MSUA will only respond to writtenquestions related to this Request for Sealed Formal Bid submitted by the question due date. CST, February 26, 2026.The Bids filed with the MSUA shall be accompanied by a Bidder’s Bond for ten percent (10%)of the total amount of the bid, payable to the MSUA. The following bonds will be required fromthe Successful Bidder: Performance Bond in the Full Amount of the Contract Price Payment Bond for payment of all labor and materials used in the construction of suchImprovements in the Full Amount of the Contract Price Two-year Maintenance Bond in the Full Amount of the Contract PriceThe Bidder must supply all the information required by the bid forms.1. W-92INSTRUCTIONS TO BIDDERSEXAMINATION OF BID DOCUMENTS Each Contractor by offering its Bid represents that it hasread and understands all documents comprising the Request for Formal Proposals. The Contractorshall include in its Bid any and all costs that may be necessary to complete the work in accordancewith the requirements of the Contract Documents.INTERPRETATION OF CONTRACT DOCUMENTS Questions regarding documents,discrepancies, omissions, or intent of the Specifications or drawings shall be submitted in writing tothe MSUA through the Engineer or purchasing agent at least thirty-four (34) days prior to openingof bids to provide time for issuing and forwarding an addendum. Any interpretation of the contractdocuments will be made only by addendum duly issued or delivered by the MSUA to each personreceiving a set of documents. The MSUA will not be responsible for any other explanations orinterpretation of the contract documents.MATERIAL SUBSTITUTION Each Contractor shall base its Bid upon the materials and equipmentas described in the Request for Formal Proposals. The successful Contractor will not be allowed tomake any substitutions on its own initiative, but in each instance will be required to obtainauthorization from the MSUA before installing any work in variance with the requirements of thecontract documents.LOCAL CONDITIONS AFFECTING Each Contractor shall visit the site of the Scope of Work andthoroughly and fully inform itself relative to construction hazards and procedure, labor, and all otherconditions and factors, local and otherwise, which would affect the prosecution and completion ofthe Scope of Work and the cost thereof, including the arrangement and conditions of existingstructures and facilities affecting or which are affected by the Scope of Work, access to the site, theavailability and cost of labor, and available facilities for transportation, handling and storage ofmaterials and equipment. It is understood and agreed that all such factors have been properlyinvestigated and considered in the preparation of every Bid submitted and there will be nosubsequent financial adjustment to any contract award here under, even in the event the lack ofsuch prior investigation affects the cost of the work.SUBSURFACE CONDITIONS The Contractor shall be completely responsible for investigatingsubsurface conditions that may affect the Scope of Work and prepare its Bid accordingly. Theexistence of unforeseen subsurface conditions, whether investigated or not, that adversely affect theScope of Work, shall not entitle the successful Contractor to any additional compensation.QUALIFICATIONS OF CONTRACTOR To assist in determining the best Bid in the interest ofMSUA, each Contractor must complete the attached “Qualification Statement of Contractor” whichseeks the following information: (a) address of permanent place of business; (b) list of Contractor-owned equipment available to complete the Scope of Work properly and expeditiously; (c) list ofequipment Contractor expects to rent or lease to complete the Scope of Work properly andexpeditiously; (d) financial records showing Contractor’s ability to meet obligations incident to thework; and (e) list of similar projects completed. Each Bidder must complete the attached “QualificationStatement of Bidders.”Each Contractor may be required to show that former work performed by it has been handled in such3manner that there are no just or proper claims pending against such work. No Contractor will beacceptable if it is engaged on any other work which impairs its ability to finance this contract orprovide proper equipment for the proper execution of same. Each Contractor shall demonstrate itsability by meeting all requirements herein stipulated.BID SECURITY. No Bid will be considered unless accompanied by a cashier’s check, a certifiedcheck or a Bidder’s bond in the amount of ten (10) percent of the Bid, as a guarantee that if the Bidis accepted, the Bidder will execute the agreement and file bonds and insurance as required by theContract Documents within 10 days from and after the date of the acceptance of the Bid by theMSUA.RETURN OF BID SECURITIES. The security of all unsuccessful Bidders will be returned after theexecution of the agreement with the successful Bidder and the approval of its bonds and insurance.If all Bids are rejected, all securities will be returned at the time of rejection.AGREEMENT, BONDS, INSURANCE The attention of Contractors is specifically directed to theforms of agreement and bonds to be executed and the type of insurance to be taken out in the eventa contract award is made. The Contractor, to whom the work is awarded, will be required to furnishthe following Surety Bonds and Liability Insurance. An irrevocable letter of credit may be substitutedfor each bond if approved by the City Attorney. Performance Bond. A performance bond to the MSUA in an amount equal to 100% ofcontract price. Statutory Bond. A statutory bond to the MSUA in an amount equal to 100% of the contractprice. Maintenance Bond. A maintenance bond to the MSUA in an amount equal to the contractprice to protect against defective workmanship and materials for a period of (2) two yearsafter acceptance of the project, and payment of all labor and materials including the primeContractor and all subcontractors. Liability Insurance with necessary endorsements and certificate naming the MSUA as anAdditional Insured. The insurance policy shall provide coverage in the amount of One MillionDollars ($1,000,000) per occurrence and Five Million Dollars ($5,000,000) in the aggregate. Workers’ Compensation Insurance. In the absence of Workers’ Compensation insurance,a signed affidavit for exempt status must be provided. The insurance policy shall providecoverage in the amount of One Million Dollars ($1,000,000) per occurrence and Five MillionDollars ($5,000,000) in the aggregate.Each bond shall be executed on the forms attached, signed by a surety company authorized to dobusiness in the State of Oklahoma and acceptable as a surety to the MSUA. With each bond thereshall be filed with the MSUA one copy of the “Power of Attorney” certified to include the date of bond.A letter of credit from a bank for the total amount of the Bid project may be used, if approved by theCity Attorney, in lieu of bonds.BID SUBMITTAL Each Bid, properly signed, together with all required submittals. Submit (5) sealedhard copies and (1) digital copy (Thumb Drive). Print Company Name, Contact, Phone Number andRFP 25-87 Fiber Node Shelter on box or envelope.All costs incurred by the Bidder in preparing and responding to this solicitation are the soleresponsibility of the Bidder. Any Bid submitted pursuant to this solicitation is at the sole risk andresponsibility of the party submitting such Bid.WITHDRAWAL OF BID Any Bid may be withdrawn at any time prior to the hour fixed in the Requestfor Bid for the opening of Bids, provided that a request in writing, executed by the Contractor, or its4duly authorized representative, for the withdrawal of such Bid is filed with the MSUA prior to the timespecified for opening of Bids. The withdrawal of such Bid will not prejudice the right of a Contractorto file a new Bid.PENALTY FOR COLLUSION If at any time it shall be found that the person, firm or corporation towhom the contract has been awarded has, in presenting any Contractor or Bids, colluded with anyother party or parties, then the Contract so awarded shall be null and void, and the Contractor and itssureties shall be liable to the MSUA for all loss or damage which the MSUA may suffer thereby, andthe MSUA may advertise for new Bids for said Scope of Work. Contractors are required to submit aNon-collusion Affidavit with the Bid submittal.LICENSE Each Contractor shall possess State and local licenses as are required by law and shallfurnish satisfactory proof to the MSUA upon request that the licenses are in effect during the entireperiod of the Contract. All applicable laws, ordinances, rules, and regulations of all authorities havingjurisdiction over construction of the project shall apply to the Contract throughout.TITLE 18 COMPLIANCE Compliance with Oklahoma’s General Corporation Act and the LimitedLiability Company Act is required before a Contract will be awarded. Each Bidder representing acorporation, limited liability company, or other formal business structure, agrees to provide uponrequest a Federal Employer’s Identification Number and proof of lawful filing with the OklahomaSecretary of State as required by Oklahoma’s General Corporation Act and the Limited LiabilityCompany Act. (See 18 O.S. §§ 1000-1144, 2000-2060).OPENING OF BIDS Bids will be opened and recorded at the time and place indicated in theInvitation for Bids. Contractors or their agents are invited to be present.ADDENDUM TO BIDS: In the event it becomes necessary to amend any part of the Bid, the ContractAdministrator shall issue a written addendum on the specifics of the change and post on our websitewith RFB 25-87. Bidder should check back periodically on our website to see if an addendum hasbeen added. See our Website at miamiokla.net and look in the Bid section to find RFB 25-87.ACCEPTANCE AND REJECTION OF BIDS The MSUA reserves the right to accept the Bid which,in its judgment, is the best Bid in the interest of MSUA, to reject any or all Bids, and to waiveirregularities or informalities at its discretion.AWARD OF CONTRACT The award of any CONTRACT will be made to the Bidder offering thebest Bid in the interest of MSUA and having provided the necessary bonds, insurance, and otherdocuments required per the Invitation to Bid and Instruction to Bidders.The award may be made to more than one Bidder by awarding the Contract(s) by item or groups ofitems, or on an ALL OR NONE basis, whichever is deemed by the Purchasing Agent to be in thebest interest of the MSUA.It is anticipated that approval will be received within 30 days of the opening of Bids. In the event thatthe approvals are not received or the MSUA cannot award or reject said proposals within 60 daysfrom the date of opening of Bids, Bidders shall have the right to withdraw their Bids on written noticeto the Owner.EFFECTIVE DATE OF AWARD If a Contract is awarded by the MSUA, such award shall be effectiveupon execution by the authorized representative of the MSUA, following delivery of a Notice ofConditional Award by some office or agent of the MSUA duly authorized to give such notice to theintended awardee, either in person or by mail at the main business address shown on the BidDocuments submitted by such awardee.EXECUTION OF AGREEMENT Copies of the contract in the number stated in the form of contract,5
