FMFCD Contract “EF-42”NC-1FRESNO METROPOLITAN FLOOD CONTROL DISTRICTNOTICE TO CONTRACTORSThe Board of Directors of the Fresno Metropolitan Flood Control District hereby invitessealed proposals for Construction of Storm Drainage Facilities in Drainage Area “EF”,Contract “EF-42”, Fresno County, California.Sealed proposals will be received at the office of the Fresno Metropolitan Flood ControlDistrict, 5469 E. Olive Avenue, Fresno, California, before 2:15:00 PM, June 17, 2026 atwhich time they will be publicly opened, examined and declared by the District Engineer ofthe Fresno Metropolitan Flood Control District, who shall report his/her findings to the Boardof Directors, at a meeting scheduled to be held within forty (40) days.The Instructions to Bidders and other Contract Documents are available at the office ofthe Fresno Metropolitan Flood Control District, for examination without charge, andreference is made thereto for particulars.Copies of Plans, Special Provisions and Contract Documents may be secured at 5471 E.Olive Avenue, back building, upon payment of a fee of Ten Dollars ($10.00). Copies of theStandard Plans and Specifications may be purchased at a cost of Thirty Dollars ($30.00)per set. Portions of the Standard Plans and Specifications may be secured for a nominalfee. None of the aforementioned fees are refundable.The Contractor and all subcontractors shall be solely responsible for complying withGovernment Code Section 12940 where no discrimination shall be made in theemployment of persons upon public works because of race, religion, creed, color, nationalorigin, ancestry, physical disability, mental disability, medical condition, marital status, sex,gender, gender identity, gender expression, age, sexual orientation or military and veteranstatus of any person, subject to the exceptions set forth in Government Code Section12940.As provided for in Section 7-7 of the Standard Specifications, Contractor and allsubcontractors shall be solely responsible for complying with all statutes and regulationsgoverning the payment of prevailing wages, including, without limitation, Labor CodeSections 1725.5, 1771, 1774 and 1775, as amended. Moreover, this contract is subjectto monitoring and enforcement by the California Department of Industrial Relations (DIR).The Contractor and its subcontractors are required to register with DIR and submit certifiedpayroll reports to DIR and the District. Only Contractors and subcontractors registered withDIR can bid on District work or work under District contract. The Contractor and itssubcontractors shall register with the DIR by following the registration instructions on theDIR website at http://www.dir.ca.gov. The Contractor shall be solely responsible forcomplying with prevailing wage law and regulation and the proper enrollment andmaintenance of records. The Contractor shall be required to post a copy of the prevailingwages applicable to each trade used at each job site. The Contractor shall also post thosenotices required by California Code of Regulations Title 8, Chapter 8, Subchapter 4.5Section 16451(d), which are included in the Appendix of these Special Provisions. Thek:\design\project plans and special provisions\projects\ef-42\ef-42 special provisions.docxFMFCD Contract “EF-42”NC-2Contractor shall notify the District’s Engineering Technician, Adam Johnson, at (559) 456-3292, with any questions related to prevailing wages and/or DIR requirements.Moreover, the Contractor and all subcontractors shall inform themselves of, and shallcomply with laws and regulations governing the payment of travel and subsistence asrequired by Section 7-6 of the Standard Specifications.Bids are required for the entire work described in the Engineer’s Estimate of Quantitiesfollowing. The quantities are approximate only, being given as a basis for the comparisonof bids, and the Board of Directors does not expressly or by implication agree that the actualamount of work will correspond therewith but reserves the right to increase, or decrease,the amount of any class or portion of the work, or to omit portions of the work, as may bedeemed necessary or advisable by the Engineer.No contract will be awarded to a Contractor who is not registered with DIR, has not beenlicensed in accordance with the provisions of the Contractors State License Law, CaliforniaBusiness and Professions Code, Division 3, Chapter 9, as amended, and whose bid is noton the proposal form included in the contract document. A valid California Contractor’slicense, Class A, (General Engineering) is required for this project.The Board of Directors reserves the right to reject any or all bids, to award or reject anycombination of items as it sees fit, and to waive any informality in any bid received.Cash, a cashier’s check, certified check or bidder’s bond, in the amount of not less thanten percent (10%) of the amount of the bid, shall accompany each proposal, madepayable to the order of the Fresno Metropolitan Flood Control District, as a guarantee thatthe bidder will, after being notified of the acceptance of his/her bid, make a contract withthe Fresno Metropolitan Flood Control District in accordance therewith, and will furnishthe required contractor’s bonds. The bonds required of the successful bidder are a faithfulperformance bond in the amount of one hundred ten percent (110%) of said bid and apayment bond in an amount equal to one hundred percent (100%) of the amount of saidbid, in accordance with the provisions of Sections 3247-3251 of the California Civil Code.If the successful bidder fails to execute the contract for which the bid is accepted and failsto furnish the required bonds within ten (10) days after the mailing of notice of the awardof the contract to the successful bidder, the Board of Directors shall have just cause forannulment of the award and forfeiture of the proposal guarantee. In this case, the Boardof Directors reserves the right to award the contract to one of the other bidders or rejectall bids.Proof of insurance (Certificate of Insurance) certifying coverage in the minimum amountsrequired by these Special Provisions and Section 7-13 of the Standard Specificationsshall be submitted to the District before 5:00 p.m. on the second business day followingthe opening of bids or as extended in writing by the District.
