NOTICE INVITING SEALED BIDSSenior Center Roof ImprovementsCity Project No. 46F056CITY OF SAN MATEO, CALIFORNIA1. Sealed bids will be received by the City of San Mateo, California, for the construction ofSenior Center Roof Improvements Project and other work as described in the ContractBook.2. Said sealed proposals shall be delivered to the City Clerk, City Hall, 330 West 20thAvenue, San Mateo, California 94403, at or before 2:00 p.m., Tuesday, May 12, 2026,and they shall be opened and read by a City Representative at said date and time.3. Said City Representative shall report the results of the bidding to the City Council at alater date, at which time the City Council may award the contract to the lowestresponsible bidder as so reported; or as the City’s interest may dictate, City Council mayexercise its right to modify the award or to reject any or all bids.4. On Tuesday, April 28, 2026 at 10:00 a.m., a mandatory pre-bid conference shallbe held at Senior Center, 2645 Alameda de las Pulgas, San Mateo, CA 94403, forpurposes of clarifying and answering questions relative to the project. Prospective biddersare encouraged to attend. A summary of questions and responses from the pre-bidconference will be issued in writing to all plan holders.5. Questions regarding the Bidding Documents should be directed to Steve Wu, Facilities &Fleet Services Manager, swu@cityofsanmateo.org via email and received no later thanseven (7) calendar days before bids are due. Responses to all submissions will be emailedto each eligible bidder no later than two (2) days before bids are due.6. The Contractor’s license required for this contract is Class C-39. Listed subcontractorsshall also possess the contractor’s license required for each specialty work specifiedand/or possess a Class C-39 license. To the extent required by state law, any othercontractors or subcontractors must hold a valid license in the appropriate classificationfor the work performed. Licenses must be in good standing at the time the contract isawarded (Public Contract Code section 10164).7. Contractor shall purchase a complete set of plans and specifications and provide contactinformation through Barker Blue in order to be eligible to bid on this project. Thecontract book, plans and proposal forms are available at City of San Mateo – PublicWorks Bidding Web Portal (www.cityofsanmateo.org/bids.aspx). Contractors can alsoemail Barker Blue’s Customer Support Team at plan@barkerblue.com or call 650-696-2100 for assistance. Any questions regarding the contract documents should be directedto Steve Wu, Project Manager, at (650) 522-7345, or in writing to: Public WorksDepartment, 330 West 20th Avenue, San Mateo, California 94403.8. The estimated construction cost of this project is $210,000.00. This estimate is notbased on a "contractor's cost take off" of the project, but is derived from an averagingof costs for work on similar projects in the area of which the City is aware. Thisfigure is given to indicate the relative order of magnitude of this project and is notintended to influence or affect in any way the amount of the bid for this project.9. All bids shall be accompanied by a bid bond, cashier's check, or certified check madepayable to the City of San Mateo in an amount not less than ten percent (10%) of theaggregate amount of the bid. Said amount or the proceeds of said bond shall be forfeitedto the City if the bidder depositing same does not, within 8 working days after the bidderhas received notice from the City of San Mateo that the contract has been awarded, signand return the contract to the City and furnish the other items required under Section 3,"Contract Award and Execution," of the special provisions.10. Bidder is notified that it shall comply with the requirements for Non-Discriminationas set forth in United States Code, Title 23, Section 112, Public Contract Code,Section 7106 and Section 00500, Agreement.11. Addenda issued during the time of bidding shall become a part of the documentsfurnished bidders for the preparation of bids, shall be covered in the bids, and shall bemade a part of the Contract. Each bid shall include specific acknowledgement in thespace provided of receipt of all Addenda issued during the bidding period. Failure to soacknowledge may result in the bid being rejected as not responsive. Failure of any bidderto receive such Addenda shall not be grounds for non-compliance with the terms of theinstructions. It is the responsibility of the contractor to contact the City to determine theexistence of any and all addenda.12. The right is reserved, as the interest of the City may require, to reject any or all bids,to waive any informality in bids, and to accept, modify, or reject any items of the bid,or in the case of a single bid being received to extend the acceptance date by up tothirty (30) days with notice. The City of San Mateo is a charter City and any contractentered into is subject to the provisions of the City of San Mateo Charter, which maysupersede certain provisions of the Public Contract Code and other provision of statelaw.13. A contractor or subcontractor shall not be qualified to bid on, be listed in a bid proposal,subject to the requirements of Section 4104 of the Public Contract Code, or engage in theperformance of any contract for public work, as defined in this chapter, unless currentlyregistered and qualified to perform public work pursuant to Section 1725.5. It is not aviolation of this section for an unregistered contractor to submit a bid that is authorizedby Section 7029.1 of the Business and Professions Code or by Section 10164 or 20183.5of the Public Contract Code, provided the contractor is registered to perform public workpursuant to Section 1725.5 at the time the contract is awarded. This project is subject tocompliance monitoring and enforcement by the Department of Industrial Relations.No contractor or subcontractor may be listed on a bid proposal for a public works projectand no contractor or subcontractor may be awarded a contract for public work on a publicworks project unless registered with the Department of Industrial Relations pursuant toLabor Code section 1725.5. This project is subject to compliance monitoring andenforcement by the Department of Industrial Relations. As an additional requirement,Assembly Bill 219 adds Section 1720.9 to the Labor Code. This bill expands thedefinition of public works under the California Prevailing Wage Law and is arequirement for this project. For reference, please see: https://www.dir.ca.gov/Per Labor Code Section 20103.5, a contractor can register at any time prior to bidaward and no contractor or subcontractor may be awarded a contract for public work ona public works project unless registered with the Department of Industrial Relationspursuant to Labor Code Section 1725.15. This project is subject to compliancemonitoring and enforcement by the Department of Industrial Relations.In general, the prevailing wage scale, as determined by the Director of IndustrialRelations of the State of California, in force on the day this bid was announced ordetermined by the administrator of the Wage and Hour Division, U.S. Department ofLabor, in force on the day bids are opened, whichever is higher, will be the minimumpaid to all craftsmen and laborers working on this project. In some cases, prevailing wagedeterminations have either a single asterisk (*) or double asterisks (**) after theexpiration date in effect on the date of advertisement for bids.In cases where the prevailing wage determinations have a single asterisk (*) after theexpiration date which are in effect on the date of advertisement for bids, suchdeterminations remain in effect for the life of the project. Prevailing wage determinationswhich have double asterisks (**) after the expiration date indicate that the basic hourlywage rate, overtime, and holiday pay rates, and employer payments to be paid for workperformed after this date have been predetermined. If work is extended past this date, thenew rate must be paid and should be incorporated in contracts the Contractor enters into.Pursuant to Section 1773 of the Labor Code, the general prevailing wage rates in thecounty, or counties, in which the work is to be done have been determined by theDirector of the California Department of Industrial Relations. The wages as set forth inthe General Prevailing Wage Rates for this project will be posted at the job site. It isunderstood that it is the responsibility of the bidder to determine the correct scale. TheCity will keep a copy of the wage scale in the City Clerk’s office for the convenience ofbidders. The State Prevailing Wage Rates may also be obtained from the CaliforniaDepartment of Industrial Relations internet website at http://www.dir.ca.gov. Any errorsor defects in the materials in the City Clerk’s office will not excuse a bidder’s failure tocomply with actual scale then in force.14. The work performed as part of this contract is subject to the restrictions and requirementsof any and all Federal, State and San Mateo County Health Orders (collectively “HealthOrders”) in effect during the contract period, which may be changed by such governmentagencies without notice.15. Said City Representative shall report the results of the bidding to the City Council at alater date, at which time the City Council may award the contract to the lowestresponsible bidder as so reported; or as City's interest may dictate. The City Councilmay exercise its right to modify the award or to reject any or all bids. Any protests toaward of contract shall follow the procedures outlined in City Council ResolutionNo. 61, dated June 7, 2004.16. To ensure performance, City reserves the right to retain five percent (5%) of thecontract price for 35 days after it records the Notice of Completion. However,pursuant to the Public Contracts Code Section 22300, Bidder may substitute securitiesfor said five percent (5%) retention or request that City make payments of retentionsearned directly to an escrow agent at Bidder’s expense. The provisions of the PublicContracts Code Section 22300 are hereby expressly made a part of the contract.17.
