Construction PlansSECTION INOTICE TO BIDDERNOTICE TO BIDDERSRECEIPT AND OPENING OF BIDS: The City of Glenn Heights, Texas, (herein referred to as "the City" and"Owner") invites sealed bids on the form attached hereto, all blanks of which must be appropriately filledin. Bids will be received by the City Secretary Office, City of Glenn Heights, 1938-C S Hampton Road,Glenn Heights, Texas, 75154 until 2:00 p.m. Thursday, March 19, 2026, from all qualified and properlylicensed contractors desiring to furnish the City with all materials, machinery, equipment,superintendence, and labor, and insurance necessary to commence and complete the Project. Bidsreceived after 2:00 PM CST will be deemed non-responsive. The envelopes containing the bids must besealed and addressed to the Sherry Roberts, Finance Director, of the City of Glenn Heights and clearlymarked in the lower left-hand corner: Bid for JENKINS LANE ALLEY IMPROVEMENTS, GLENNHEIGHTS, RFB 2026-01.All stated time periods stated here are in calendar days.Sealed bids must be received by the above-stated time and date, immediately after which time thesubmitted bids will publicly be opened and read aloud. Any bids received after the above-stated time willbe returned unopened.The City reserves the right to reject or to accept any or all bids, or to waive any informality.The plans, specifications, and contract documents are available at City Hall, 1938 S. HamptonRoad, Glenn Heights, Texas, 75154. Prospective bidders must call (972) 223-1690 ext. 430(Andrew Waits) to arrange for pickup of the documents.Digital (PDF) plans are also available at no cost at https://glennheightstx.gov/Bids.aspx.Each bid must be accompanied by a certified check or cashier's check payable to the City of Glenn Heightsand drawn on a responsible bank or an approved bidder's bond for the sum of 5% of the amount of themaximum total bid as a guarantee that, if awarded the contract, the bidder will promptly enter into acontract and execute the bonds on the forms provided in the contract documents. No bidder may withdrawa bid within 60 days after the actual date of the opening thereof.1. BID PROPOSAL FORM: Bidders shall use the bid proposal form included in the RFB 2026-01documents, which must be kept bound. Supplemental data to be furnished shall be includedin the same sealed envelope with the bid proposal.Oral bids will not be considered. Corrections, deletions, or additions to the bid must be made inperson by replacing the original submitted bid prior to the opening time of the bids andconfirmed by letter. No verbal, electronic or facsimile corrections, deletions, or additions willbe accepted.The Bid shall contain an acknowledgment of receipt, if any, of all Addenda. (The numbers ofwhich must be filled in on the Bid Form).2. DELIVERY OF PROPOSAL: It shall be the Bidder's responsibility for the delivery of his proposalat the proper place by the time stated in the Notice to Bidders. The mere fact that a proposalI-1was dispatched will not be considered. Each proposal shall be in a sealed envelope plainlymarked as described in section I, in “Receipt and Opening Bids” paragraph.3. QUALIFICATION OF BIDDER AND REJECTION OF BIDS: The Owner may make such investigationsas it deems necessary to determine the ability of the bidder to perform the work, and the bidder shallfurnish to the Owner all such information and data for this purpose as the Owner may request.The Owner reserves the right to reject any and all bids. Owner may reject the bid if the evidencesubmitted, either by the bidder or from an investigation of the bidder, fails to satisfy the Ownerthat such bidder is properly qualified to carry out the obligations of the contract and thereforeto complete the work contemplated herein. Conditional bids will not be accepted.To demonstrate qualifications to perform the Work, each Bidder must be prepared to submitwithin five days of Owner's request written evidence, such as financial data, previousexperience, present commitments, and other such data as may be called for.4. BIDDER'S AFFIDAVIT SAFETY RECORD: All contractors bidding on City of Glenn Heightsprojects must submit with the proposal a notarized affidavit with their bid attesting to theirsafety record.The Contractor must provide safety records from the Dallas OSHA office or the local OSHA office inwhich the firm is located. The Contractor's safety record may not reflect penalties for six (6) or moreserious violations, none of which may be repeat violations; nor may it reflect three (3) or more willfulviolations, none of which may be repeat violations, within three (3) years preceding award. Thisinformation will be considered in determining the responsibility of the bidder for purposes of theaward.5. BID SECURITY: All bids must be accompanied by a Bid Bond or a certified or cashier's check drawnon a U.S. bank made payable to the order of City of Glenn Heights, in the amount of five (5%) percentof the maximum bid proposal, as surety that the successful bidder will enter into his or her proposedContractor's Agreement with the City. The City will retain payment if the successful bidder does notexecute the City's Contractor's Agreement with the City in the form of the contract attached heretoand furnish the City with the required bonds and insurance within seven (7) days of the notification ofbid award. Bids submitted without the required bid bond will not be considered. All checks/bid bondswill be returned promptly after the owner & accepted bidder have executed the contract or if no awardhas been made within 60 days after the date of the opening of bids.6. SURETY BONDS: Contractor Surety: With the execution and delivery of the contract, theCONTRACTOR shall furnish and file with the OWNER in the amounts herein required, the suretybonds specified hereunder, without exception, the owner's bond forms must be used, and exclusivevenue for any lawsuit in connection with such bonds shall be specified as the county in which theOWNER'S principal office is located. Such surety bonds shall be in accordance with the provision ofChapter 2253, Texas Government Code, and Article 7.19-1 of the Vernon’s Texas Insurance Code,as amended. These bonds shall automatically be increased by the amount of any change order orsupplemental which increases the contract price with or without notice to the surety, but in no eventshall a change which reduces the contract amount reduce the penal amount of such bonds.a) PERFORMANCE BOND: In accordance with Chapter 2253 of the Texas Government Code,a performance bond in the amount of not less than one hundred percent (100%) of thecontract price conditioned upon the faithful performance of the contract for projects with aI-2
