REQUEST FOR PROPOSAL
Sealed proposal packages will be received by the City of Duluth (Owner) until 11:00 a.m. legally
prevailing time on January 15, 2026 for:
Bunten Road Park Improvement Project
Proposal packages will be formally opened and the total bid from the bid form will be read aloud
at 11:01a.m. legally prevailing time on January 15, 2026, in the second-floor executive
conference room of Duluth City Hall, located at 3167 Main Street, Duluth, GA 30096.
THIS WILL BE A PACKAGE OPENING AND BID READING ONLY. No determination as to the most
qualified or highest-ranking proposal will be made until a thorough evaluation has been completed
by the City of Duluth’s evaluation team, and the evaluation team’s recommendation is approved
by City Council.
For purposes of this Request for Proposal (RFP), the terms “Proposer”, “Bidder”, and “Contractor”
will be used interchangeably, and are intended to refer to the entity submitting the proposal
package.
Contractor shall provide one (1) original and three (3) copies of the complete submittal package,
along with one (1) complete digital version in PDF format on a flash drive. All five (5) items must
be submitted in a sealed package, addressed to City of Duluth (OWNER). Each sealed package
containing the five (5) items must be plainly marked on the outside as follows:

Submittal packages shall include the following completed items:
o Written Project Approach, including staging, and scheduling (max 4 pages )
o Corporate Certificate
o Surety Requirements Acknowledgement
o Bid Bond
o Oath of Bidder
o Statement of Bidder Qualifications
o Contractor E-Verify Affidavit
o Resumes and References as described below
o Subcontractor List and Past Experience
o Acknowledgment of any Addenda
o Bid Form (including schedule of items with unit price for each item and all quantities
verified)

Failure to include any of the above items fully complete and executed may result in your package
being declared as “non-responsive” and disqualify you from further consideration.
If submittal is forwarded by mail or delivery service, the sealed package containing the one (1)
original, three (3) copies, and one (1) digital version listed above must be enclosed in another
internal package to the attention of OWNER at the address previously given. If, for example, your
FedEx box is opened and the submittal is not in a sealed package within the FedEx box, it may
be declared non-responsive and disqualified from consideration. Submittal packages must be
sealed to maintain their integrity prior to the formal opening.
Submittal packages received without the aforementioned criteria enclosed may be returned to
Contractor. Submittal packages received after said time and date will be marked late and not
opened. No extension of the proposal period will be made.
The Instructions to Proposers, Bid Information, Evaluation Criteria, Forms, Project Manual,
Specifications, Drawings, Bid Bond, Performance and Labor & Material Payment Bond
requirements and other Documents related to the bidding and construction of the Work of this
Project may be obtained via the following:
Project plans and specifications for the “Bunten Road Park Improvement Project” will be
available electronically at no charge via the Georgia State Procurement Registry and the
City’s website at:

PACKAGES MUST BE SUBMITTED IN RESPONSE TO THE PROJECT IN ITS ENTIRETY. NO PARTIAL
SUBMITTALS WILL BE ACCEPTED.
The City of Duluth and the Georgia Procurement Registry are the only official sources for this
invitation or any addenda that may be issued for same. The City of Duluth will not be held
responsible for errors or omissions in submittal packages.
The written bid within the Contractor’s submittal package will include the furnishing of all labor,
materials, equipment, and all items necessary pursuant to Drawings, Specifications and Conditions,
etc., for construction of Bunten Road Park Improvement Project (hereinafter referred to as the
Project).
Proposed Project Location:
3180 Bunten Road
Duluth, Georgia 30096
Scope of Work:
This project consists of newly constructed and refurbished park elements within the Bunten Road
Park site, as well as a new sidewalk extending from the park entrance north along Bunten Road,
approximately 267’ beyond the intersection with Parcview Run Cove NW, to tie into existing
sidewalk. Work inside the park includes, but is not limited to: new and repaved asphalt multi-
use trails; pre-cast concrete retaining walls; custom handrails; a pre-fabricated bridge crossing;
concrete walks, ADA ramps, and pedestrian plaza areas; repaving of paved driveways and
parking areas; realignment, regrading, and paving of drive aisles and ADA parking; renovation of
a restroom facility, enhancements to storm water structures; addition of green infrastructure and
enhanced swales; new dam installations; streambank restoration and slope stabilization;
installation of chain link fencing; general landscape improvements; and other items as shown in

the plans and specifications. The project is expected to start in late March, 2026. Access to
the sections of the park that are not under construction will need to remain open to the public.
Add Alternate #1 – Stream Restoration and Pond Improvements: Included within
the summary of project scope described above, the Add Alternate includes all work
associated with stream restoration, pond improvements, and dam replacement as shown
on the Drawings. Work includes, but is not limited to, removal of existing stone and
structural dam components; construction of new earthen dams; related grading,
stabilization, and outlet control features; installation of rip rap and river cobble/boulder
overflows; and all associated landscape, erosion control, and site restoration work. A new
pre-fabricated bridge crossing and all-weather trail maintenance are also included in this
Add Alternate.
Add-Alternate #1 Permitting Requirements: The Add-Alternate portion of the project
includes work that is subject to environmental permitting by the Georgia Environmental
Protection Division (GA EPD) and the U.S. Army Corps of Engineers (USACE). These permits
have been submitted and remain pending at the time of this advertisement.
The Owner reserves the right to proceed with the Base Bid work while permitting is
underway. Bidders are advised of the following:
Contingency: Award and/or construction of the Add-Alternate is contingent upon
receipt of all required permits. The scope, limits, or methods of this work may be
modified based on agency comments or permitting outcomes.
Scheduling & Staging: The Contractor shall account for the possibility of delayed
Notice to Proceed for the Add-Alternate items. The Base Bid work may proceed
independently.
Change Order Potential: If permits are not approved or require modification of
the Add-Alternate work, the Owner may issue a Change Order to remove or revise
a portion of the Contractor’s scope. Bidders shall include any costs associated with
this potential adjustment in their bid pricing.
No Claim for Delays: The Contractor shall not be entitled to additional
compensation for delays related solely to the timing of GA EPD or USACE permit
approvals.
Add Alternate #2 – New Sidewalk along Bunten Road: Included within the summary
of project scope described above, Add Alternate #2 includes all work associated with a
portion of the new sidewalk extending from the property line at the northwest corner north
along Bunten Road, approximately 213’ beyond the intersection with Parcview Run Cove
NW, to tie into existing sidewalk.
Add-Alternate #2 Driveway Easement Requirements: Add-Alternate #2 includes
sidewalk improvements along Bunten Road that require new driveway easements from
adjacent property owners. These easements have not yet been acquired, and their timing
may affect when this work can begin.
Contingency: Construction of Add-Alternate #2 is contingent upon obtaining the

necessary easements. The scope or limits of this work may be adjusted based on final
easement boundaries.
Scheduling & Staging: The Contractor shall anticipate a possible delayed Notice to
Proceed for this Add-Alternate. Base Bid work may proceed independently.
Change Order Potential: If easements cannot be secured, or if boundaries change, the
Owner may issue a Change Order to revise or remove this Add-Alternate. Bidders shall
account for this possibility in their pricing.
No Delay Claims: The Contractor shall not be entitled to additional compensation for
delays related solely to easement acquisition.
Vendor Collaboration Requirement: The selected contractor shall be required to work
collaboratively with other vendors, contractors, and/or service providers engaged as part of the
wayfinding portion of the park improvements. This collaboration includes, but is not limited to:
A. Coordination of Efforts: Coordinating joint planning, scheduling, and execution of tasks
to ensure seamless integration and timely project completion.
B. Information Sharing: Sharing relevant project data, documentation, and updates in a
timely and transparent manner to facilitate effective communication and decision-
making.
C. Problem Resolution: Cooperating to identify, address, and resolve issues or conflicts
that may arise during the project lifecycle.
The selected vendors for the wayfinding portion of the park improvements will be independent
contractors of the City. Failure to collaborate effectively with other vendors or adhere to these
requirements may result in penalties, contract termination, or other remedies as deemed
appropriate by the City.
Vendors are encouraged to demonstrate their experience with cross-vendor collaboration in their
written understanding of the project.
Contractor Experience Requirements:
1. The Contractor maintains a permanent place of business.
2. The Contractor has operated under the current corporate name for at least the last five
(5) years.
3. The Contractor currently has sufficient bonding capacity to provide performance and
payment bonds, both in the amount of 100 percent of the contract amount.
4. The Contractor has not defaulted on a project or failed to complete a project within the last
ten years.
5. The Contractor has not filed for bankruptcy nor been judged bankrupt at any time over the
last ten years.
6. The Contractor has a history of completing projects consistently on time and within the bid
amount.
7. The Contractor does not have a history of being involved in litigation or filing claims against
Owners, Construction Contract Administration Firms, or Design Firms.

8. The Contractor has available at least two project management personnel with at least five
years’ experience on projects with the technical characteristics required of a project of
similar scope. One of these project management personnel must be the Project
Superintendent and must be on the jobsite at all times during construction. Documentation
of this experience must be provided with the proposal package, including resumes of the
two project management personnel and a list of at least 3 similar projects completed by
the contractor with project name, description, and reference contact information.
9. The onsite project management personnel shall be fluent in the English language.
10. The Contractor, nor any of its affiliated companies, is not currently involved in a dispute,
formal claim, or litigation with the OWNER, or with any authority or organization with
which the City of Duluth (OWNER) has a vested interest.
11. The Contractor has a written Quality Control/Quality Assurance Program. Proof required.
12. The Contractor has a written Safety Program. Proof required.
Project Schedule:
Contractor understands that time is of the essence for completion of the project, and, because
damages will be difficult to ascertain, the parties shall include a provision in the Contract agreeing
that liquidated damages in the amount of five-hundred-dollars ($500) per calendar day shall be
paid by Contractor for each day that Contractor is in default of completing the work within the
agreed-upon timeframe. This timeframe will be proposed by the contractor in his proposal,
evaluated by the City and included in the contract. The timeframe may not exceed 360
days. Completion of the work includes successfully passing any required punch-list inspection
by the designer or owner.
The successful bidder shall commence work with an adequate force and equipment on a date to
be specified in a written order by the Owner (Anticipated Notice to Proceed late March. 2026)
and shall complete the work within the allotted schedule. Payment will be made to the contractor
each calendar month based on the estimated work complete and in place as prescribed by the
standard specifications. Retainage as prescribed by the standard specifications will be withheld.
Final payment of amount withheld will not be made until the work has been satisfactorily
completed and accepted by Owner.
Bid Information:
A mandatory pre-proposal meeting will be held at Bunten Road Park, 3180 Bunten Road,
Duluth, GA 30096 on Thursday, December 18, 2025, at11:00a.m. local prevailing time. This
meeting is mandatory, and interested bidders must attend.
A City representative will be present on site throughout the duration of the meeting to record and
respond to questions or requests for clarification.
All addenda will be issued on the State procurement Registry and on the City’s website at
https://duluthga.net/business/bid_opportunities.php
The City will assume no responsibility for representations or understandings concerning conditions made
by its officers or employees unless included in this Request for Proposal and addenda.
A Bid Bond in the amount of not less than 5% of the total amount of the base bid must be
submitted with each bid made payable to the City of Duluth. Failure to supply bond will force
