Each bid shall beaccompanied by a certified check, bank money order, or a Bid Bond in an amount not less than 10 percent ofthe Bid total, payable to the Borough in accordance with the Instructions to Bidders. Laws and regulationsapplicable to this Contract include the Commonwealth of Pennsylvania “Steel Products Procurement Act” – ActNo. 3 of 1978 as amended; and the Pennsylvania Prevailing Wage Act (Act of 1961), P.L. 987, No. 442).Bidders are subject to all applicable provisions of the Pennsylvania wage laws, and bids shall be preparedaccordingly.Specifications and bid forms may be obtained at no cost from the offices of the Borough of Carlisle at the addressabove from 8:00 a.m. to 4:00 p.m., Monday through Friday, except holidays. The successful bidder will berequired to post a performance bond in the amount of one hundred percent (100 %) of the bid price.All contractors on this Project are required to ensure that employees and applicants will not be discriminatedagainst because of race, creed, color, religion, sex, age, handicap, marital status or national originals; and, thatthe statutes and regulations of federal and state law regarding non-discrimination are met.A non-mandatory pre-bid meeting will be held at 1:00 p.m., prevailing time, March 6, 2026, at the Owner’soffice, located at 53 West South Street, Carlisle, PA 17013, with a site visit following the meeting. Allprospective bidders are encouraged to attend.Bid Proposals will be opened at 1:30 p.m. on March 20, 2026 at the offices of the Borough of Carlisle. Unlessall bids are rejected, the lowest responsible bidder may be selected at a public meeting of the Borough Councilto be held April 9, 2026 at 6:00 p.m. at the offices of the Borough of Carlisle noted above.Borough Council reserves the right to reject any or all bids or parts thereof and to waive any defects orirregularities in the best interest of the Borough.Borough of CarlisleSusan Armstrong, Borough Manager___________________Page 2 of 35INFORMATION AND INSTRUCTIONS TO BIDDERS1. All proposals must furnish services, products and/or materials in strict compliance with thosedimensions, quantities and other requirements as noted in the Specifications attached hereto. Underno circumstances will any products or materials be accepted that are different from or in substitutionof or for those items and components described in the Specifications.2. All bids shall be made upon the forms supplied by the Borough of Carlisle (the “Borough”) andmailed via U.S. Postal Service or recognized national currier service to “ATTN: BID BOC 3-26,Borough of Carlisle, 53 West South Street, Carlisle, PA 17013” or by hand delivery to the Officeof the Borough Manager at the above address with “ATTN: BID BOC 3-26” on the outer envelopeonly between the hours of 8:00 a.m. and 4:00 p.m. weekdays. Sealed bids shall be received in theOffice of the Borough Manager up to 1:30 p.m., prevailing time, March 20, 2026. The bid must beproperly sealed in an envelope and clearly marked with “BID BOC 3-26” on the bid envelope.The bid must include the complete set of Contract Documents with the completed, notarizednon-collusion affidavit, completed Employer Verification Form (if applicable), Bid Bond, andBid Proposal completed and containing original signatures.3. All bids shall give the proposed price both in words and figures and shall be signed by the Bidderwith full name and address. Where bidder is a partnership, the name and address of each partnershall be stated in full and, if a corporation, the state where incorporated.4. The Borough Council of the Borough of Carlisle reserves the right to reject any and all bids, toaccept or reject any part of a bid, to waive any informalities and minor irregularities in the bids andto annul any contract if, in its opinion, there shall be a failure at any time to perform faithfully anyof its terms.5. Bids which contain erasures, alterations, conditional bids, omissions or irregularities may berejected.6. The Borough of Carlisle will award the bid to the lowest responsible bidder (hereinafter called"successful bidder"). Responsible Bidder is defined as “in the reasonable discretion of the municipalofficials based upon considerations to include promptness, faithfulness and the capacity and abilityto do the work according to plans and specifications, measured by, among other things, the qualityof previous work, record of completing projects on time, history of payments to subcontractors andsuppliers, maintenance of permanent place of business, adequacy of equipment and plant to do thework, technical experience and whether the Bidder has a solid financial basis to guarantee contractcompletion.7. The successful bidder agrees, if selected, to furnish a performance bond, a payment bond, evidenceof required insurance and furnish the executed Agreement within 10 days of notice of intention ofaward by the Borough of Carlisle.Page 3 of 358. The successful bidder shall not assign its rights under the bid awarded, in whole or in part, withoutthe prior written approval of Borough Council, which permission can be withheld in Council’s solediscretion.9. All bids shall be accompanied by a bid bond in the same form attached hereto or certified checkmade payable to the Borough of Carlisle in the amount of ten percent (10%) of the bid. In the eventany bidder shall, within 10 days’ notice from the Borough of its intention to award the contract, failto provide completed payment and performance bonds in the same forms provided in these ContractDocuments, evidence of required insurance and the executed Agreement, the bid security providedby that bidder by certified check or bid bond shall be forfeited to the Borough as liquidated damages.10. In accordance with the Pennsylvania Anti-bid Rigging Act that became law on October 23, 1983,the Borough requires each bidder to complete and return the Non-Collusion Affidavit. The Affidavitis to be completed as follows:a) This Non-Collusion Affidavit must be executed by the member, officer or employee of the bidderwho makes the final decision on prices and the amount quoted in the bid.b) Bid rigging and other efforts to restrain competition and the making of false sworn statements inconnection with the submission of bids are unlawful and may be subject to criminal prosecution.The person who signs the Affidavit should examine it carefully before signing and assurehimself/herself that each statement is true and accurate, making diligent inquiry as necessary, ofall other persons employed by or associated with the bidder with responsibilities for thepreparation, approval or submission of the bid.c) In the case of a bid submitted by a joint venture, each party to the venture must be identified inthe bid documents and an Affidavit must be submitted separately on behalf of each party.d) The term "complementary bid" as used in the Affidavit has the meaning commonly associatedwith that term in the bidding process and includes the knowing submission of bids higher thanthe bid of another firm, any intentionally high or noncompetitive bid and any other form of bidsubmitted for the purpose of giving a false appearance of competition.e) Failure to file an Affidavit in compliance with these instructions will result in disqualification ofthe bid.11. All specified services and delivery of any equipment, materials or products shall be delivered at thesuccessful bidder’s expense, free of any liens, encumbrances and security interests.12. The successful bidder is responsible for being familiar with and to know the location, means ofaccess and all other features and conditions necessary for the successful bidder to perform theservices specified herein. All costs and expenses of delivery of every kind, type or nature shall bethe responsibility of the successful bidder. The successful bidder, its agents or representative shallbe responsible for securing and properly delivering all items and components in accordance with allfederal, state and local laws, regulations, codes and ordinances. It is the responsibility of eachPage 4 of 35Bidder, before submitting a Bid, to visit the Project site to become familiar with local conditionsthat may affect cost and furnishing of the work. Contact Rebecca Lauver at 717-601-5962 toschedule a site visit. A bidder who has visited the site within the past two months need not visit thesite again before submitting a bid.13. Any bids received after the deadline by which they are to be received are late bids. Such late bidswill not be considered but will be held unopened until the time of award and then returned to thebidder. No responsibility will attach to the Borough of Carlisle for the premature opening of, or thefailure to open, a bid not properly addressed and identified. Bids may be withdrawn by writtenrequest received from the bidder prior to the time fixed for opening.14. If, after final payment and prior to the expiration of one year after the date of such final payment,any services performed or items supplied by the successful bidder are found to be defective, thesuccessful bidder shall promptly, without cost to the Borough, properly repair defective work orsupply the Borough with non-defective items. If the successful bidder fails to repair the defectivework or supply such items within 30 days’ notice, the Borough may supply such items at the cost ofthe successful bidder. The successful bidder will also be responsible for and pay all costs, fees andattorney fees incurred by the Borough if legal action is initiated against the successful bidder due tothe successful bidder’s failure to pay such costs and expenses upon demand by the Borough.15. The Notice, Information and Instruction to Bidders, Specifications, Non-Collusion Affidavit, BidProposal, Bid Bond or other bid security, Notice of Intent to Award, Notice To Proceed, Agreement,Performance Bond, Payment Bond shall constitute the “Contract Documents”, the terms of whichshall constitute a binding contract with the successful bidder.16. Nondiscrimination/Sexual Harassment.The successful bidder agrees:a) In the hiring of any employee(s) for the manufacture of supplies, performance of work, or anyother activity required under any contract with the Borough, the successful bidder, or anysubcontractor person acting on behalf of the successful bidder, shall not discriminate by or onthe basis of actual or perceived race, color, familial status, religious creed, ancestry, handicap ordisability, age, sex, sexual orientation, gender identity or expression, national origin, the use ofa guide or support animal because of the blindness, deafness or physical handicap of the user orbecause the user is a handler or trainer of support or guide animal or act in violation of thePennsylvania Human Relations Act (PHRA) and applicable federal laws, against any citizen ofthis Commonwealth who is qualified and available to perform the work to which theemployment relates.b) The successful bidder or any person on their behalf shall not in any manner discriminate byreason of actual or perceived race, color, familial status, religious creed, ancestry, handicap ordisability, age, sex, sexual orientation, gender identity or expression, national origin, the use ofa guide or support animal because of the blindness, deafness or physical handicap of the user orPage 5 of 35
