There shall be nodeviations from the specifications or the intent of the specifications, except which are listed and which are expresslyapproved as part of the bid acceptance. The City reserves the absolute right in its obligation to the public, to accept thebest bid to serve the public interest.INSTRUCTIONS TO BIDDERSPreparation of Bid. Bid shall be made on the Bid Form included in this request for Bids. Bid information shall beentered into the appropriate space on the Bid Form. All costs of bid preparation are the expense of the bidder. Noelectronic, verbal, facsimile or telephone bid will be accepted.Examination of Bid Documents. The Bid Documents consist of this Request for Bid, and any addenda which may beissued. Submission of a bid shall constitute bidder’s acknowledgment upon which the City may rely that bidder hasthoroughly examined and is familiar with the Bid Documents. No claim for additional compensation will be allowedbeyond that stated in the bidder’s submitted Bid Form. Bids may be modified or withdrawn prior to the bid submission deadline. Bidsmodified must be retrieved by bidder, at bidder’s expense, and resubmitted with corrected information prior to the bidsubmission deadline. There will be no extensions for bid modification beyond the bid submission deadline.Late Bids. Bidder shall be responsible for the timely delivery of bid. Bids received after the deadline for receipt of bidsshall not be accepted and shall be returned to the bidder unopened unless necessary for identification purposes.Bid to Remain Open. The bidder shall guarantee its bid for a period of ninety (90) calendar days from the date of bidopening.Contract Award. Contract award will be made to the lowest responsive and responsible bidder(s). The acceptance of abid will be evidenced by a written Purchase Order/Contract delivered to the successful bidder. The successful bidderagrees to abide by the specifications, requirements, terms, and conditions contained in the Contract Documents.Contract Documents. The successful bidder will be required to enter into a Purchase Order/Contract that is acceptableto the City. Special Provisions within the contract may allow for the addition of attachments, amendments, and specialconditions that may be negotiated by the successful bidder and the City. Contract documents will consist of this bidinvitation, its attachment(s) and addenda, if any; the successful bidders completed and signed Bid Form; and a PurchaseOrder/Contract issued by the City. In the absence of any language to the contrary in the executed PurchaseOrder/Contract, this bid invitation, its attachment(s) and addenda, if any, will be the determining document in questionsof compliance with the specifications for this bid.Reservations. The City reserves the right to:• Postpone the date and time announced for receipt of bids by issuance of an Addendum at any time prior to thedeadline for receipt of bids;• Reject any bid that is conditional in any way or that contains erasures, items not called for, items not inconformity with applicable law, changes, additions, alternate proposals, or any other modifications of the BidForm which are not in accordance with the Bid Documents;• Make any investigations deemed necessary to determine if a bidder is responsive and responsible;• In the event only one bid is received in response to this bid invitation, require the sole bidder to submit cost orpricing data to assist in determining if the price is reasonable;3• Reject any or all bids, including any bids that are found to be non-responsive or submitted by a bidder that is notresponsible;• Waive minor defects or irregularities in any bid, provided that the discrepancy does not affect the bid amount orgive the bidder an advantage over others;• Award a Purchase Order to a single bidder for the entire procurement or to multiple bidders by line item, ingroups, or in phases, according to specifications.Scope:• Trip Hazard: A trip hazard is defined as a vertical displacement between adjacent sidewalk panels that measure+0.25 inches or greater• Contractor will be responsible for providing all necessary labor, equipment, and materials to permanentlyremove sidewalk trip hazards.• Contractor will provide dust control, traffic control, cleanup, and disposal of materials to ensure the effectivecompletion of repairs.• All trip hazards must be eliminated across the entire width of each affected sidewalk joint, resulting in zerodifferential between adjacent slabs. Repairs must address hazards measuring between +0.25 inches and 1.5inches, with the finished slope not exceeding a maximum of 1:12.• Use of grinding, pulverization, or fill materials is not permitted. Contractors are required to use dry dustabatement systems, as water-based slurry systems are prohibited.• Itemized invoices must be submitted. These invoices must include the measurements, the width of the repair,the physical location of the hazard, photos of each repair, and the unit cost for the work performed. Dataportability should be in the form of KML files or equivalent.Repair method will not damage homeowner’s driveway panels when hazards repairs on adjacent panels areperformed. The Contractor shall be responsible for all repairs resulting from their work.• Repair method must not cause any damage to landscape, retaining walls, curbs, sprinkler heads, utility covers orother objects adjacent to sidewalks. Contractor will be responsible for any and all repairs.• All debris will completely and immediately be cleaned up after each hazard is repaired. All costs incurred fordisposal of waste materials shall be included in unit cost and not paid for separately.• The Contractor shall provide the Street Superintendent with a daily summary of work completed.• The Contractor shall identify any sidewalks they are unable to shave and provide written notice of such locationsto the City of Derby.4Project Location:• Addendum 1 – Map of identified sidewalk locations for shaving and repair, attached hereto and incorporated byreference.• Addendum 2 – List of streets, attached with corresponding sidewalks identified for the project, attached heretoand incorporated by reference.• The locations listed in Exhibit A represent areas identified by the City of Derby as requiring corrective action;however, quantities and exact extents of work at each location may vary based on sidewalk conditions.General Requirements:• Daylight hours for the purpose of these specifications are defined as the period one-half hour aftersunrise to one-half hour before sunset. The contractor will provide the schedule for work.• Performance of work on Saturdays is optional with the Contractor.• If required, the Contractor shall be responsible for all traffic control for the work required and follow thestandard set forth in the MUTCD manual.Payment:• Payment shall be made in full to the Contractor upon completion of the project and final inspection by the City ofDerby.5
