The Calhoun County Commission (sometimes herein referred to as"Commission") seeks bids for demolition, and/or clean-up, and disposal, as provided herein andin the Scope of Work for Demolition/removal of Nuisances, which is attached hereto, andincorporated herein by reference as if set forth herein in full, of the nuisances specified on theattached Exhibit C, Nuisance Property Descriptions and Locations.B. Please complete the Bid Cover Sheet for Nuisance Demolition/removal and put itas the first page of your bid followed by your bid bond or certified check in lieu of a bid bond, asherein provided. A copy of the Bid Cover Sheet for Nuisance Demolition/removal and Scope ofWork for Demolition/removal of Nuisances is attached to this Invitation to Bid.2. The Calhoun County Commission will until MAY 13,2026 at 2:00 P.M., CentralTime, receive competitive sealed bids from qualified contractors for the demolition/removal ofspecified items from properties that, by Resolution of the Calhoun County Commission, havebeen declared a “Public Nuisance”. A mandatory pre-bid conference for all contractorsbidding shall take place on MAY 5, 2026 at 2:00 P.M. in the Calhoun County 4HAUDITORIUM, located inside the Ken Joiner Calhoun County Administration Building,1702 Noble Street, Anniston, Alabama 36201. Contractors who fail to attend the mandatorypre-bid conference will not be allowed to bid on this contract.3. Sealed bids with the words "Public Nuisance Demolition/removal" on the outsidemust be submitted to the Calhoun County Commission, 1702 Noble Street, Suite 103, Anniston,Alabama 36201 no later than MAY 13,2026, at 2:00 PM. Central Time, at which the bids will beopened and read aloud in the Calhoun County Commission Meeting Room in the Ken JoinerCalhoun County Administration Building, 1702 Noble Street, Anniston, Alabama 36201.Questions and requests for additional information concerning this solicitation should be directedto Mr. Kraig Mize, Calhoun County Environmental Enforcement Officer, 1702 Noble Street,Ste.103, telephone number (256) 241-2943.4. Bid prices must be submitted under the condition of irrevocability for a period ofninety (90) days from when the bids are opened.5. A bid bond, in an amount equal to 5% of the amount of the Total Bid, as shown on theBid Cover Sheet, not to exceed $10,000.00, is required of each bidder submitting a bid. Acertified check made payable to the Calhoun County Commission is acceptable in lieu of a bidbond. The bid bond, or certified check as herein required, shall be submitted in the envelopecontaining the bid. The bid bonds and certified checks will be returned to the bidders uponaward of the contract to each successful bidder and entry into a contract between each successfulbidder and the County, unless otherwise required by law.FAILURE TO SUBMIT A BID BOND OR CERTIFIED CHECK IN LIEU OF A BIDBOND, AS HEREIN REQUIRED, WILL CAUSE YOUR BID TO BE REJECTED. IF ABIDDER SUBMITS A BID BOND AND THE BID BOND IS NOT EXECUTED BY THEPRINCIPAL AND THE SURETY THE BIDDER’S BID WILL BE REJECTED.6. Bids sent, delivered or communicated by facsimile transmission, e-mail,telephone or telegram will not be accepted.7. Before commencing work the selected bidder (sometimes herein referred to as"Contractor") will be required to submit a properly completed and executed Internal RevenueService Form W-9, and to have a properly prepared and executed purchase order for the work thebidder is selected to perform.8. The Commission reserves the right to reject any and all bids, to consider,judge, and, to the fullest extent allowed by law, select a bid other than based on price alone,and to waive technical requirements if in the judgment of the Commission such best servesthe interests of Calhoun County and its citizens.9. The selected bidder shall comply with all federal, state and local laws, rules andregulations applicable to the work and services solicited in this invitation for bids. Further, theenactment of any state or federal statute or the promulgation of regulations thereunder, afterexecution of a contract between the County and the successful bidder, shall be reviewed by theCounty and the successful bidder to determine whether compliance therewith is required.10. Bidders shall include in their bid a copy of bidder’s, City and/or Countybusiness license.11. A. Further, each selected bidder, agrees that, in consideration of a contractand as part of its obligations pursuant to a contract, the Contractor will have in full force andeffect, a policy or policies of insurance, at his/her/its own expense, of the following types, whichprovide at least the following amounts of coverage. Each selected Contractor shall deliver toCounty certificates of insurance from a duly qualified insurance agent qualified to do business inthe State of Alabama, issued by an insurance company or companies qualified to do business inthe State of Alabama, showing insurance of the following types, which provide at least thefollowing minimum amounts of coverage:1. Workers' Compensation Insurance -As prescribed by the Workers' Compensation Laws of the State of Alabama.2. General Liability Insurance -(A) Bodily injury liability: $500,000 each person, $1,000,000 each occurrence;and(B) Property damage liability $100,000 each occurrence, or, in lieu of (A) and(B);(C) Bodily injury and property damage $1,000,000 combined single limit; and3. Motor Vehicle Liability Insurance-The higher of the minimum limits of coverage required by law, and thefollowing:(A) Bodily injury liability: $500,000 each person, $1,000,000 each occurrence;and(B) Property damage liability $100,000 each occurrence, or in lieu of (A) and(B);(C) Bodily injury and property damage $1,000,000 combined single limit.B. Prior to commencement of work hereunder, each selected Contractor will have CalhounCounty and the Calhoun County Commission and Calhoun County’s officers, employees,servants, and agents and each of the Commission’s, Commissioners, officers, employees,servants, and agents named as additional named insureds under the policy or policies providingthe above required general liability insurance and motor vehicle liability insurance, and furnish acertificate or certificates of insurance to that effect as to the above-required insurance and theadditional named insureds as herein provided. The policies evidencing required insurance shallcontain an endorsement that cancellation or any material change in the policies adverselyaffecting the interests of Calhoun County (herein sometimes referred to as “County”) and/or theCounty Commission’s, Commissioners, officers, employees, servants and/or agents, and/or any orall of the County’s officers, employees, servants, and agents in such insurance shall not beeffective until thirty (30) days after written notice thereof is delivered to the Calhoun CountyCommission. The policy or, if more than one, policies of insurance shall provide primarycoverage for the County, the Commission, and the County’s officers, employees, servants andagents of County and/or the Commission, and shall provide coverage for any and all claims madefor or concerning any occurrence or event during performance by the Contractor of the contractawarded.12. Each Contractor shall indemnify and hold harmless the County, the Commission,and the County’s officers, employees, servants and agents of County and/or the Commission,from any and all claims, actions, proceedings, expenses, including, but not limited to, reasonableattorneys' fees, damages, and liabilities, arising in connection with the award, or in any wayconnected with or arising out of providing the services and/or work as specified in the contractawarded.13. Bidders should carefully examine the specifications, and fully inform themselvesas to all the conditions and matters, which can in any way affect the work or cost thereof. Shoulda bidder find discrepancies in or omissions from specifications or documents or should there beany doubt as to the meaning, the bidder should at once notify the Calhoun County EnvironmentalEnforcement Officer and obtain clarification prior to submitting a bid.14. Any entity who or which chooses to submit a “No Bid” is requested tocomplete “Part A” of the Bid Cover Sheet for Nuisance Demolition/removal and submit theBid Cover Sheet with the box at the bottom of the Bid Cover Sheet checked “Our companychooses not to submit a bid”.15. Alabama Immigration Law Compliance: Each selected bidder shall agree that itwill fully comply with the Immigration Reform and Control Act of 1986, as amended byImmigration Act of 1990 and the Beason-Hammon Alabama Taxpayer and Citizen ProtectionAct, as amended, which makes it unlawful for an employer in Alabama to knowingly hire orcontinue to employ an alien, who is or has become an unauthorized alien, who is employed towork in the State of Alabama. Without limiting the foregoing, the selected bidder shall notknowingly employ, hire for employment, or continue to employ an unauthorized alien, and shallhave an officer or other managerial employee who is personally familiar with the selectedbidder’s hiring practices to execute an affidavit to this effect on the form supplied by the Countyand return the same to the County. Each selected bidder shall also enroll in the E-Verify Programprior to performing work and shall remain enrolled throughout the entire course of thisperformance hereunder and shall attach to its affidavit the E-Verify Program for EmploymentVerification and Memorandum of Understanding and such other documentation as the Countymay require to confirm the selected bidder’s enrollment in the E-Verify Program. The selectedbidder agrees not to knowingly allow any of its subcontractors, or any other party with whom ithas a contract to perform any work in connection with the services, work, labor and suppliesprovided with this bid award, to employ in the State of Alabama any illegal or undocumentedaliens to perform any work in connection with the services, work, labor and supplies providedwith the bid award, and shall include in all of its contracts a provision substantially similar to thisparagraph. If the selected bidder receives actual knowledge of the unauthorized status of one ofits employees in the State of Alabama, it will remove that employee from the project, jobsite orpremises of the County and shall comply with the Immigration Reform and Control Act of 1986,as amended by the Immigration Act of 1990 and the Beason-Hammon Alabama Taxpayer andCitizen Protection Act, as amended. Each selected bidder shall require each of its subcontractors,or other parties with whom it has a contract to perform any work in connection with the services,work, labor and supplies provided with the bid award to act in a similar fashion. If a selectedbidder violates any term of this provision, the agreement awarded to the selected bidder will besubject to immediate termination by the County. To the fullest extent permitted by law, theselected bidder shall defend, indemnify and hold harmless the County and the CountyCommission from any and all losses, consequential damages expenses (including, but not limitedto, attorneys’ fees), claims suits, liabilities, fines, penalties, and any other costs arising out of or inany way related to a selected bidder’s failure to fulfill its obligations contained in this paragraph.The Contract or agreement with and each selected bidder shall contain the following: Bysigning this contract, the contracting parties affirm, for the duration of the agreement, that theywill not violate federal immigration law or knowingly employ, hire for employment, or continueto employ an unauthorized alien within the state of Alabama. Furthermore, a contracting partyfound to be in violation of this provision shall be deemed in breach of the agreement and shall beresponsible for all damages resulting therefrom.By signing this Contract, the contracting parties affirm, for the duration of thisagreement to remain in compliance with Act 2016-312, the Parties hereby agree that they are notcurrently engaged in, and will not engage in, the boycott of a person or an entity based in or doingbusiness with a jurisdiction with which this state can enjoy open trade.SCOPE OF WORKFORDEMOLITION/REMOVAL OF NUISANCES1. Contractors shall mobilize and begin work on their awarded property orproperties no later than (14) calendar days after the date of the Notice to Proceed/Purchase Orderand completed, inspected, and accepted by the Calhoun County Commission or its authorizedagent no later than ninety (90) calendar days from the date of the Notice to Proceed/PurchaseOrder. County will not pay for any work done prior to the date of a Notice to Proceed/PurchaseOrder. All demolition permits must be obtained prior to the start of work, if applicable.Safeguards, during demolition, shall be in accordance with the International Existing BuildingCode, 2005 edition, published by the International Code Congress. Contactor shall comply withall Governmental agencies’ rules and regulations applicable to demolition, handling, transportingand disposal of debris.2. Contractor shall remove all man-made items indicated as Public Nuisances,which are documented by resolution of the Calhoun County Commission and throughcoordination with the Environmental Enforcement Officer. These items include, but are notlimited to the following:A. Weeds on the property that have attained such large growth as to become a firemenace when dry, or which are otherwise noxious or dangerous:The Contractor shall clear and grub all high weeds on the site to approximate depth of four(4) inches below finish grade except for vegetation flagged to remain. The definition of clear andgrub is the demolition/removal of all vegetation and root systems to a depth of approximatelyfour (4) inches below finish grade, that has a trunk size too large to be mowed and maintained byhand propelled lawn mowers. Generally, this is any vegetation trunk with a diameter greater thanone-quarter (1/4) inch.Contractor shall evenly spread fine grade topsoil to be free of all debris with a dimensiongreater than three- quarter (3/4) inch in any direction and shall seed with grasses that willmaintain a quick cover growth and spread hay or other approved ground cover over all thedisturbed site to completely cover the topsoil.Contractor shall bring in clean suitable fill dirt as required to sculpture and blend in finishgrade contours so that the site connects to adjacent property lines with a smooth transition. Thefinish grade topsoil shall be a minimum of approximately two (2) inches of good quality soil tosustain commercial grade grass seed. The site once cleared of high weeds shall be sowed withcommercial grade grass seed that will promote a growth that can be easily maintained by a pushor riding lawn mower.Onsite soil shall not be removed in areas of possible environmental contamination asdetermined by local, state, and federal authorities. Coordination shall be effected with thefollowing organizations before demolition/removal of any onsite soils, United StatesEnvironmental Protection Agency, Alabama Department of Environmental Management,Environmental Enforcement Officer, Calhoun County, Alabama, and the Calhoun CountyLandfill.An accumulation of trash, rubbish, junk, or debris:The contactor shall remove any accumulated trash/rubbish as defined in §22-27-1 et. seq.,Code of Alabama 1975 and dispose of the trash, rubbish, or debris at a legally permitted landfill.
