PHASE 1 DISTRIBUTION SYSTEM IMPROVEMENTS
General Notice
Charter Oaks Village Cooperative (Owner) is requesting Bids for the construction of the following Project:
Phase 1 Distribution System Improvements
Bids for the construction of the Project will be received at DuBois & King’s Laconia office located at 208
Union Avenue Laconia, NH 03246, until Monday, June 8, 2026 at 11:00 am local time. At that time the
Bids received will be publicly opened and read.
The Project includes the following Work:
Construction of new water distribution piping, service corporation stops, fittings and
appurtenances, installation of Above-Ground Storage Tanks (ASTs) complete with required
secondary containment systems, surface restoration, and associated water distribution
infrastructure.
Bids are requested for the following Contract: Charter Oaks Phase 1 Distribution Improvements
Owner expects that the Project’s construction schedule will be completed no later than by December 1,
2026.
Each BID must be accompanied by a certified check payable to the OWNER for five percent (5%) of the
total amount of the BID. A BID BOND may be used in lieu of a certified check.

2. If Hard Copies are wanted: Please contact the Issuing Office Contact identified above to discuss
the details of this method and to confirm cost.
The date that the Bidding Documents are transmitted by the Issuing Office will be considered the
prospective Bidder’s date of receipt of the Bidding Documents. Partial sets of Bidding Documents will not

be available from the Issuing Office. Only Bid Documents obtained from DuBois & King, Inc. (Website or
Issuing Office) shall be used for submitting a Bid. Neither Owner nor Engineer will be responsible for full
or partial sets of Bidding Documents, including Addenda if any, obtained from sources other than the
Issuing Office.
IMPORTANT
Any change to the Bidding Documents during the bid period will be made via addenda and posted at
www.dubois-king.com/projects-bidding-active. The prospective Bidder is responsible for checking the
web site as required to obtain any/all addenda that may be issued. The Issuing Office is NOT responsible
for notifying prospective Bidders when addenda are posted. This responsibility lies with the prospective
Bidder.
Any CONTRACT or CONTRACTS awarded under this Invitation for BIDS are expected to be funded in part
by a grant from the United States Environmental Protection Agency. Neither the United States nor any of
its departments, agencies or employees are or will be a part to the Invitation for BIDS or any resulting
contract. This contract is subject to all applicable and/or relevant Federal procurement guidelines
pertaining to Grants and Cooperative Agreements with State and Local Governments.
Pre-bid Conference
A pre-bid conference for the Project will be held on Wednesday, May 13, 2026 at 10:30 am at Charter
Oaks Village Cooperative, 31 Allen Road, Arundel, Maine 04046. Attendees should meet at the large
pump house building. Attendance at the pre-bid conference is encouraged but not required.
Instructions to Bidders
A Bid Guarantee equal to five percent of the Bid is to be submitted with each bid, and Performance and
Payment Bonds will be required for 100% of the contract price.
Bidder shall comply with Disadvantaged Business Enterprises (DBE) requirements.
Bidder shall comply with Build America, Buy America (BABA) requirements.
Davis-Bacon wage rates shall apply.
Bidder must comply the Department of Labor Regulations relating to Copeland Anti-Kickback Act (18
U.S.C. 874) as supplemented by 29 CFR part 3, Contract Work Hours and Safety Standards Act (40 U.S.C.
327-330) as supplemented by 29 CFR part 5, Occupational Safety and Health Standards (OSHA) (29 CFR
part 1910). The CONTRACTOR must comply with all applicable standards, orders, or requirements
issued under section 306 of the Clean Air Act (42 U.S. C. 1857(h)), section 508 of the Clean Water Act (33
U.S. C. 1368), Safe Drinking Water Act, Executive Order 11738, and the Environmental Protection Agency
Regulations (40 CFR Part 15). The CONTRACTOR must comply with Section 13 o the Federal Water
Pollution Control Act Amendments of 1972, Section 504 of the Rehabilitation Act of 1964, Title VI of the
Civil Rights Act of 1964, the Age Discrimination Act of 1975, and the Uniform Relocation and Real
Property Acquisition Policies Act. Section 3 of the Housing and Urban Development Act of 1968 (24 CFR
Part 75), requiring that to the greatest extent feasible, economic opportunities be directed to low- and
very low-income persons.

This project is funded in part through the Maine Drinking Water State Revolving Fund and the HUD PRICE
Grant Program (Grant #B-23-PR-25.0002). Consequently, the following provisions apply to this WORK
(more detail for each of these provisions can be found in Instruction to Bidders):
1. Bid security in accordance with the Instructions to Bidders.
2. Disadvantaged Business Enterprise (DBE) requirements.
3. Performance BOND and Payment BOND each in the amount of 100% of the contract price.
4. ‘AIS’ (American Iron and Steel) provisions of P.L. 113-76, Consolidated Appropriations Act.
5. ‘BABA’ (Build America, Buy America Act) provisions of P.L. 117-58.
6. Federal Wage Rates as determined under the Davis-Bacon Act.
7. Federal nondiscrimination in employment and labor standards, including compliance with
Executive Order 11246.
8. Prohibition on Certain Telecommunications and Video Surveillance Services or Equipment.
9. Compliance with Section 3 of the Housing and Urban Development Act of 1968 (24 CFR Part 75).
