Bid Title: SERVICE SIX 1,000 GALLON VAULT TOILETS ALONG MT BLUE SKY
Category: Open Space Status: Open Description: Clear Creek County is seeking bids for a vendor that will service six (6) - 1,000-gallon vault toilets located on Colorado State Highway 5 (Mount Blue Sky Highway). This is part of the Mount Blue Sky Scenic Byway near Idaho Springs, Colorado, and begins at Colorado State Highway 103. Two (2) vault toilets are located at the Mount Goliath Natural Area/Dos Chappell Nature Center (approximate elevation 11,540 feet), and four (4) toilets are located at the Mount Blue Sky Summit (approximate elevation 14,130 feet). Clear Creek County is asking for bids for the following: per time serviced, to have clean, empty, functioning vaults after each service:
- Removal and disposal of any garbage or debris contained in the six (6) vaults before pumping;
- Pumping the entire contents of the six (6) 1,000-gallon concrete waste vaults;
- Transportation/fuel charges, if any; and
- Cost for any additional tasks or materials that have not previously been identified.
Additional relevant information includes:
- Colorado State Highway 5 (Mount Blue Sky Highway) is typically open and accessible to the public annually from Memorial Day Weekend through Labor Day Weekend;
- Colorado State Highway 5 has been closed to the public since September 3, 2024;
- Colorado State Highway 5 (Mount Blue Sky) was rebuilt in 2025;
- All six (6) vault toilets were pumped and locked before this closure;
- Historical use has seen the vaults pumped two (2) times per season (halfway through the season and then at the end of the season:
- The County will notify the vendor of the need to pump the vault toilets when they are nearing capacity;
- Servicing is to be done Monday through Friday early in the day to facilitate access;
- Vault openings are standard openings;
- To pump the vault toilets, the trucks will need a hose for the Mount Goliath Natural Area where they will access the pumping through the risers in the toilet. At the Mount Blue Sky Summit, the vault toilets can be accessed through the service road gate. Trucks will need to back up to the openings in the rear of the vault toilets;
- All toilets pumped will require a 3” re-charge of water. The 3” depth is measured directly below the riser from the bottom of the tank. Water for re-charging shall be considered incidental to the pumping; and
- Willingness to provide additional service, if usage indicates the need.

County shall have the right within such period to inspect such books,records and documents upon demand, with reasonable notice and at a reasonable time, forthe purpose of determining, in accordance with acceptable accounting and auditingstandards, compliance with the requirements of this Agreement and the law.6. Project Management: Enter Name of Proj. Mgr. for Consultant. shall be designatedas the Consultant’s Project Manager for the Services. Enter Name of Proj. Mgr. for County. shallbe County’s Project Manager responsible for this Agreement. All correspondence between theparties regarding this project shall be between and among the project managers. Independent Contractor: It is expressly acknowledged and understood by the partiesthat nothing contained in this Agreement shall result in, or be construed as establishing, anemployment relationship. Consultant shall be, and shall perform as, an independent contractor. Noagent, employee, or servant of Consultant shall be, or shall be deemed to be, the employee, agentor servant of County. Consultant shall be solely and entirely responsible for its acts and for theacts of Consultant’s agents, employees, servants and subcontractors during the performance of thisAgreement. Consultant understands and agrees that Consultant is not entitled tounemployment insurance benefits unless unemployment compensation coverage is providedby the Consultant or some other entity, and that the Consultant is obligated to pay federaland state income tax on any moneys paid pursuant to the contract relationship.8. Personnel: Consultant understands and hereby acknowledges that County is relyingprimarily upon the expertise and personal abilities of Enter Name of Consultant’s Principal or Proj.Mgr., and this Agreement is conditioned upon his/her continuing direct personal involvement inthe Services. County understands that other employees of Consultant will be working on portionsof the Services; however, these employees shall be under the direct supervision of the personidentified in this paragraph at all times; in the event that s/he is unable to remain involved in theServices, Consultant shall immediately notify County and County shall have the option toterminate this Agreement.9. No Assignment: The parties to this Agreement recognize that the Services to beprovided pursuant to this Agreement are professional in nature and that by entering into thisAgreement County is relying upon the personal services and reputation of the person(s) identifiedin the preceding paragraph.
