Bidding documents have been prepared by TranSystems. Plans and specifications have been prepared by TranSystems. The bid documents, plans and specifications may be examined and obtained from the public works office for the City of Independence.
The Owner reserves the right to waive any informalities or minor defects and to reject any or all bids and to readvertise and rebid and/or negotiate with any or all bidders.
No bidder may withdraw his bid within (60) days after the actual date of the opening thereof.

Each BID must be submitted in a sealed envelope, addressed to. 120 N 6thStreet, Independence, Kansas, 67031Each sealed envelope containing a BID must be plainly marked on the outside as BID FOR:Storage Tank for Secondary Containmentand the envelope should bear on the outside the name of the BIDDER, his address, his license number, ifapplicable, and the name of the project for which the BID is submitted. If forwarded by mail, the sealed envelopecontaining the Bid must be enclosed in another envelope addressed to City Clerk, City Hall, 811 West Laurel St,Independence, Kansas, 67301.All BIDS must be made on the required BID form. All blank spaces for BID prices must be filled in, in inkor typewritten, and the BID form must be fully completed and executed when submitted. Only one copy of theBID form is required.The BIDDER shall submit a completed Contractors Qualification form with their bid.The OWNER may waive any informalities or minor defects or reject all BIDS. Any BID may be withdrawnprior to the above scheduled time for the opening of BIDS or authorized postponement thereof. Any BID receivedafter the time and date specified shall not be considered. No BIDDER may withdraw a BID within 60 calendardays after the actual date of the opening thereof. Should there be reasons why the contract cannot be awardedwithin the specified period, the time may be extended by mutual agreement between the OWNER and theBIDDER.BIDDERS must satisfy themselves of the accuracy of the estimated quantities in the BID schedule byexamination of the site and review of the drawings and specifications, including any ADDENDA. After BIDShave been submitted, the BIDDER shall not assert that there was a misunderstanding concerning the quantities, thenature of the WORK to be performed, or the extent of responsibilities and risks to be assumed in that performance.The OWNER shall provide to the BIDDERS prior to BIDDING, all information which is pertinent to, anddelineates and describes, the land owned, and rights-of-way acquired or to be acquired.The CONTRACT DOCUMENTS contain the provisions required for the construction of the PROJECT.Information obtained from an officer, agent or employee of the OWNER or any other person shall not affect therisks or obligations assumed by the CONTRACTOR or relieve him from fulfilling any of the conditions of thecontract.The OWNER, within fourteen (14) days, exclusive of Sundays and holidays, of the receipt ofacceptable INSURANCE CERTIFICATES, and Agreement signed by the party to whom the Agreement wasawarded, shall sign the Agreement, and return to such party an executed duplicate of the Agreement. Should theOWNER not execute the Agreement within such period, the BIDDER may, by WRITTEN NOTICE, withdraw hissigned Agreement. Such notice of withdrawal shall be effective upon receipt of the Notice by the OWNER.NOTICE TO PROCEED shall be issued within THIRTY (30) days of the execution of the Agreement bythe OWNER. Should there be reasons why the NOTICE TO PROCEED cannot be issued within such period, thetime may be extended by mutual agreement between the OWNER and CONTRACTOR. If the NOTICE TOPROCEED has not been issued within the thirty (30) day period or within the period mutually agreed upon, theCONTRACTOR may terminate the Agreement without further liability on the part of either party.The OWNER may make such investigations as he deems necessary to determine the ability of the BIDDERto perform the work, and the BIDDER shall furnish to the OWNER all such information and data for this purposeas the OWNER may request. The OWNER reserves the right to reject any BID if the evidence submitted by, orinvestigation of, such BIDDER fails to satisfy the OWNER that such BIDDER is properly qualified to carry outthe obligations of the Agreement and to complete the work contemplated therein.A conditional, or qualified BID, or tied Bids will not be accepted.The BIDDER submitting the lowest TOTAL BID AMOUNT will be designated Apparent Low Bidder.Contract will be awarded to the lowest responsive responsible Bidder based on the lowest Total Bid Amount andhaving provided the necessary Bid Schedule, and other Bid Documents. The Total Bid Amount shall bedetermined by the summation of the Extended Totals for each bid item. Extended totals shall be determined by theItem Bid price written in words for lump sum bid items and the Item Bid price written in words multiplied by thenumber of units for the unit bid items. In all instances, the Item Bid price written in words shall take precedenceover other prices written either in words or numerals. Bids received without Item Bid Prices written in words willbe adjudged non-responsive.All applicable laws, ordinances and the rules and regulations of all authorities having jurisdiction overconstruction of the PROJECT shall apply to the contract throughout.The low BIDDER shall supply the names and addresses of major material SUPPLIERS ANDSUBCONTRACTORS when requested to do so by the OWNER.The ENGINEER is TranSystems, 115 South 6th Street, Suite B, Independence, Kansas, 67301.
