No electronic or fax bids will be accepted.Each bid shall be accompanied by bid security equal to five percent of the amount of the bid, whichshall be forfeited to the EDA in the event the successful bidder fails to enter into a contract, providethe required insurance or to furnish performance or payment bonds. The bid security shall be a bidbond issued by a surety company authorized to do business in the State of Minnesota and acceptableto the EDA, or a certified check or cashier’s check from a federally insured bank, payable to“Economic Development Authority of the City of Brooklyn Park.”Any prime contractor or subcontractor that does not meet the minimum criteria established for a“responsible contractor” as defined in Minnesota Statutes Section 16C.285, subdivision 3 or fails toverify that it meets those criteria is not a responsible contractor and is not eligible to be awarded acontract for the project or to perform work on the project. A false statement under oath verifyingcompliance with any of the minimum criteria shall make the prime contractor or subcontractor thatmakes the false statement ineligible to be awarded the project and may result in termination of thecontract awarded to a prime contractor or subcontractor that submits a false statement. A primecontractor shall submit to the EDA, upon request, copies of the signed verifications of compliancefrom all subcontractors.If awarded the contract, the bidder will be required to execute and deliver payment and performancebonds, each for an amount no less than the total estimated amount of the contract and evidence of allrequired insurance. The bidder will also be required to enter into a contract with the EDA. Therequired terms of the contract are set forth in the Bidding Documents – BidderQualifications/Instructions and Specifications. The EDA’s prevailing wage rates apply according to theCity Code, Chapter 42.The EDA reserves the right to reject any or all bids and to waive any irregularities and informalitiestherein and to award the contract to other than the lowest bidder if, in its discretion, the interests ofthe EDA would be best served thereby.The bids will be opened and read aloud at the Brooklyn Park City Hall, Room A201, on Tuesday,June 30, 2026, immediately after the time noted above for submitting bids.
