STATEMENT OF WORKA. SCOPEIt is the intent of these specifications, terms, and conditions to describe the securitypanels upgrade kits for East Bay Municipal Utility District (EBMUD) SCADA Engineering.East Bay Municipal Utility District (District) intends to award a contract to the lowestcost bidder(s) whose response meets the District’s requirements.The District intends to procure replacement hardware which include, but not limited to,the following: STAR Pro-to-iSTAR Ultra G2 SE Upgrade Kit, 16 Rdr (one Ultra G2 SE GCM,two Ultra G2 SE ACMs, and Ultra G2 SE panel door).B. BIDDER QUALIFICATIONS1. Bidder Minimum Qualificationsa. Bidder, bidder’s principal, or bidder’s staff shall have been regularlyengaged in the business of providing hardware for at least one (1) year.b. Bidder shall be a certified or authorized manufacturer, dealer, or provider.c. Bidder shall possess all permits, licenses, and professional credentialsnecessary to supply product and perform services as specified under thisRFQ.C. SPECIFIC REQUIREMENTSAll products shall be in new and unused condition and shall be of the most current andup to date model.The District shall be procuring the following hardware:1. Description of HardwareManufacturer:Model:Series:Includes:Software HouseGSTAR-PRO-SE16iSTAR Pro-to-iSTAR Ultra G2 SE Upgrade Kit, 16 reader support• One Ultra G2 GCM• Two Ultra G2 ACM SE• One Panel doorRFQ No. 2612Page 3SECURITY CONTROL PANEL UPGRADE PROJECT2. Product DeliveryUpon notification and approval from the District, partial shipment for thehardware components may be permitted.D. DELIVERABLES/REPORTSContractor shall provide Buyer (District) with a copy of the End User license agreementand shall warrant that all manufacturer software is licensed originally to Buyer (District)as the original licensee authorized to sue the Manufacturer Software.Equipment shall be delivered to:District’s Administrative Maintenance Central Warehouse1200 21st St. Oakland, CA 94607Contractor must provide a report to document the serial number of all the hardware.E. INSPECTIONThe District will inspect material after its arrival at the delivery point, which consist ofphysical inspection of hardware exterior, powering up each unit to confirm units bootup in factory default settings. Components not to the operating satisfaction of theDistrict may be rejected. Contractor is solely responsible for ensuring the materialarrives at the District’s ship-to location free of defects and manufactured in strictconformance with the specifications.In the case that two (2) or more of the components are faulty, the item and/or lot willbe rejected. District Inspectors will provide Contractor and the EBMUD PurchasingDivision with an Inspectors Report which will itemize the product deficiencies andrequired corrective action.The District reserves the right-of-access to the Contractor’s facility to verifyconformance to this specification at the District’s expense.F. FAILURE TO MEET SPECIFICATIONSIn the event any shipment or shipments of a Contractor’s product do not meet thespecification or delivery requirements, the District may reject the shipment orshipments and, at its option, may purchase this material from any supplier in the openmarket who can meet the District’s specification requirements, or the District maydemand immediate replacement by Contractor of the non-conforming product. Anycosts over and above the original contract price will be charged back to the Contractor.In addition, Contractor shall bear the costs of removal and disposition for any deliverywhich fails to conform to the specifications.RFQ No. 2612Page 4SECURITY CONTROL PANEL UPGRADE PROJECTII. Hard copiesof addenda will not be mailed out.III. DISTRICT PROCEDURES, TERMS, AND CONDITIONSA. RFQ ACCEPTANCE AND AWARD1. RFQ responses will be evaluated to determine that they are responsive,responsible, and that they meet the specifications as stated in this RFQ.2. The District reserves the right to award to a single or to multiple Contractors,dependent upon what provides the lowest overall cost to the District.3. The District has the right to decline to award this contract or any part of it for anyreason.4. Any specifications, terms, or conditions, issued by the District, or those includedin the bidder’s submission, in relation to this RFQ, may be incorporated into anypurchase order or contract that may be awarded as a result of this RFQ.5. Award of contract. The District reserves the right to reject or rebid any or allproposals, to accept one part of a proposal and reject the other, unless thebidder stipulates to the contrary, and to waive minor technical defects andadministrative errors, as the interest of the District may require.
