NOTICE TO BIDDERSPUBLIC NOTICE IS HEREBY GIVEN that sealed bids will be received by the BOROUGH OF SEASIDEPARK for the NJIB CLEAN WATER APPLICATION STORMWATER MAINTENANCE EQUIPMENTREBID in BOROUGH OF SEASIDE PARK, OCEAN County, New Jersey.Bid forms, contracts and specifications are available by contacting Remington & VernickEngineers. Contact shall be made by phone or by email to make bid purchase arrangements. At 732-286-9220 or by submitting TR_RVEbidinterest@rve.com.Said Bids will be received, opened and read aloud in public at the Borough Of Seaside Park, 1701N OCEAN AVE, SEASIDE PARK 08752 on April 16, 2026, At 11:00 A.M.Electronic download link for copies of the bid forms, contracts and specifications may be obtainedfrom said Remington and Vernick Engineers, by prospective bidders upon request, upon payment ofthe sum of $50.00 for each set. Should interested bidders not have the ability to handle electronicdownload sets, a set may be arranged to be sent overnight by calling 732-286-9220.NO BIDS ARE TO BE PICKED UP AT THE ENGINEER’S OFFICE OR AT THE MUNICIPALITY OFFICES.PAYMENT MUST BE RECEIVED PRIOR TO OBTAINING SAID SPECIFICATIONS.NO BIDS ARE TO BE DROPPED OFF AT THE ENGINEER’S OFFICE.ALL BIDS ARE TO BE DELIVERED PRIOR TO THE BID OPENING DATE AND TIME.The scope of work for this project will consist of furnishing various pieces of equipment to be usedfor Stormwater Management to ensure clean water within the Borough of Seaside Park. Equipmentpurchase is to include a vacuum sewer cleaner truck, street sweeper, compact street sweeper andtrailer mounted diesel generator. The equipment shall be new, factory tested, and delivered to theBorough of Seaside Park, ready for use. All equipment shall feature the manufacturer's standardwarranty.The BOROUGH OF SEASIDE PARK reserves the right to consider the bids for sixty (60) days after thereceipt thereof, and further reserves the right to reject any or all bids, either in whole or in part andalso to waive any informality in any and make such awards or take action as may be in compliancewith the New Jersey Local Publics Contract Law N.J.S.A. 40A:11-1 et. Seq.If indicated, bid proposals must be accompanied by a certified check, cashier's check, or bid bondin the amount of ten per centum (10%) of the total amount of the bid, but not in excess of twentythousand ($20,000) dollars and made payable to the BOROUGH OF SEASIDE PARK.The award of the contract shall be made subject to the necessary moneys to do the work beingprovided by the BOROUGH OF SEASIDE PARK in a lawful manner. The contract to be executed bythe successful bidder will provide that it shall not become effective until the necessary moneys todo the work have been provided by the BOROUGH OF SEASIDE PARK in a lawful manner. The awardshall further be subjected to the securing of necessary State, Federal or Local permits governing thework.Bidders are required to comply with the requirements of N.J.S.A. 10:5-31 et seq., N.J.A.C. 17:27(Affirmative Action), N.J.S.A. 34:11-56.25 et seq.(New Jersey Prevailing Wage Act), and Americanswith Disabilities Act of 1990 (42 U.S.C. S12101, et seq.).The contractor is further notified that he must comply with N.J.S.A. 52:25-24.2 and submit aDisclosure Statement listing stockholders with his bid.The contractor is further notified that he must comply with N.J.S.A. 34:11-56.48 et seq. Public WorksContractor Registration Act and he and any subcontractors must be registered in accordance withthe act.The contractor is also further notified that he must comply with N.J.S.A. 52:32-44 and submit proofof business registration and submit proof of business registration for any named subcontractors inaccordance with the act.This contract or subcontract is expected to be funded in part with funds from the New JerseyDepartment of Environmental Protection and the New Jersey Environmental Infrastructure Trust.Neither the State of New Jersey, the New Jersey Environmental Infrastructure Trust nor any of theirdepartments, agencies or employees is, or will be, a party to this contract or subcontract or anylower tier contract or subcontract. This contract or subcontract is subject to the provisions ofN.J.A.C. 7:22-3, 4, 5, 9 and 10.This contract or subcontract is expected to be funded in part with funds from the New JerseyDepartment of Environmental Protection and the New Jersey Environmental Infrastructure Trust.Neither the State of New Jersey, the New Jersey Environmental Infrastructure Trust nor any of theirdepartments, agencies or employees is, or will be, a party to this contract or subcontract or anylower tier contract or subcontract. This contract or subcontract is subject to the provisions ofN.J.A.C. 7:22-3, 4, 5, 9 and 10.The project is funded in part by the New Jersey Environmental Infrastructure Trust and the successfulbidder must comply with all provisions of N.J.A.C. 7:22-9 et seq. for the participation of smallbusiness enterprises owned and controlled by socially and economically disadvantaged individuals(SEDs). This invitation to bid is on an unrestricted basis whereby the successful bidder must fulfillthe SED utilization requirements. The agencies specified in N.J.A.C. 7:22-9.13(a)8 will have a list ofeligible SED firms and shall, upon request, provide them to the MUNICIPAL CORPORATION. TheMUNICIPAL CORPORATION, during the bidding phase, will provide copies of the list to allContractors on unrestricted contracts.Contractor shall be required to comply with the Project Plan developed by the Borough Of SeasidePark fulfilling the SED utilization. All prime Contractors will be required to submit a SED UtilizationPlan to the Borough of Seaside Park and the NJDEP Office of Equal Opportunity and Public ContractAssistance no later than thirty (30) days after notification that they are the low bidder. The Contractorshall award no less than ten (10) percent of the total amount of all contracts for building, materials,equipment or services for the project to SED’s.Bidders are required to comply with the requirements of N.J.S.A. 10:5-31 et seq. and N.J.A.C. 17:27(P.L. 1975, c.127, Affirmative Action); P.L. 1963. C150 (New Jersey Prevailing Wage Act); andAmericans with Disabilities Act of 1990 (42 U.S.C. 12101, et.seq.).Pursuant to N.J.A.C. 10:5-33, “Bidders are required to comply with the requirements of P.L. 1975, c.127.”The contractor is further notified that he must comply with P.L. 1977, c. 33, and submit a DisclosureStatement listing stockholders with his bid.The contractor is further notified that he must comply with P.L. 1999 c.238 Public Works ContractorRegistration Act and he and any subcontractors must be registered in accordance with the act.The contractor is also further notified that he must comply with P.L. 2004 c. 57 and submit proof ofbusiness registration and submit proof of business registration for any named subcontractors inaccordance with the act.In accordance with N.J.A.C. 7:22-3.17(g) and N.J.A.C. 7:22-4.17(g), all applicable surety bondsrequired in connection with the advertisement and award of building contracts or sub-agreementsmust be written by a surety company listed on the Federal Treasury List (Department Circular 570-Surety Companies Acceptable on Federal Bonds), incorporated herein by reference.
