Box 2412, Opelika, AL 36803-2412 until 10:00 AM on April 15th, 2026 and at that timepublicly opened at the Lee County Courthouse, 215 S. 9th Street, Opelika, AL 36801, for the furnishingand installation of Traffic Stripe and Pavement Markers on various public roads in Lee County, AL.The Entire Project Shall Be Completed In one-hundred and eighty (180) Calendar Days.Plans and Proposals are available online athttp://www.leeco.us/business/commission_office/current_bids.php, or at the Lee County HighwayDepartment (ph. 334-737-7011), 2555 Society Hill Road, Opelika, AL 36804. A Bidding Proposal maybe purchased for $5.00. Plans may be purchased for $2.00 per set. Checks should be made payable tothe Lee County Commission. Plans and Proposals will be mailed only upon receipt of remittance.Cashier's check or bid bond for 5% of bid (maximum - $10,000.00) made payable to the Lee CountyCommission must accompany each bid as evidence of good faith.The bracket range is shown only to provide general financial information to contractors and bondingcompanies concerning the project's complexity and size. This Bracket should not be used in preparinga bid.The bracket estimate on this project is from $283,046.27 to $345,945.44.The bidder's proposal must be submitted on the complete original proposal furnished him or her by theLee County Commission. Prequalification is not required.The right to reject any or all bids is reserved.Ala. Code § 39-3-5 applies to this project. In accordance with Ala. Code § 39-3-5(a), “…. preferenceshall be given to resident contractors, and a nonresident bidder domiciled in a state having laws grantingpreference to local contractors shall be awarded Alabama public contracts only on the same basis as thenonresident bidder's state awards contracts to Alabama contractors bidding under similar circumstances;and resident contractors in Alabama, as defined in Section 39-2-12, be they corporate, individuals, orpartnerships, are to be granted preference over nonresidents in awarding of contracts in the samemanner and to the same extent as provided by the laws of the state of domicile of the nonresident.”As a condition for award, the business entity and its subcontractors shall not knowingly employ or hirean unauthorized alien within the State of Alabama. The awarded business entity must providedocumentation of enrollment in the E-Verify program. Notice shall be given duringnormal hours of operation of the Lee County Highway Department.2.0 TRAFFIC CONTROLThe Contractor shall furnish all temporary traffic control necessary to provide for thesafety of the public and construction crews and to safeguard the integrity of the constructionbeing performed. The Traffic Control Plan shall be designed and executed in accordance with theManual of Uniform Traffic Control Devices (MUTCD Latest Edition). Any signing or other trafficcontrol devices deemed necessary by the County Engineer or his designee, shall be furnished bythe contractor.3.0 FINAL AUTHORITYThe standard specifications referenced herein may be altered by the Lee County Engineerat his discretion. The project shall be constructed under the instructions of the Lee CountyEngineer, which shall cover all phases of workmanship and materials, as final authority.4.0 INSURANCEUnless otherwise required by Special Conditions of this Invitation to Bid, if a contract isawarded, the successful bidder will be required to purchase and maintain during the life of thecontract, Comprehensive General Liability insurance, Comprehensive Automobile Liabilityinsurance, and Workman’s Compensation insurance with limits of not less than those set forthbelow.4.1 COMPREHENSIVE GENERAL LIABILITY INSURANCEComprehensive General Liability Insurance; Liability limits of a minimum of$1,000,000.00 each occurrence and $1,000,000.00 aggregate.4.2 COMPREHENSIVE AUTOMOBILE LIABILITY INSURANCEComprehensive Automobile Liability Insurance: Liability limit of a minimum$1,000,000.00 any one accident.4.3 WORKMAN’S COMPENSATION INSURANCEWorkman’s Compensation Insurance: Statutory coverage.4.4 CERTIFICATES OF INSURANCEThe bidder shall provide the County with Certificates of Insurance evidencing thecoverage required above. Such certificates shall provide that the County be given at least 30days’ prior written notice of any cancellation of, intention to not renew, or material change insuch coverage.Page 3 of 84.5 REQUIREMENTS NOT INTENDED TO RELIEVE BIDDER OF OTHER RESPONSIBLITIES OROBLIGATIONSThe providing of any insurance required herein does not relieve the bidder of any of theresponsibilities or obligations assumed by the bidder in the contract awarded or for which thebidder may be liable by law or otherwise.4.6 FAILURE TO PROVIDE INSURANCEFailure to provide and continue in force such insurance as required above shall bedeemed a material breach of the contract and shall operate as an immediate terminationthereof.4.7 LICENSESIt shall be the Bidder’s responsibility to possess all proper City, County, State andFederal Licenses and shall familiarize himself/ herself and comply with all City Ordinances,County Resolutions, State Laws and Federal Laws.5.0 E-VERIFY PROGRAMAla. Code § 31-13-9 requires that all contracts or agreements to which the state, a politicalsubdivision, or state-funded entity are a party shall include the following clause: "By signing thiscontract, the contracting parties affirm, for the duration of the agreement, that they will notviolate federal immigration law or knowingly employ, hire for employment, or continue toemploy an unauthorized alien within the State of Alabama. Furthermore, a contracting partyfound to be in violation of this provision shall be deemed in breach of the agreement and shallbe responsible for all damages resulting therefrom."Also, the awarded business entity must provide documentation of enrollment in the E-Verifyprogram. The business must participate in the E-Verify program for the length of the contract.6.0 DOMESTIC PRODUCTSAla. Code § 39-3-1 requires that the person, firm, or corporation undertaking the projectagrees to use in the execution of the contract materials, supplies, and products manufactured,mined, processed, or otherwise produced in the United States or its territories, if the same areavailable at reasonable and competitive prices and are not contrary to any sole sourcespecification implemented under Ala. Code § 39-2-2(f).In the event the contractor breaches the agreement to use domestic products, and domesticproducts are not used, there shall be a downward adjustment in the contract price equal to anyrealized savings or benefits to the contractor.7.0 CERTIFICATION OF MATERIALS USEDUpon completion of the project the Contactor shall furnish Lee County a certification thatall materials used on the project met the requirements of the plans and specifications of thecontract.Page 4 of 8
