Bids shall be submitted in a sealed envelope and shall bemarked on the outside as follows:NAME AND ADDRESS OF COMPANYCLARK HEISTERITB# PW-2025-02Bid Submittal Instructions: Vendors are to submit 1 original signed document and 2 copies of the same. Any deviation from the requirements set forth for the labeling of bid envelopes shall resultin said bid being returned to the bidder unopened and any such bid shall not beconsidered. Sealed bids shall be addressed to the attention of Brian McBrayer and mailed to WhitfieldCounty Board of Commissioners, P.O. Box 248, Dalton GA 30722-0248 or delivered to theBoard of Commissioners’ Office, Courthouse Annex, 201 S Hamilton St., 4th floor, Dalton,GA 30720. All bids shall be received on or before the above designated date and time. Any bidreceived after this date and time shall not be accepted. Bids shall be typed or submitted in ink.Bids will be publicly opened and read. Bids are legal and binding upon the bidder whensubmitted. It is understood that this contract, if accepted by Whitfield County, is entered into for theconvenience of the county, and in no way precludes the county from obtaining like goods fromother suppliers upon prior approval of the Whitfield County Board of Commissioners. Suchapproval shall be made at the sole discretion of the Board of Commissioners and shall beconclusive. The equipment shall be in compliance with the specifications as prepared by theState Highway Engineer. The equipment shall be produced in accordance with the laws ofGeorgia under the supervision and to the satisfaction of the Department of Transportation andWhitfield County. Whitfield County reserves the right to accept or reject any or all bids for any reason, to waivetechnicalities, and to make an award deemed in its best interest. The county shall have the rightto delete a unit item from the bid if necessary or proper in the sole determination of the county. Effective July 1, 2012 any vendor that provides a service to Public Works will be required tosubmit verification that your company is complaint with O.C.G.A 13-10-91, which states that theindividual, firm or corporation which is engaged in the physical performance of services under acontract to Public Works has registered with and is participating in a federal work authorizationprogram. PURPOSEThe intent of this invitation to obtain competitive sealed bids so that Whitfield County Public Workswill have the ability to purchase a CLARK S30L.P. Heister.2. PricingAll bids must include any and all freight charges.3. DELIVERY POINTEquipment shall be delivered to the specific site as specified by WCPW.170 Gillespie DR.Dalton, GA 307214. TIME OF PERFORMANCEWCPW reserves the right not to be restricted to only the lowest bidder.5. COMPLETION OF PERFORMANCEBidder will successfully complete the terms of the contract when the equipment as specified isdelivered as specified and the associated delivery ticket has been submitted to WCPW.The Vendor shall comply with all laws, ordinances, rules and regulations of any governmental entitypertaining to the supply of any items or services pursuant to this ITB and resulting Contract.6. QUANTITIESThis is a unit/price contract. The County shall not be bound to purchase a minimum quantity norrestricted to a maximum quantity during the initial contract agreement period and any subsequentrenewals.7. CANCELLATIONThis contract may be cancelled by either party, for any reason, by giving written notice to the otherparty.8. INDEMNIFICATION / HOLD HARMLESSThe vendor that is selected as the contractor shall, at its own expense, protect, defend, indemnify,save and hold harmless Whitfield County and its elected and appointed officers, employees, servantsand agents from all claims, damages, lawsuits, costs and expenses including, but not limited to, allcosts from administrative proceedings, court costs and attorney fees that Whitfield County and itselected and appointed officers, employees, servants and agents may incur as a result of the acts,omissions or negligence of the contractor or its employees, servants, agents or subcontractors thatmay arise out of the agreement.9. DRUG-FREE WORKPLACE CERTIFICATIONBy signing the Supply Service Contract form, I certify that the provisions of Code Sections 50- 24-1through 50-24-6 of the Official Code of Georgia Annotated, relating to the “Drug- free Workplace Act”,have been complied with in full. The undersigned further certifies that:a) A drug-free workplace will be provided for the Contractor’s employees during performance ofthe contract; and,b) Each Contractor who hires a subcontractor to work in a drug-free work place shall secure fromthat subcontractor the following written certification:
