACTERISTICS:202.1 Class B biosolids generated from the Southside Dewatering Facility are land applied inaccordance with the provisions of the Southside Biosolids Management Permit. TheSeller(s) will be required to follow Oklahoma Department of Environmental Quality(ODEQ) approved guidelines, including existing plans and site-specifics provided as partof this Agreement.202.2The Seller(s) will be paid on a per cubic yard basis and must provide sufficient equipmentto load, transport and unload all dewatered biosolids stored in storage beds. Anestimated volume of 20,000 cubic yards will be removed from the Southside storagebeds each year. This quantity is an estimate to be used for bidding purposes only. TheCity and the Seller(s) must agree upon volume and cost, per the Bid pricing, prior tocommencement of work.IFB Rev 02/20245
