GENERAL INFORMATION AND SCOPEThe County of Portage Wisconsin (County), through its Purchasing Department (Purchasing), requestsbids to establish a contract for the purchase of Bituminous Oil applied on County roads. A map of theproposed roads is shown in Attachment D.The attached Standard Terms and Conditions shall govern this bid unless specifically modified in thesebid documents. Conditions of bid that include the word "must" or "shall,” describe a mandatoryrequirement. All specifications are defined as mandatory minimum requirements unless otherwisestated. If no bidder is able to comply with a given specification or condition of bid, Purchasing reservesthe right to delete that specification or condition of bid. Failure to meet specification requirements shalldisqualify your bid. Vendors may not submit their own contract document as a substitute for theseterms and conditions.Retain a copy of these Bid documents for your files. Should you receive an award, these Bid documentsbecome your contract terms and conditions.Contract Execution: Portage County utilizes a web based electronic signature program (DocuSign) for theexecution of contracts that do not require notarization. By submitting your bid you are agreeing to theuse of this program to sign documents should you receive an award. Bidder must bid on the enclosed Bid OfferForm.5. BID SUBMISSIONBidders must submit an original and one copy including all required materials for acceptance of their bidby the date and time listed on the Bid Cover Sheet. Any bids received after that time and date will berejected. Receipt of a bid by the US mail system does not constitute receipt of a bid by Purchasing, forpurposes of this RFB. BID RESPONSE REQUIREMENTSIn order for your bid to be considered, the following information must be provided by the due date andtime listed on the bid cover page. Failure to include any required documents will disqualify your bid.Include an original and a copy:6.1 Signature and Authority Affidavit Form, Attachment A (Acknowledge addendum(s) if any.)6.2 References Sheet, Attachment B6.3 Bid Offer Form, Attachment CThe Signature and Authority Affidavit submitted in response to this RFB must be signed by the person inthe Contractor's organization who is responsible for the decision as to the prices being offered in the Bidor by a person who has been authorized in writing to act as agent for the person responsible for thedecision on prices and services. Failure to provide these forms/information with your bid submittal maydisqualify your bid. The County encourages all bidders to print their submission double-sided to savepaper7. METHOD OF AWARDAward(s) shall be made on the basis of the lowest and most advantageous unit price per item from aresponsive, responsible bidder(s) who meets specifications. Multiple bidders may be awarded.Timeliness of delivery may be considered when making this award.8. BIDDER/CONTRACTOR QUALIFICATIONSTo be eligible for a contract award, you must be qualified and able to provide the following:8.1 Bidder must supply references of three firms to which similar services have been provided duringthe past five years to a comparable-sized institution or company. If contacted, all of thosePORTAGE COUNTYWISCONSINBID #2026-10PCPAGE 5 OF 14references must verify that a high level of satisfaction was provided. Use Attachment B to listreferences.8.2 Bidder must be in the business of applying bituminous oil for the past five years.8.3 Awarded contractor must provide Purchasing a Certificate of Insurance and maintain the minimumlimits specified for the term of the contract. All policies must be issued with a 30-day cancellationnotice, by an insurance company licensed to do business in the State of Wisconsin, with aminimum AM Best rating of A1, and signed by an authorized agent.Maintain worker's compensation insurance as required by Wisconsin Statutes, for all employeesengaged in the work.Maintain commercial liability, bodily injury and property damage insurance against any claim(s)which might occur in carrying out this agreement/contract. Minimum coverage shall be onemillion dollars ($1,000,000) liability for bodily injury and property damage including productsliability and completed operations. Provide motor vehicle insurance for all owned, non-owned andhired vehicles that are used in carrying out this contract. Minimum coverage shall be one milliondollars ($1,000,000) per occurrence combined single limit for automobile liability and propertydamage.8.4 It is the bidders responsibility to schedule and manage distributors and placements of nurse tanksdaily to meet production needs.8.5 All distributors shall be on the job site and ready to spray 30 minutes prior to scheduled daily starttime.8.6 All distributor operators shall have a minimum of 400 hours of operating experience with fullknowledge of chipseal operations and procedures.8.7 Contractor must supply an on-site foreman during chipseal operations to coordinate distributors andnurse trucks.8.8 Contractor shall calibrate all distribution equipment and provide records to Portage County whenrequested.9. SPECIFICATIONSThe following specifications are minimum acceptable requirements. Bid specifications may not berevised without an official written addendum issued by Purchasing.Material shall conform to the State of Wisconsin Specification Section 455. Certified analysis of materialswill be at supplier's expense if and when Portage County requires testing. The Highway Department willhave the right to procure samples of material at destination point. Failure of materials to comply withState specifications and/or Highway Department requirements shall result in rejection. There will be nodemurrage charges paid by the Highway Department. Late delivery of materials may cause forfeiture ofthe remaining season's contract.Upon award of the contract separate performance and payment bonds, each in the amount of onehundred (100) percent of the project price (including materials and labor), with a corporate suretyapproved by the owner will be required of the bidder for the faithful performance of the contract. Thisguarantee shall remain in effect until acceptance of the work by the owner.
