It is intended that themajority of these funds be spent on work under this bid, although that amount is not guaranteed.Bids shall be made on the Bid Forms furnished with the Specifications. The Town of Bedford reserves theright to reject any and all Bids, to waive any informality in any Bid, and to award the Contract to other thanthe lowest Bidder if deemed in the best interest of the Town to do so. This contract is to remain in effectfrom January 1, 2026 to December 31, 2026. However, if the Town of Bedford determines that it is inthe Town’s best interest, the contract will be extended each year (with the bid pricing / provisions soprovided by the vendor at the time of bid) until December 31, 2026 and each year thereafter for up to atotal of 4 years – i.e. December 31, 2030 (if mutually agreeable to both the Town of Bedford and theVendor awarded this contract.)November 28, 2025By Order of the Town BoardBy Allie Whalen, Town ClerkINSTRUCTIONS TO BIDDERSBids shall be made and received upon the following conditions:1. Before bidding, Contractors are requested to fully examine the specifications.2. Bidders are required to form their own judgment of the character of the work, by personalexamination of the specifications relating to the work.3. Bidders are required to express in writing and also in numerals, the price for which they willagree to execute and perform the various work stated.4. The price so named is to cover the cost of furnishing all labor, material, and of performing allthe work under this contract, in accordance with the specifications and every expenseincidental to the execution of the work.5. No deviation from the plans and specifications will be permitted, nor shall any extracompensation be claimed or allowed beyond the prices named in the bid.6. Bids that contain any omission, erasures, alterations, additions, or items not called for initemized Bid, or that contains irregularities of any kind, may constitute sufficient cause forrejection of the bid. In case of any discrepancy in the price or amount bid in the Bid, theprice, as expressed in words, shall govern. All bids must be submitted in sealed envelopesaddressed to the Town Board, Bedford, New York, Westchester County, New York and beclearly identified with: (1) Project Name, (2) Name of Bidder and Address. Bids shall besigned with name typed below signature. The Bidder's seal, if a corporation shall be affixedunder the Bidder's signature. Telephone, Facsimile or Telegraphic Bids will not be accepted.7. All Performance Bonds and Labor and Material Bonds must contain the followingrequirements:A. Signature of Attorney-in-Fact signing on behalf of sureties and for the Officer orOwner signing on behalf of the Contractor/Vendor/Bidder and their names printed ortypewritten below their corresponding signature;B. Notary Acknowledgement for the Attorney-in-Fact signing on behalf of sureties andfor the Officer or Owner signing on behalf of the Contractor/Vendor/Bidder, along withbond(s) and Power of Attorney; andC. All bonds must be from surety companies licensed to do business in the State of NewYork, have a good history with respect to claims handling, and attach consent of surety.8. The Bedford Commissioner of Public Works may make such investigations as he/she deemsnecessary to determine the qualifications of the Bidder to perform the work and the Biddershall furnish information and data for this purpose as may be required. The Commissioner ofPublic Works and the Town of Bedford reserves the right to reject any bid if the evidencesubmitted by a Bidder, or the investigation of such Bidder, fails to satisfy theCommissioner/Town, that such Bidder is properly qualified to carry out obligations of the2Contract and to complete the work contemplated therein within the time designated.Fraudulent statements shall cause rejections of Bid and forfeiture of bid security.The investigation of a Bidder will seek to determine whether the organization is adequate insize, is authorized to do business in the jurisdiction where the project is located, has hadprevious similar experience and where available equipment and financial resources areadequate to assure Commissioner/ Town of Bedford that the work will be competed inaccordance with the terms of the Agreement. The amount of other work to which the Bidderis committed may also be considered.All Bidders shall be prepared to submit within five (5) days of Bedford Commissioner ofPublic Works request, written evidence of such information and data necessary to determine ifBidder is qualified to perform the work. Qualifications shall include a minimum of five (5)previous projects involving similar construction work. The Contractor shall have a minimumof 5 years of work experience of similar size and scope.Technical capability and the ability to complete the project within the established time framewill also be part of the evaluation criteria along with any special status the bidder may havesuch as women-owned business and minority-owned business. Guidance on businessclassifications can be found in the Federal Acquisition Regulations (FAR) Subpart 19.1.In evaluating Bids, the Bedford Commissioner of Public Works will consider thequalifications of only those Bidders that have submitted Bids are in compliance with theprescribed requirements.9. If the bid is accepted, the successful Bidder will enter into a contract for the work or thegoods, as the case may be, and will furnish an executed performance bond in the full amountof the contract price as security for the faithful performance of the terms, covenants andconditions of the contract and a labor and material bond in an equal amount of the fullpayment of all persons performing labor or furnishing material in connection therewith. Thebonds shall have as surety thereon such surety company or companies as are acceptable to theTown and are authorized to transact business in the State of New York.Work shall be guaranteed against defects for 6 months from the date of completion of allwork in a calendar year. 5% retainage shall be held on all invoices for duration of 6 monthsfrom the approval of the final project invoice to ensure proper completion of the work and the6 month warranty. If warranty repairs are not made within one month of notification to theContractor, the Bedford Commissioner of Public Works shall have the right to make theserepairs and deduct them from the project retainage.All bonds are subject to the approval of the Town Attorney of the Town of Bedford as toadequacy, form and content.10. All deposits will be returned to the unsuccessful Bidders and to the successful Bidder on theexecution of the contract and the furnishing of the required security.11. The Town Board reserves the right to reject any or all bids submitted to it, to omit any item oritems, to waive any informality in a bid or to approve minor changes in specifications ifdeemed advisable in the interests of the Town.312. Upon acceptance of the bid, the successful Bidder shall execute a contract and furnish therequired security within seven (7) days from the date of mailing of said contract by the Townof Bedford.13. Where applicable, the contract will contain a provision that every mechanic, laborer andworkman employed in or about the work contemplated by the contract shall be paid not lessthan the prevailing rate of wages and provided with not less than the prevailing supplementsas provided by Section 220 of the Labor Law of the State of New York.14. All bids shall be in the prescribed form, and no other form shall be used. The prices must bewritten in ink in words and also stated in figures, and any bid not in accordance with theseinstructions or not on the blanks furnished, or containing bids not asked for, may be rejected.Where separate prices are required for various items, it is understood that the Town Boardshall have complete discretion in awarding the contract as a whole or in part. Local and Statesales taxes shall not be included in the bid.15. The details of the insurance requirements related to this bid are contained in the contract andschedule thereto. All insurance as required hereunder shall run for the benefit of the Town ofBedford.16. The notice to Bidders, these instructions, the specifications, the bid and the non-collusionstatement shall be deemed to be part of the formal contract to be executed by the successfulBidder.Price Adjustment Clause: Since asphalt cement prices may fluctuate, and to adjust equally to compensatefor price fluctuations, bidder shall use the posted by NYSDOT (Average Posted Prices for Asphalt) forNovember 2025 (i.e. $638.00 per ton) for the base price of asphalt cement at the time of their submissionof bid (or at the time the bid is renewed if the contract is extended.) In requesting payment the vendor shallinvoice the Town of Bedford for the number of tons at the bid price. An additional statement on the sameinvoice form will designate the adjustment based on the percentage of asphalt cement in the particular mix.This will be either and additional payment to the vendor or a credit to the Town if the asphalt cement costidentified above is over or under the established base price. NYSDOT Standard Specifications NYSDOTAverage Posted Prices are available at: ttps://www.dot.ny.gov/main/business-center/contractors/construction-division/fuel-asphalt-steel-price-adjustments?nd=nysdot. The adjustment shall be made by taking theNYSDOT Average Posted Prices for Asphalt from the month the asphalt was installed and subtracting theNYSDOT Average Posted Prices for Asphalt from November 2025. The difference shall be multiplied bythe percent of asphalt in the asphalt used. For example if the current month index is 500, the adjustmentis calculated as follows (current month index $500 - reference month index $461)*percent asphalt 6.2% /100 = $2.42 increase.In requesting payment the vendor shall invoice the Town of Bedford for the number of tons at the bid price.An additional statement on the same invoice form will designate the adjustment based on the percentage ofasphalt cement in the particular mix. This will be either and additional payment to the vendor or a credit tothe Town if the asphalt cement cost identified above is over or under the established base price.The Base Documentation of the price of asphalt will be submitted with invoices.The 2026 Budget for the Town of Bedford, NY road resurfacing is approximately $1.1 million. This is anestimated expenditure and is not guaranteed. Quantities in Column D of the itemized bid submission4portion of this document are estimated for bid purposes and are also not guaranteed.
