INVITATION TO BIDTOWN OF MORRISTOWNLEGAL NOTICE TO BIDDERSREHABILITATE RUNWAY 5-23, PHASE XI (DESIGN) - (PHASE H CONSTRUCTION)MORRISTOWN MUNICIPAL AIRPORTNOTICE is hereby given that sealed bids will be received by the Business Administrator of the Town ofMorristown, in the County of Morris, State of New Jersey (the “Town” or, as the case may be, the “Sponsor”or “Owner”) on Wednesday, May 20, 2026, at 10:00 a.m., prevailing time for the following:REHABILITATE RUNWAY 5-23, PHASE XI (DESIGN) - (PHASE H CONSTRUCTION) atMORRISTOWN MUNICIPAL AIRPORTSealed bid proposals will be received at the Morristown Town Hall, 200 South Street, 2nd Floor, Room 201,Morristown, NJ, 07960 until May 20, 2026, at 10:00 A.M. (the “Receipt Deadline”), at which time they willbe publicly unsealed and the contents publicly announced in Room 201. N.J.S.A. 40A:11-23(a) prohibits bidsbeing publicly opened on a Monday or the day after a holiday.Unless a form included in the Bid Documents expressly specifies otherwise, all bid proposals must besubmitted on the Proposal Forms provided in the Bid Documents and must be enclosed in a sealed opaqueenvelope, with the name of the Bidder and the name of the project plainly and clearly marked on the outside asfollows:TO: Attn: Jillian C. No bid will be accepted after the Receipt Deadline specified above. TheTown shall not be responsible for any bid not delivered in person to Morristown Town Hall, 200 South Street,2nd Floor, Room 201, Morristown, NJ, 07960 at or before the Receipt Deadline. The Town shall award theContract or reject all bids within 60 days of bid opening, except that the bid of any bidder who consents theretowhere indicated in the bid documents, may be held for consideration for such longer period as may be agreed,but in no event exceeding 210 days without further consent.The Town will evaluate bids and any award will be made to the lowest, responsive, responsible bidder inaccordance with N.J.S.A. 40A:11-6.1.Plans and specifications will be available and can be purchased at www.deltaairport.com. Plans andspecifications are available for purchase in both hardcopy and digital (PDF) formats.A Pre-Bid Conference will be held in the Airport’s Multi-Purpose/Conference Room (Building 8C) onApril 29, 2026 at 10:00 A.M.All prospective bidders are highly encouraged to attend the Pre-Bid Conference to discuss the proposedconstruction and the plans and specifications.Bidders may visit the project site by prior appointment with DM AIRPORTS, LTD., operators of MorristownMunicipal Airport. To schedule a project site visit appointment, contact Felicia Coppola, ProjectsAdministrator, at (973) 538-6400.A Proposal Guaranty—in the form of either a Cashier’s check drawn upon a state or national bank or a ProposalBond with a Surety’s Bond Affidavit and in the penal sum of five percent (5%) of the total maximum bidamount—will be required with each bid proposal. After the bids are publicly opened the Proposal Guaranty ofthe two (2) apparent lowest responsible bidders will be retained until a final award is made. All other ProposalGuaranties will be returned to the bidder that proffered it within ten (10) days after the opening of bids, unlessotherwise requested by the bidder. After the contract has been awarded and executed, the unsuccessful bidder’sProposal Guaranty will be returned as soon as practicable, while the Proposal Guaranty of the winning bidderwill be returned as soon as the Town receives the contract bonds as required herein. Failure to include therequisite Proposal Guaranty, in the format prescribed herein, with your bid Proposal, is a fatal defect that willrender your bid unresponsive and require that it be rejected.Bidders are required to comply with all relevant Federal and State Statutes, Rules and Regulations and LocalOrdinances, including but not limited to, the applicable provisions of Title VI of the Civil Rights Act of 1964,as amended (42 USC 2000d-1 et seq.), the discrimination and affirmative action provisions of N.J.S.A. 10:2-1through 10:2-4, the New Jersey Law against Discrimination, N.J.S.A. 10:5-1 et seq., and the rules andregulations promulgated pursuant thereto. Pursuant to N.J.S.A. 10:5-31 et seq., bidders are required to complywith the requirements of P.L. 1975 c. 127, N.J.A.C. 17:27.Bidders are directed to the Proposal Forms included in the specifications, in particular the Proposal Checklist,for identification of required Category 1 documents as well as Category 2 documents. Failure to provideCategory 1 bid documents will automatically render the bid unresponsive and require rejection of the bid.Prospective bidders are cautioned not to rely solely on this Invitation to Bid, but to read the Bid Package inits entirety.Contractor and all subcontractors must comply with all applicable provisions of the New Jersey Public WorksContractor Registration Act, N.J.S.A. 34:11-56.48 and the New Jersey Prevailing Wage Act, N.J.S.A. 34:11-56.25.The Town of Morristown reserves the right to reject any and all bid Proposals and to waive any informalityin bid Proposals received.
