In 2004, the County of San Mateo developed the Domestic Violence Protocol for Law Enforcement ("Protocol") to ensure a consistent response by law enforcement to domestic violence incidents. The Protocol emphasizes enforcing laws to protect victims and sends a clear message that domestic violence is criminal behavior and will not be tolerated.

The Protocol acknowledges that victims are not the only individuals requiring assistance. Responding officers must address the perpetrator’s actions while also aiding victims and witnesses. To support victims effectively, officers often require immediate access to resources such as counseling and safe housing.

A key component of the Protocol is the Emergency Response Program (ERP). Responding officers initiate the ERP by contacting the on-duty counselor at a partner agency to provide immediate support to victims of domestic violence. Counselors from the partner agency must respond promptly by calling the phone number provided by the officer. Additionally, counselors conduct follow-up with victims referred through the Protocol, making at least four attempts to reach them by phone if direct contact isn’t possible at the time of the referral.

Under the contract, the service provider must deliver the following services:

- A 24-hour crisis hotline.

- Emergency shelter.

- Counseling for victims and their children.

- Legal assistance to obtain restraining orders.

- Teen outreach and community education programs.

The ERP, unique to San Mateo County, collaborates with all law enforcement agencies to provide 24/7 telephone counseling during or immediately after a 911 domestic violence call. Responding officers encourage victims to speak with specially trained counselors who provide information about the dynamics of domestic violence, available services (e.g., counseling, shelter, legal assistance), and options for ongoing support.

The Protocol mandates ERP notification during the handling of any domestic violence incident, regardless of whether the case is deemed criminal or results in an arrest. This ensures that both victims and officers receive the timely support necessary to address domestic violence effectively.
